Guideline and Application Form For Relaxation of Compulsory Service
a. Please read the information below before completing the Application Form.
b. You are expected to comply with ALL the terms and conditions stipulated herein.
c. Malaysian Medical Council (MMC) will not be held responsible to the consequences
from the delay in processing your application due to non-adherence to any of the
requirements stated below.
1. Pursuant to section 40 of the Medical Act 1971, every practitioner has to serve a
continuous total period of not less than TWO years within the public services upon
being given full registration.
2. Under section 41 of the Medical Act 1971, a person who commences to serve in a post
in a public service in pursuance of a notice issued under subsection 40(1) of the Medical
Act 1971 shall continue to serve in the said post or in such other subsequent post in the
same or such other public service as may from time to time be determined by the Director
General in his discretion for a continuous total period of not less than two years to the
satisfaction of the Director General and if he fails to do so, he shall be guilty of an offence
under this Act.
3. Though government agencies are deemed public services according to Article 132 of the
Federal Constitution, section 40(4)(b) and section 41 of the Medical Act 1971, however,
empowers the Director-General of Health to determine which public services where one
can practice to complete his compulsory services. As for now, the Director-General
considers only services within the Ministry of Health and other public services as
fulfilling such legal requirement;
4. It is an OFFENCE under the Act for any practitioner who fails to complete his
compulsory service as determined by the Director General. Upon conviction in court, the
registration of such person shall be deemed to be revoked and the Registrar is shall
accordingly strike off the name from the Register (section 40(3) of the Medical Act
1971);
5. However, under section 42 of the Medical Act 1971, the Honourable Health Minister
may grant reduction, exemption or postponement from the period of service;
6. To avoid committing an offence, if you are unable or do not intend to complete the
compulsory service, you can either apply for:
a. reduction, exemption and postponement from the Honourable Health Minister ; or
b. consideration from the Director-General of Health for your services in MOH or any
public services as fulfilling the legal requirement.
7. The eligibility criteria are:
a. For reduction:
Will only be considered for those who have served at least 1 year and 6 months of
time in the public sector.
b. For postponement:
Generally, postponement is considered for practitioners who need to leave MOH or
other public services before the two-year period and intend to complete the
compulsory service once the postponement period’s end.
Practitioners without postgraduate qualifications wishing to join the academic sector
before completing their services in the MOH may apply for a postponement.
c. For consideration:
Practitioners who possess a postgraduate qualification and wish to practice in the
academic sector or have secured a job offer in other public agencies may apply for
consideration from the Director-General of Health.
However, only those who have applied and granted postponement by the Honourable
Minister are eligible to apply for consideration to be backdated. Those who have
never applied may only be considered for consideration from the application date.
d. For exemption:
a) Malaysian citizens who are practising abroad and intend to return and practicing in Malaysia
are eligible for exemption of compulsory service if they fulfil one of the following criterias:
i. Practitioner who is 40 years old and above at the time of application, with or without
a postgraduate qualification.
ii. Practitioner who possess a postgraduate qualification registrable with National
Specialist Register (NSR) AND has secured an employment post in public or private
higher education institution in Malaysia as a lecturer in the medicine faculty for a
continuous total period of not less than 2 years,; or
iii. Practitioner who is fully registered but did not secure any offer of employment in
public services after 6 months of application for employment.
b) Local practitioner who is fully registered but did not secure any offer of employment in
public services after 6 months of application for employment.
8. Please ensure that ALL mandatory fields marked * are completed (preferably type-
written in BLOCK LETTERS) before you submit;
9. Please provide addresses in Malaysia for resident and postal address.
10. Application will be processed only after all the required document completely submitted.
