MEMORANDUM OF AGREEMENT

STUDENT INDUSTRY INTERNSHIP/OJT PROGRAM

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is entered into by and between:

________________________, a company duly organized and existing under the Philippine laws,
with principal office address at ________________________________, Pampanga, Philippines
represented herein by its _______________________, ________________________________,
hereinafter referred to as the “COMPANY.”

and

City College of Angeles, a school duly recognized by the Commission on Higher Education
(CHED) and existing under the Philippines laws with principal office address at Arayat
Boulevard, Barangay Pampang, Angeles City, represented herein by its President, Dr. Richard G.
Daenos, hereinafter referred to as the “COLLEGE.”

WITNESSETH:

WHEREAS, the College acknowledges that one of the means of achieving its mission is to
develop the moral and academic growth of its students, and to expose them to commerce best-
practices and realities in various fields;

WHEREAS, the College, in the quest of its objectives, aims to mold responsible, efficient
and flexible individuals through intellectual trainings in diversified lines of work;

WHEREAS, the Company concedes the expressed need of the College to assign its
students to actual office work and/or field work settings for the purpose of supplementing their
acquired higher learning, and is prepared to help the students in this undertaking;

WHEREAS, the Company shall provide the students with learning experiences, in
preparation for the actual application of the students’ knowledge based on their chosen courses
after graduation.

The parties hereby bind themselves to undertake a Memorandum of Agreement for the purpose
of supporting the COLLEGE’s on-the-job training for student-trainees under the following terms
and conditions:

1. The COLLEGE shall be responsible for briefing the on-the-job student-trainees who intend
to conduct practicum exposure in the COMPANY as part of the COLLEGE’S curriculum;

2. The COLLEGE shall provide the on-the-job student-trainee the basic orientation on work
values, behavior, discipline and their intended duties and responsibilities as stipulated in the
Practicum Manual to ensure smooth cooperation with the COMPANY;

3. The COLLEGE shall issue an official endorsement vouching for the well-being of the on-
the-job student-trainee which shall be used by the COMPANY for processing the application
of the student-trainee;

4. The COLLEGE shall voluntarily withdraw a student-trainee who is found to misbehave


and/or act in defiance to existing standards, rules, and regulations of the COMPANY and
impose necessary college sanctions to the said student-trainee;

5. The COMPANY may/may not grant allowance and/or adequate insurance to student-trainee
in accordance with the COMPANY’S existing rules and regulations;

6. The COMPANY, upon consultation with the COLLEGE, may require qualified students to
submit themselves to examinations, interviews, and file pertinent documents to support their
application;

7. The COMPANY is not obliged to employ student-trainee upon completion of the training;

8. There is no employer-employee relationship between the COMPANY and the student-


trainee;

9. Unless otherwise agreed upon by the COMPANY and the COLLEGE. the duration of the
program shall be equivalent to:

 Bachelor of Library and Information Science: 200 working hours;


 Bachelor of Science in Accountancy: 400 working hours;
 Bachelor of Science in Accounting Technology: 200 working hours;
 Bachelor of Science in Computer Science: 500 working hours;
 Bachelor of Science in Information Systems: 500 working hours;
 Bachelor of Science in Tourism Management: 600 working hours;
 Bachelor of Technical Teacher Education: 270 working hours (Immersion I) / 540
working hours (Immersion II);

10. Any violation of the foregoing covenants will warrant the cancellation of the Memorandum
of Agreement by the COMPANY within thirty (30) days upon notice to the COLLEGE.

NOW THEREFORE, for and in consideration of the above mentioned premises, the parties
hereto mutually agree as follows:

Roles and Responsibilities:

I. COMPANY

1. Accept City College of Angeles (CCA) students for Industry Immersion/ OJT (on-the-
job-training) endorsed by the College in its offices/departments as it may deem necessary
and/or appropriate based on the student’s qualification and field of specialization.

2. Observe due care and diligence to student-trainee in work situations and activities where
a higher degree of risks are anticipated.

3. Protect students against unacceptable conduct of sexual nature and cruel or inhuman
treatment by the Company staff.

4. Designate the Human Resource Department (HRD) to work with the College.

5. Provide students with variety of work assignments suitable to their chosen courses to be
supervised by an experienced staff.

6. Make a periodic evaluation of job progress based on the rating/criteria from provided by
the College.

7. Award the student-trainee an Industry Immersion/ OJT (on-the-job-training) Completion


Certificate at the end of the specified training period.

8. Shall not designate/assign the student-trainee in any hazardous work.

II. COLLEGE

1. Designate a practicum coordinator that will work with the Human Resources Department
(HRD) of the Company.

2. Endorse qualified students for Industry Immersion/OJT program for which a list shall be
submitted to the Company.

3. Offer necessary guidance and/or assistance to both student-trainees and HRD.

4. Provide for the coverage of accident and death insurance during the Industry Immersion/
OJT period and within the Company premises or during works done in relation to the
Industry Immersion/OJT Training Program.

5. Monitor progress and assist in evaluation of student.

6. Establish high standards and expectations for the student.

III. PROCEDURES

1. The Company and the College shall observe the following procedures:

2. The Practicum Coordinator shall endorse the qualified student trainee to the Company.

3. The Practicum Coordinator shall advise the student trainee to meet the HRD and submit
the following:

 Resume
 Endorsement
 Training Agreement
 Reply Form

4. After verifying the submitted documents, the HRD shall accept the application for
Industry Immersion/OJT of the student and conduct an orientation to the student on
rudiments of Industry Immersion/ OJT (on-the-job training) Program.

5. The HRD shall introduce the student-trainee to work mentor and supervisor after such
training.

6. The supervisor shall give specific instruction to the student trainee on work norms and
responsibilities.

7. The supervisor shall accomplish an evaluation of the student trainee at the end of his/her
training period and submit the form to the HRD.

8. The HRD shall prepare the Industry Immersion/ OJT (on-the-job training) Completion
Certificate of the student apprentice for submission to the College.

IV. GROUNDS FOR WITHDRAWAL OF THE STUDENT INDUSTRY IMMERSION/
OJT (ON-THE-JOB TRAINING)

Both parties agree that students can be withdrawn from the Industry immersion/ OJT (on-the-job
training) Program on the following grounds:

1. Wilful disobedience to the company rules and regulations.


2. Insubordination to lawful orders of the supervisor.
3. Violence or other forms of gross misconduct by the student while inside the Company
premises.
4. Immoral, physical, sexual abuse or harassment of the student by the employer or any of
its employees.
5. Poor performance on the job for a prolonged period despite warnings duly given to the
student apprentice.
6. Habitual neglect of his/her assigned duties/tasks.
7. Dishonesty or misconduct.
8. Poor physical condition, permanent disability or prolonged illness which incapacitates the
apprentice.
9. Theft or malicious destruction of company property and/ or equipment.
10. Substandard or hazardous working conditions.
11. Repeated violations by the employer of the terms of the Industry immersion/ OJT (on-
the-job training) agreement.
12. Cruel and inhuman treatment by the employer or his subordinates.
13. Personal problems which in the opinion of the trainee shall prevent him/her a satisfactory
performance of his/her job.
14. Non-enrolment or dropping out from the University.

V. TERM AND EFFECTIVITY:

This Memorandum of Agreement shall become effective upon signature of both parties
and implementation will begin immediately and shall continue to be valid three (3) years until
written notice is given by either party thirty (30) days prior to the date of intended termination.

However, this Memorandum of Agreement does not automatically require the


COMPANY to accommodate student-trainees and the COLLEGE to send student-trainees to the
COMPANY for the duration of its effectivity. Prior to the start of the internship program, the
COLLEGE or the COMPANY may express in writing its formal request for student-trainees.
Only when there is a need on the COMPANY’s part will student-trainees be endorsed in the
COMPANY following the Procedure stipulated in this MOA. However, the COLLEGE still
reserves the right whether to endorse student-trainees or not in the COMPANY.
