Cory transferred to Doris a parcel of land for the price of P100,000, P30,000 to be paid
in cash and for the difference, she will convey her car worth P70,000. What kind of
contract is this?
ANSWER:
This is a contract of barter. Article 1468 states that if the consideration of the contract
consists partly in money, and partly in another thing, the transaction shall be
characterized by the manifest intention of the parties. Here, intention between the
parties cannot be ascertained that the contract be one that of a sale. Thus, this contract
shall be considered a barter since the consideration is also the equivalent of the amount
of money.
