The building is a dwelling. Count 4, 5, 6- A person Is guilty of possession of burglar’s tools when he possesses any tool, instrument or other article adapted, designed or commonly used for committing or facilitating offenses involving forcible entry into premises, or offenses involving larceny by a physical ‘taking, or offenses involving theft of services as defined in subdivisions four, five and six of section 165.15, under circumstances evincing {an intent to use or knowledge that some person intends to use the same in the commission of an offense of such character. ‘To Wit: On 02/24/2021 at 12:20pm, while at 307 N Wyoming Avenue, North Massapequa in Nassau County, the defendant, Nicholas Fileccia, did knowingly and enter and remain unlawfully in the dwelling with an intent to commit a crime. The defendant did effect entry Into the dwelling wearing a light-colored shirt and running pants with strips down the side, wearing a backpack and carrying a duffle bag raped over his arm, the defendant stated to victim 2, he was, ‘looking for Chris” before being confronted by victim 2's sister in law, the defendant the went to approach victim 2 before being told to leave, the defendant then attempted to look through vietim 2's mail before exiting the dwelling, (On 02/24/2021 at while at 94 Lawrence Street, Farmingdale NY in Nassau County, the defendant, Nicholas Fileccia, did knowingly and enter and remain unlawfully in the dwelling with an intent to commit a crime. The defendant di effect entry into the dwelling, victim 3 did hear their dog barking and went to check around the house to find the defendant wearing a light-colored shirt, a black jacket tied ‘around his waist with dark colored pants, standing in victim 3's living room. The defendant when asked by victim 3 who he was stated, “I POCN es Page 1 of2 think I'm in the wrong house, my name is Nick”, Victim 3 then yelled at the victim to leave their dwelling. The defendant the left victim 3's. dwelling. (0m 02/24/2021 at while at16 Hemlock Drive, Farmingdale NY in Nassau County, the defendant, Nicholas Fileccia, did knowingly and enter and remain unlawfully in the dwelling with an intent to commit a crime. The defendant did effect entry into the dwelling when victim 4 left their dwelling to pick their child up from school. Upon victim 4’s return their child did make entry into their dwelling and was confronted by the defendant who was standing by the basement stair doorway. Victim 4 then entered their dwelling and confronted the defendant who stated, ‘think 'm in the wrong house”, victim 4 then called police who placed the defendant in custody. Upon and incident to arrest search of the defendants back pack and recovered a tool designed or commonly used for committing or facilitating offense involving forcible entry into premises. The above is based on information and belief: The basis for said information and reason for such belief being the signed supporting deposition of the victims, The photos arrays presented to the victims in which they positively identified the defendant, a police record search of the defendants criminal history, and the oral and written admissions of the defendant in which in sum and substance he admitted to having entered and remained the for mentioned dwellings. ‘Any false statements made herein are punishable as a class A misdemeanor pursuant to Section 210.45 of the Penal Law, and as other crimes LE) LL Lo DET Francesco Caporxdlr LT Albert R Culmone POCN 85 Page 2of2
