Officer-Involved Shooting Update

On Thursday afternoon the Collier County Sheriff’s Office learned that the State Attorney’s Office has completed
its independent review of a Sept. 17 officer-involved shooting on Edenfield Way in Immokalee that resulted in the
death of 37-year-old Nicholas Morales Besanilla of Immokalee. The State Attorney’s Office review determined that
the use of force by Cpl. Pierre Jean was lawful and legally justifiable and they will not be filing criminal charges in
the case. In accordance with CCSO policy our Professional Responsibility Bureau will now conduct its
administrative investigation to ensure that agency policies and procedures were followed during the encounter.

As promised, we are releasing the dash-cam videos associated with the call.

SYNOPSIS: Cpl. Jean, Cpl. Nathan Kirk and Dep. Brian Tarazona responded to the Edenfield Way address after a
frightened woman called 911 at 1:12 a.m. and told dispatchers that a man she did not know was banging on her
door and trying to force his way inside. When deputies arrived, the man, later identified as Nicholas Morales
Besanilla, 37, ignored repeated commands to get on the ground. He released the shovel, produced a shiny object
later determined to be metal landscaping shears, and charged at deputies. In fear for his life and the lives of the
other deputies on scene, Cpl. Jean fired four gunshots, three of which struck Morales Besanilla. Deputies rendered
medical aid until EMS arrived. Morales Besanilla was transported to Naples Community Hospital, where he died.
