AFFIDAVIT

I, Sunil Garg, Son of Late Sri Sh.R.L.Garg, aged about 52 years,


presently working as General Manager (GM) – Indirect Taxation
& Finance and Authorized Signatory of Havells India Ltd., having
its registered office address at 904, 9th Floor, Surya Kiran
Building, K.G Marg, Connaught Place, New Delhi-110001
presently at New Delhi, do hereby solemnly affirm and declare as
under:

1. That I am the (Authorised Signatory) of the petitioner in the


aforesaid case and in that capacity, I am well conversant
with the facts and circumstances of the present case as such
competent to file the present affidavit.

2. At the outset, it submitted that the aforementioned Petition,


is pending for adjudication and next date fixed is.
01.05.2021.

3. That, by an order dated 10.03.2021 as directed by the


Hon’ble Court to file affidavit in support of stay of Demand
by Income Tax Department, in pursuant to said direction,
Petitioner is submitting herewith a copy Stay of Demand
order dated 07.05.2018 by the Income Tax Department.

A copy for Stay of demand letter dated 07.05.2018 is


annexed herewith and marked at Annexure P-7.

4. That in said order dated 07.05.2018 the Income Tax


Authorities, intimated that demand will be stayed till the
disposal of your appeal by CIT (Appeal) subject to payment
of 20% of the above stated demand i.e., Rs. 1,97,29,492/-

In compliance thereof, Petitioner deposited an amount of


rupees i.e. Rs.1.98 crores (20% of demanded amount of
disputed amount of Rs.9.06 crores ) for the AY 2006-07,
AY 2011-12 through AY 2012-13 through Challan
No.51579 dated 17.05.2018 by IDBI Bank.

A copy of the letter dated 18.05.2018 by Petitioner with a


copy of Challan No.51579 dated 17.05.2018 is annexed
herewith and marked as Annexure P-8.

5. It is submitted prior to said demand by the Income Tax


Department, as on 08.12.2017 there is no outstanding demand
against petitioner. It is submitted that there has been dues of
Rs. 29,88,000 with a certificate of no outstanding stated
08.12.2017 obtained from the income tax authorities stating
that there is no outstanding demand as on 08.12.2017.
6. It is submitted that by mail dated 22.10.2020, Petitioner
already informed about the Stay of Demand by the Income Tax
Authorities to Respondent No.3.

A Copy mail dated 22.10.2020 is annexed herewith and


marked at Annexure P-9.

my knowledge and belief, no part of it is false and nothing has
been concealed there from.
