APPLICATION FOR STAY

MAY IT PLEASE YOUR HONOUR :

The Applicant herein most respectfully

state and submit as follows:

1. The Applicant is

filing an accompanying revision against

the final report dated 19th march 2012 ,

submitted before the learned magistrate

Valpoi on 17th April 2012 and impugned

order passed by the learned judicial

magistrate first class, Sattari, Valpoi

dated 20/04/2015 in criminal case no.

31/s/2015 and the directions contained

therein. The Applicants crave leave to

refer to and rely upon the averments

and/or the grounds as set out in the

revision memo, as if the same are


specifically averred herein, for the sake

of brevity.

2. The Applicants state that

grave hardship and severe prejudice will

occasion to the Applicants, if pending the

hearing and final disposal of the present

revision, operation of the impugned Order

against the applicant is not stayed.

3. Under the

circumstances, the Applicants states that

it shall be just, fit and proper and in

the interest of justice that this

Honorable Court grant stay of operation

of the impugned Order and the directions

therein dated 20.04.2015 pending the

hearing and final disposal of the present

revision.

4. The Applicants are also filing

an affidavit in support of this

application.

The Applicants therefore pray that this

Honorable Court be pleased to:

a) Stay the operation of the impugned

Order and the directions therein

dated 20.04.2015, pending the

hearing and final disposal of the

present revision;

b) Grant ex-parte ad-interim relief

in terms of prayer clause (a)

herein above;

c) Pass such other and further

orders, as this Honorable Court

deems fit and proper.

I, Ramakant Shetye r/o Panaji Goa , the

petitioner above named Indian national,


major in age, married, do hereby solemn

affirmation state and submit as under:-

1. I say that I am the

Applicant herein. I say that I am

conversant with the facts of the case.

2. I say that I am filing

the accompanying revision along with an

application for stay against the impugned

Order and the directions therein dated

20.04.15 passed by the Judicial Magistrate

First Class in IPC Criminal Case No.

31/S/2015 and the directions contained

therein. I crave leave to refer to and

rely upon the averments made therein as if

the same is specifically averred herein

for the sake of brevity.

3. I say that the contents of

paras 1 are true to my personal knowledge

and contents of para 2-4 of the

accompanying application for stay are in

the nature of the legal submissions and/or

inferences of facts, which I believe to be

true.
4. I say that the contents

of this affidavit are true to my own

knowledge and belief.
