Dear Chancellor Camacho:

This is to respectfully recommend for your consideration and approval of the PROPOSED
CONTRACT TIME SUSPENSION NO. 1 (CTS#1) retroactive effective MARCH 11, 2021 to the
contract of JUNCAN ENTERPRISES for the abovementioned project. The recommendation for
CTS#1 emanated from the contractor’s letter dated 11 March 2021 which was received by this office
on 12 March 2021 (Please see “Annex A”) stating their intention to suspend the works due to the
pending approval of the Proposed Variation Order No. 1 (PVO # 1).

For your ready reference, the duration of the project’s contract with the corresponding rationale is
shown below:

Start of Contract = October 05, 2020
Duration of Contract = 150 Calendar Days
End of Contract = March 03, 2021

Due to Approved First Proposed Contract Time Extension (CTE #1) (Please see “Annex C”)
Additional Contract Duration = 15 CD
1st Amended Contract Duration = 165CD (i.e. 150 CD + 15 CD)

1 Amended Expiration Date = March 18, 2021

Upon inspection of the site on March 11, 2021 for the evaluation of the contractor’s Progress Billing
No. 1 (PrB #1), the contractor informed the Project Inspectorate Composite Team of its intent for a
contract time suspension due to the pending approval of PVO #1. Hence, the evaluation for their
claim of a contract time suspension was conducted on March 11, 2021, ahead of this office’s receipt
date of the contractor’s request letter for CTS #1.

Upon evaluation, the contractor has already accomplished the items of work that were already
included in the original contract except those that are involved in the Proposed Variation Order No. 1
which emanated from the end-user’s request (Please see “Annex D”). And to further expound on the
matter, the only remaining scope of work are those contained in the Proposed Variation Order that is
currently on preparation as of this date.

Also, this office believes in the applicability of Item 9.1 of “Section 9.0 Suspension of Work” of
“Annex E” of the 2016 Revised IRR of R.A. 9184, as quoted herein:

“9.1. The procuring entity shall have the authority to suspend the work wholly or partly by
written order for such period as may be deemed necessary, due to force majeure or any
fortuitous events or for failure on the part of the contractor to correct bad conditions which
are unsafe for workers or for the general public, to carry out valid orders given by the
procuring entity or to perform any provisions of the contract, or due to adjustment of plans
to suit field conditions as found necessary during construction. The contractor shall
immediately comply with such order to suspend the work wholly or partly.” (Emphasis
supplied.)

With this, the suspension of works shall be lifted once the Proposed Variation Order No. 1 is
approved.
