United States’ Motion to Stay the Issuance of the Mandate for 90 Days
Pending the Acting Solicitor General’s Decision Whether to File a
Petition for a Writ of Certiorari in the Supreme Court

In accordance with Fed. R. App. P. 41 and 11th Cir. R. 41-1, the United

States respectfully moves on the following grounds for this Court to stay the

issuance of the mandate for 90 days pending the Acting Solicitor General’s

decision whether to file a petition for a writ of certiorari in the Supreme Court:

1. On May 6, 2021, this Court issued its en banc opinion in this case,

holding that the district court had abused its discretion by removing a juror

during deliberations after the district court had found that the juror was not

basing his verdict solely on the evidence presented at trial and on the law as

instructed by the court, and remanding for a new trial.

2. The United States Attorney immediately reported the decision to

the responsible component of the Department of Justice in Washington, D.C.,

which it is required to do for “every published court of appeals’ decision that is

adverse to the government in any respect,” United States Justice Manual § 9-

2.170B4; accord id. at § 2-2.110, 2.2.111. The Solicitor General is responsible

for “all Supreme Court cases, including appeals, petitions for and in opposition

to certiorari, briefs and arguments,” 28 C.F.R. § 0.20(a), and “[d]etermin[es]

whether, and to what extent, appeals will be taken by the Government to all

appellate courts,” 28 C.F.R. § 0.20(b); accord United States Justice Manual §§ 2-1,

2-2.121, 2-2.510, 2-2.520, 9-2.170A. This reporting and decisionmaking

process ensures that the United States pursues further review only in cases that

present substantial questions and meet the requisite standards for certiorari

review.

3. For good cause, the United States requests this Court to stay the

issuance of the mandate for 90 days to allow the Acting Solicitor General time

to determine whether the United States will seek review in the Supreme Court.

Any petition will be premised on the Acting Solicitor General’s determination

that a substantial question exists that satisfies the standards for certiorari

review. See Sup. Ct. R. 10.

4. The appellee, Corrine Brown, is currently on release and has been

on unopposed release since this Court granted rehearing en banc. The United

States does not oppose her continued release and assumes that she will remain

on release unless and until her conviction were to be reinstated.

5. The United States will immediately notify this Court if the Acting

Solicitor General determines not to seek further review, so that this Court may

issue its mandate forthwith.

Therefore, the United States requests this Court to stay the issuance of

the mandate in this case for 90 days pending the Acting Solicitor General’s

decision whether to file a petition for a writ of certiorari in the Supreme Court.
