United States’ Motion to Stay the Issuance of the Mandate for 90 Days
Pending the Acting Solicitor General’s Decision Whether to File a
Petition for a Writ of Certiorari in the Supreme Court
In accordance with Fed. R. App. P. 41 and 11th Cir. R. 41-1, the United
States respectfully moves on the following grounds for this Court to stay the
issuance of the mandate for 90 days pending the Acting Solicitor General’s
decision whether to file a petition for a writ of certiorari in the Supreme Court:
1. On May 6, 2021, this Court issued its en banc opinion in this case,
holding that the district court had abused its discretion by removing a juror
during deliberations after the district court had found that the juror was not
basing his verdict solely on the evidence presented at trial and on the law as
for “all Supreme Court cases, including appeals, petitions for and in opposition
whether, and to what extent, appeals will be taken by the Government to all
appellate courts,” 28 C.F.R. § 0.20(b); accord United States Justice Manual §§ 2-1,

present substantial questions and meet the requisite standards for certiorari

3. For good cause, the United States requests this Court to stay the
issuance of the mandate for 90 days to allow the Acting Solicitor General time
