Under Article 1 of the 1987 Constitution of the Philippines, that the national territory
comprises the Philippine Archipelago, with all the islands and waters embraced therein,
and all other territories over which the Philippines has sovereignty or jurisdiction,
consisting of its terrestrial, fluvial, and aerial domains, including its territorial sea, the
seabed, the subsoil, the insular shelves, and other submarine areas. The waters around,
between, and connecting the islands of the archipelago, regardless of their breadth and
dimensions, form part of the internal waters of the Philippines. Our government enacted
the Water Code in consonance to its duty to protect our waters. Considering that the
previous water legislations could not cope up with the increasing need to protect our
waters, this Code was enacted. This governs the utilization, management, protection, and
conservation of the same. The objectives of this Code are a. To establish the basic
principles and framework relating to the appropriation, control, and conservation of water
resources to achieve the optimum development and rational utilization of these resources,
b. To define the extent of the rights and obligations of water users and owners including
the protection and regulation of such rights, c. To adopt a basic law governing the
ownership, appropriation, utilization, exploitation, development, conservation and
protection of water resources and rights to land related thereto, and d. To identify the
administrative agencies which will enforce this Code.1
I believe that this Code had been beneficial to us in creating solutions for our water
related problems. Philippines, as an archipelago, we are surrounded with water resources.
These resources had been the source of livelihood of our fellow countrymen. Thus, said
resource can also be subject to abuses which the State sought to prevent. I am for the idea
of securing a permit before doing any activity that concerns the utilization of our water
resources. Said activity may either be for the benefit of people and wildlife, it may be
income generating, or prejudicial to the State. This code does not make a distinction as to
bodies of waters found in private lands. National Water Resources Council (NWRC)
governs, controls, and regulates the utilization, exploitation, development, conservation
and protection of water resources. As such, illegal exploitation of the same may be
prevented.
Protection and conservation of our water resources is not a new thing for us. It has

been taught us since we were in our primary years. This Code has equipped us on how we
can “up our game” as to do our duty to protect our waters.
