ABSTRACT

• It is inheritance which initially gave the women a status in


the society and it still is a determining factor to judge the
independence and social status of a women in a given
society.
• It is further pointed that the instant article compares Islamic
system of inheritance with other legal regimes and discusses
in length that as to why the Islamic legal system or regime of
inheritance is far better and elaborative than the other
system present in the world. Hence, one could understand
that a system which was laid down 1400 years ago gave a
more modernized society than the ones who today claim to
be the flag bearer of women rights.
INTRODUCTION

• Equal importance is the marital


property regime. The concept of
inheritance was developed centuries
ago as a deviation from the custom of
burying wealth, widows, and slaves
along with the deceased and
continued to persist strictly under
the patriarchal domain.

• It appears that the equal inheritance
rights, custom and tradition wins out,
leaving many women and girls
powerless.
• The explanation and challenge to
begin and grasp the complicated
relationship between inheritance,
property, women and equality.
• Women in our society are groomed as
sub-human creature, mostly
submissive to male relations. Another
hurdle in this respect is the lacunae in
judicial and monitoring system.
LITERATURE REVIEW
• The importance of property ownership for
women and the role that property plays in
sanctioning women. Property ownership is
viewed as a means for reinforcing the
position of women in societies where they are
disadvantaged.
• Property ownership gives some security
against poverty and may strengthen their
freedom (Mohan, 2011).
• Women are the legal holders of property in
those cases; they are often not in actual
power (Agarwal, 1994; Datta, 2006).

• Woman was considered to be lower creature
and ruled by her male relatives when she
was a virgin and her spouse when she got
married.
• Allah enjoins you about [the share of
inheritance of] your children: A male's share
shall equal that of two females‖ (The
Qur‘an n4:11).
• The low status of women before Islam when
compared with their present status – that
unveils the point of the developments which
the Holy Quran presented. The higher

• For this research we have selected the two articles

Turkish Women‘s Inclusion and Exclusion from Property
RESULTS AND ANALYSIS
• A comparative study of different legal
regimes in this world clearly shows that Islam
gave those rights to women 1400 years ago
which were given by the west not more than
a century ago and are still not given by the
religious legal regime of our neighbor.
• Despite the system laid down by the Almighty
what we see today is that Pakistan a Muslim
majority state ranks at 93rd out 115 countries
in respect of protection and implantation of
inheritance rights.
