What are the five elements necessary to adversely possess land and define them?

1. Occupy the space for a statutorily prescribed time period of 7-20 years- the people must live in
that area for 7-20 years.
2. Must be open. visible, and notorious- the house, shed, whatever the property is must we seen
by everyone who is there not hidden.
3. Actual and exclusive- The people must physical occupy the space. Ex. grow plants or build
something there.
4. Continuous and peaceful- People must live there peaceful without disturbing others around
them.
5. Hostile and adverse- People must occupy the space without the permission of the owner of the
space.

What does RICO allow prosecutors to do?

They are allowed to criminally charge organized crime leaders. Ex. leaders of the mafia who
weren't actually committing the crimes but were in charge of them.
They are also allowed to bring a lawsuit against the violator of the crimes for the injured person
to receive recovery from injuries cause by the violator.

That is when a person can live in their real property (house) for their entire lifetime even if they
sell it or lease it to someone else.

It states no person shall be compelled in any criminal case to be a witness against himself or
herself.

What is the role and benefit of the plea agreement in criminal law?

The role is that the accused admits to a lesser crime than they are charged for and the
government can give a lessor sentence. The benefit is that government saves time and money
with a plea agreement than with a trial.

Name difference between 1st and 2nd degree murder

1st degree murder is done with the intent and plan to murder someone. 2nd degree murder is
without intent or a plan to kill.
