PETITION
COMES NOW, the petitioners by their undersigned counsel and to
this Honorable Court, most respectfully alleges:

1. That petitioners is of legal age, Filipino, is represented BBBBB


with address at ____________________________, where they
may be served with summons and other court processes; a copy
of Special Power of Attorney is hereto attached and made
integral part hereof as Annex "A’’.

2. A Deed of Sale executed on _________ between Estate of


CCCC as represented by administratix DDDDDD and the
petitioners was approved in an order by Regional Trial Court of
Pasig City, Branch XXX, in SP. Proc. No. XXX the court ruled to
wit:

3. Subsequently, a Certificate of Finality was issued by the Court


on ______, a copy of Certificate of Finality dated______ issued
by the RTC City, Branch XXX is hereto attached and made
integral part hereof as Annex “C”.

4. The property described under Transfer Certificate Title No.
XXXX of the Registry of Deeds of City is registered in the name
of CCCCC and located at __________________ as borne by a
verified copy, a verified copy of TCT no. XXXX is hereto
attached and made integral part hereof as Annex “D”.

5. However, the original of Transfer Certificate of Title No. XXXX


on file with the Register of Deeds of City is not on the record
with the Register of Deeds of City, a copy of certification issued
by the Register of Deeds of City dated ______ is hereto
attached made integral part hereof as Annex “E”.

6. That no deed or other instrument affecting the property has


been presented for registration with the Office of the Register of
Deeds City.

7. The subject parcels of land were declared for taxation purposes


in Quezon City covered by Tax Declaration Nos. XXXXX
declared in the name of XXXXX, a copy of Tax Declaration is
hereto attached and made integral part hereof as Annex “F”.

8. Assessor’s Office of XXXX City issued a certification regarding


the adjacent lots of TCT XXXX based on their description, a
copy of Certification of Assessor’s Office of City is hereto
attached and made integral part hereof as Annex “G”

9. That the said Transfer Certificate of Title is free from all liens
and encumbrances.

10. Herein petitioners warrants that there are no deeds or


instrument affecting the said property which has been presented
for and pending registration to this date in the Office of the
Register of Deeds concerned.

11. Moreover, herein below are the additional support of this


Petition for Reconstitution, the following documents which may
constitute a source or basis for reconstitution, are herewith
submitted, to wit:

a. Sepia film and Blueprint of Plan of Land of Lot _______


Pcs-XXXX prepared by a duly licensed Geodetic
Engineer who certified thereon that its preparation was
made on the basis of a survey, a copy of which is hereto

attached and made integral part hereof as Annex “H” and
“I”.

b. Lot Data computation, filed notes cover and field notes, a


copy of which is hereto attached made integral part
hereof as Annex “J” and “K” to “K-4”.

c. Verification Survey report, a copy which is hereto


attached and integral part hereof as annex “L”.

12. The “Technical Descriptions” which are not on file with the
Technical Records Section, DENR-NCR is pending issuance
upon the filing of this petition and shall be submitted to the court
in the presentation of Petitioner’s evidence.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed


of this Honorable Court, after due hearing and consideration, grant the
herein petition by ordering the City, Register of Deeds to reconstitute
TCT No. XXXX in the name of the registered owner, CCCCC, and to
cancel the same and issue a new Owner’s Copy and Owner’s Duplicate
Copy of Transfer Certificate of Title in the name of CCCC.

Other reliefs just and equitable under the premises are likewise
prayed for.

records; The pleading is not filed to harass, cause unnecessary delay, or
needlessly increase the cost of litigation; and The factual allegations
therein have evidentiary support or, if specifically so identified, will
likewise have evidentiary support after a reasonable opportunity for
discovery; The signature of the affiant shall further serve as a
certification of the truthfulness of the allegations in the pleading.
I hereby certify that he has not commenced any action or
proceeding involving the same issue before the Supreme Court, Court of
Appeals, or any tribunal or agency; that he is not aware of any action or
proceeding pertaining to same matter filed or pending before any court
except the one file in Regional Trial Court, Branch 215 of Quezon City
which was dismissed without prejudice with case no. R-QZN-17-08755-
LR , tribunal or agency and should he later on become aware of any
such action or proceeding involving the same issues filed or pending
before any court tribunal or agency, he hereby bind himself to inform this
Court of such fact within five (5) days from notice thereof.
