SUBJECT : Investigation Report, Re: Turn-over of one male arrested
Indian National for violation of RA 8353 (Anti-Rape Law of
1997)

I. AUTHORITY:
1. Complaint Sheet of MS. EVANGELINE DONAYRE y JORDAN dated April
21, 2017; (TAB “A”) and;
2. Memo from Chief, SIDMD PS-6 Batasan Police Station dated April 23,
2017 with same subject as above; (“TAB B”)
II. MATTERS INVESTIGATED:
3. A case of violation of RA 8353 that transpired on April 21, 2017 at
about 10:00 AM at # 3 Sta. Monica St. Brgy. Holy Spirit Quezon City; and
4. To determine the criminal liabilities of the suspect identified as
HARJENDER SINGH Alias “Tatay Bombay” male, married , 64 years old, Indian
National, presently billeting at # 3 Sta. Monica St. Brgy. Holy Spirit, Quezon City (Under
Police Custody) and other facts and circumstances surrounding the case.

III. PERSONNEL INVOLVED:

IV. FACTS OF THE CASE:


Investigation disclosed that on or about 10:00 AM of April 21, 2017 victim met the
suspect at the carwash station for renewal of her lending (5/6) from the suspect.
Afterwards, he brought the victim to his place of abode and told that his son will
delivered the lend money. While they were inside the room suspect motivated with lust
and with the use of superior strength, sexually abused the victim against her will by
inserting his penis into her genitalia. Please see (attached Medico-Legal Certificate
issued by Dr. Ferdinand Baldos of PNP Crime Lab dated April 23, 2017).

After an hour, suspect with lewd design, again attempt to raped the victim by
inserting his penis into her genitalia but victim refused and resisted, prompting the

the suspect to get mad and uttered unsavory words to herein victim. Suspect got irked
and threatened the victim that something will happen to her and to her family if she will
attempt to report the incident to the authorities.

5. At about 10:30 PM, April 22, 2017 PO1 Mark Anthony Sotto, PO1
Arvin Aribal, PO1 Gilbert Egloso and BPSO Reynaldo Llagas of Batasan Police
Station,( PS-6), QCPD extended Police Assistance to the victim who positively
pinpointed HARJENDER SINGH as the suspect being complained. Immediately, at
around 9:00 AM, April 23, 2017, both parties were brought and turned over to this
office for investigation and proper disposition.(Affidavit of Arresting Officers TAB
“C”)

V. DISCUSSION:
6. Suspect HARJENDER SINGH took advantage of his position and
took advantage of Ms. Donayre, Harjender Singh was motivated with lewd design that
committed the act of Rape against the victim/complainant.
VI. CONCLUSION:
7. As can be gleaned from the foregoing facts and circumstances ,the
undersigned investigator conclude that suspect HARJENDER SINGH Alias “Tatay
Bombay” committed the crime of Violation of RA 8353 (Anti-Rape Law of 1997).
VII. DISPOSITION:

8. On April 23, 2017, a case of violation of RA 8353 (Anti-rape Law


of 1997) was filed by the undersigned investigator against the suspect HARJENDER
SINGH before office of the Assistant City Prosecutor NILDA R. ORDOÑO.
9. After evaluating the pieces of evidence, ACP ORDOÑO found
probable cause for the filing of the case of RA 8353.(Resolution from the Office of
the City Prosecutor, Quezon City TAB “D”)

VIII. RECOMMENDATION:
10. Strongly recommend for issuance of Commendation to the
personnel involved for their exemplary dedication to duty during police assistance
rendered that yielded positive result in the arrest of Harjender Singh.

1. This pertains to the disposition and solution to the case of SHAIANNE
SANCHES VERAS for Violation of RA 8353 (Anti-Rape Law of 1997) and Grave
Coercion that happened on February 25, 26, 27 to 28, 2017 inside Unit 301 Metro Hotel,
K6th St. Brgy West Kamias, Quezon City. The suspect in this particular case was
identified as ANIELLO MIRANDA, male, single, 43 years old (DOB: April 25, 1973),
Italian National, presently billeting at Unit 301 Metro Hotel, K6th St. Brgy West Kamias,
Quezon City.

2. In connection herewith, please be informed that after an inquest


conducted in accordance with existing rules and with prior authority and approval of the
City Prosecutor ROGELIO A VELASCO, Deputy City Prosecutor, Chief Inquest Division,
docketed under XV-03-INQ-17C-01005, suspect was arrested for Grave Coercion with
recommended bail as stated in the information.

3. Further, Violation of RA 8353 (Anti-Rape Law of 1997) was set For


Further Investigation because the complaint on the incidents of Rape that transpired on
February 25 to 27, 2017 are not proper for inquest and referred for preliminary
investigation.

4. The case having been filed before Quezon City Prosecutor’s Office, the
court acquired jurisdiction over the case. Hence, the instant case is now treated SOLVE
and CLOSED as far as this unit is concerned.
