As desired in your letter under reference, the following documents

of Sri Rupam Sen, Ex.Ty.Helper-II of canteen/KGPW are enclosed herewith for
your kind information and further course of action at your end please.

1. Chronological events of the case is placed at Folio -62.

2. Parawise comments on the representation dtd. 07.12.2020 of Sri Rupam
Sen is placed at Folio -61.
3. Service sheet of Sri Rupam Sen is not available in this office.
4. The full original D&A case file of Sri Rupam Sen in 62 pages (From
folio 01 to folio 62) but the following documents are not available in

HQ/DAR/410/9/RS/20 [F/58] along with representation, dtd. 07.12.2020 [F/55-56]
addressed to GM/S.E.Rly. submitted by Sri Rupam Sen, Ex Canteen Bearer-III, Main
Canteen/KGPW regarding mercy appeal against his punishment notice no. SER/P-

no. SER/P-KGPW/410/Major Canteen/Rs/115 dtd. 09.01.2015 addessed to General
Manager,S.E.Rly Garden Reach, Kol-43

Para-1: Sri Rupam Sen, S/o Late Narayan Chandra Sen, Ex Tech-I, T.No.-6161 was
appointed on Compassionate ground as Ty. Helper-II under Canteen
Manager/KGPW vide WPO/KGP’s memorandum no. 181/Gr.D/Comp.
Apptt./4734 dtd. 10.09.2011(F/46)

Para-2: It is stated that his Mother Latika sen was expired on 09.10.2020.In support of
this he has enclosed the photocopies of Death Certificate (F/47 )

Para-3: Sri Rupam Sen has submitted the photocopies of the prescriptions/medical
illness certificates issued by Dr. U.N.Choudhary, Ex. Medical Officer, Ranchi
Manasik Arogyashala, Kanke, Ranchi, cash memos of medicines etc. as he was
under medical treatment of Dr U.N.Choudhary, since January, 2014 up to
October, 2018.

Para-4:

 A Major penalty Charge Memorandum (SF-5) dtd. 09.01.2015 (F/6) was issued
against him on the allegations of unauthorised absence from 23.02.2014 to
28.06.2014 and from 20.07.2014 till date. But, he has not submitted any defence
statement against the same. Subsequently, Departmental enquiry was conducted
by appointing Sri K.C.Reddy, the then Ch.Staff & Welfare Inspector of this office
as inquiry Officer vide this office letter no. SER/P-KGPW/410/D&A/Enquiry/
RS/Spl. dtd. 10.04.2015. During the inquiry proceedings, he has accepted the
charges against him, in reply to Question No. 10. A copy of Inquiry report was
sent to his residential address vide this office letter dtd. 21.08.2015 which was
acknowledged on 21.08.2015. Sri Rupam Sen has submitted his final
representation on 04.09.2015. Thereafter, on going through the entire case the
disciplinary authority find him guilty of charges and imposed the punishment,
i.e. “he was removed from Railway Service with effect from 29.11.2015 without
extending any compassionate allowance.” as a measure of disciplinary action
vide punishment notice no. SER/P-KGPW/410/D&A/ Enquiry/RS/4353 dtd.
28.11.2015 (F/12) which was sent to his residential address by Regd. Post with
A/D.
 Moreover, it was also stated that he had appealed to WPO/KGPW & the
Appellate authority on 10.11.2018 (F/21) and the Appellate authority sustained
the punishment given by Disciplinary Authority on 08.02.2019 (F/24).
 Thereafter he had again submitted a revision petition to CWM/KGPW & the
Revisionary authority on 26.03.2019 (F/35) and the punishment awarded by DA
& AA is fair and just and “hence, it stands good”(F/40)
