Intimation regarding Notice Inviting e-Tender

PROVISION OF MAINTENANCE SERVICES TO DRDO TRANSIT FACILITY


BHUBANESWAR AND O&M RADDARS, BHUBANESWAR THROUGH WATCH &
WARD SERVICES.
Dear Sir(s),

1. On behalf of President of India, e-Tenders are invited for the subject work as per
the scope of work given in the attached tender documents.

2. The tender conditions and execution of work shall be governed by the following:-

a) RDCE Work Procedure - 1999 General Conditions of Contracts.


b) Para 173(i) (h) of GFR 2017 (NIL Consideration).
c) All conditions/ Instructions as per tender documents.
d) Special Terms & Conditions (Enclosed at Appendix - B).

3. The lowest tender in total amount (L-1) will be considered for acceptance
keeping in view the overall reasonability of quoted rates. Acceptance of the L-1 tender is
subject to fulfilling of all conditions listed in the tender documents including all the
Statutory Regulations. Special attention is drawn to Para 2(b) above and its contents
therein.

4. This notice along with conditions/instructions to tenderers and other tender


documents enclosed/shall form part of the contract.

5. Tenderers who wish to avail the exemption under MSME/ NSIC ( towards cost of
tender documents & EMD) may please refer Para 17 of NIT.

6. Please study the tender enquiry documents in detail and ensure that there is no
ambiguity/ doubt. In case you have any query/ clarification, the same may please be got
clarified well before quoting for the tender. Your presumption/ assumption/
misinterpretation cannot be accepted if it is contrary to the tender condition. No
representation/ explanation at a later date will be entertained in this regard. Tenderers
are advised to seek clarifications, if required, well before submission of the bid. Please
refer Para 18 of NIT. Please note that the decision of the EMU R&D Chandipur is final
and binding in this regard.

7. All cordinal dates as given in this NIT may please be noted and timely action as
deemed fit shall be taken by the tenderer to avoid rejection of tender at later date.

Tender submitted without Earnest Money Deposit will be rejected.
The Earnest Money shall not earn any interest. Copy to be uploaded
online and original to be submitted before closing date and time as
given at para 11.
7 Duration : 6 (SIX) Months
8 Eligibility Criteria:

a) Only agencies having valid license issued by competent authority under Private Security
Agencies (Regulation) Act 2005 (PSARA) in the respective District/ State where work needs to
be executed are eligible.

NOTE: Agencies who have applied for registration under Private Security Agencies
(Regulation) Act 2005 (PSARA) but have not obtained the license are not eligible and will not
be considered for the tender. No representation shall be entertained in this regard.

b) The agencies shall satisfy the following criteria :

(i) Average annual financial turnover during the last 3 years ending 31 Mar of the previous
financial years (i.e., upto 31 Mar 2020) should be at least 30% of the estimated cost,
i.e., Rs. 2.4 Lakhs. IT returns for the last 03 (Three) years to be submitted duly audited
by Chartered Accountant. The firm should not have incurred loss in the last two years.
(ii) Should have experience of having successfully completed similar works of providing
Watch and Ward Services during last 7 years ending last day of month previous to the
one in which applications are invited (i.e., Jun 2020) fulfilling either of the following:-
aa) At least three similar completed works each of Rs. 3.19 Lakhs as above in the
past 7 years, i.e., 40% of estimated cost.

(or)
bb) At least two similar completed works each of Rs. 3.99 Lakhs as above in the past
7 years, i.e., 50% of estimated cost.
(or)
cc) At least one similar completed work of Rs. 6.39 Lakhs as above in the past
7 years, i.e., 80% of estimated cost.

(iii) Definition of similar work is “Provision of Watch & Ward/ Security Services”.

(iv) Agencies should submit completion certificate / performance certificate along with
the relevant order/contract copy.
Note: Completion certificate/ performance certificate without copy of work
order/ contract will not be accepted. Those firms who have currently or
earlier awarded contract under this EMU but irregular in making wages to
workers shall be technically rejected.
(v) The firm should not have been blacklisted by any Government Organization/PSU. Refer
Annexure – I to NIT.
(vi) The bidder should have PAN No. & GST registration, VAT and TIN registrations as
applicable. A copy of the same should be enclosed along with the tender documents.
(vii) Copy of registration certificate of firm/ company with Registrar of companies.
(viii) Memorandum of articles of association in case of limited companies.
(ix) Copy of partnership deed in case of partnership firm.
Note:
Bids of agencies who fail to submit any of the above eligibility criteria documents are
liable for rejection. No representation will be entertained.

9 Procedure for (a) The bidder will upload the tender in two ONLINE covers. Cover-
submitting 1 (Technical Bid) (Eligibility, cost of tender, undertaking (Annexure-I
Tender to NIT), Annexure-II to NIT and EMD) & Cover-2 (Price Bid).

(b) On the due date & time of bid opening the Cover-1, i.e.,
‘Eligibility Documents’ as per the above Eligibility Criteria will only
be opened and processed.
NOTE:
(i) ONLY documents of COVER-1 TO BE SUBMITTED IN HARD
COPY in office of EMU R & D CHANDIPUR before the
prescribed due date and time. EVALUATION OF TECHNICAL
BID WILL BE ONLY ON THE BASIS OF HARD COPIES
SUBMITTED BY THE TENDERER.

(ii) No documents pertaining to Cover-2 (Price Bid) shall be


submitted in hard copy or else the bid is liable to be rejected.

16. Submission of Documents:-

a) In order to consider e-bids for the subject work, hard copies of the following
documents must be sent in a sealed cover by person/ post to ESTATE MANAGEMENT
UNIT R &D CHANDIPUR, BALASORE ODISHA 75025 on or before 1100 Hours on 23
JUN 2021:-

(i) Cost of tender in original or MSME / NSIC Registration Certificate.

(ii) Earnest Money Deposit receipt in original or MSME/ NSIC Registration


certificate. [see para 17a) (vi)]

(iii) Eligibility documents:-

aa) Valid PSARA Licence copy of the agency in respective district/ state
where the subject work needs to be executed.
bb) Copy of work order signed by competent authority for similar works.
cc) Copy of completion or performance certificate of similar works signed by
competent authority.
dd) Copies of IT returns of the last 03 (Three) years duly audited by
Chartered Accountant.
ee) Undertaking (Annexure-I to NIT)

b) Tenderers are advised to note the following:-

(i) Application not accompanied by any of the requisite documents given above is
liable to be rejected. Also, conditional offers will be rejected.

(ii) In any case, hard copy of price bids shall not be submitted or else, tender
bid will be liable for rejection.

(iii) Bids received after due date will be rejected.

17. Earnest Money:

a) Form of Earnest Money:

(i) Earnest money should be submitted in the form of bank guarantee/ DD/BC/FDR
from a scheduled bank.

(ii) A part of earnest money is acceptable in the form of bank guarantee also. In
such cases 50% of earnest money or Rs. 20.00 lakhs whichever is less, will have
to be deposited in the shape of DD/BC/FDR and balance can be accepted in
form of bank guarantee issued by a scheduled bank.

(iii) The bank guarantee/FDR submitted as a part of the Earnest Money should be
valid for a period of 03 (three) months or more from the date of submission of the
tender.

(iv) Proforma for bank guarantee for earnest money is enclosed.

(v) Firms registered under Micro & Small Enterprises are exempted from depositing
Earnest Money deposit and tender cost as per GO Gazette No. 503 dated 26
Mar 2012 subject to the condition that the firm should qualify the PQ criteria. The
firm should submit a valid registration certificate of MSME/ NSIC. The firm also
is required to submit hard copies of the requisite documents in time as specified
in the NIT. Bidder to note and ensure that MSME/NSIC exemption, the nature of
services and goods/items manufactured mentioned in MSME or NSIC certificate
matches with the nature of the services and goods/items to be supplied as per
tender.

(vi) For MSME exemption for this tender, the firm should be registered under
division - 80, group - 801 and a copy of registration certificate shall be
attached. If the MSME registration certificate pertains to some other
category of work and /or does not have validity, the bid will be summarily
rejected. No representation in this regard will be entertained.

b) Refund of Earnest Money: The earnest money deposit submitted by all the tenderers
except the lower tenderer will be refunded upon opening of price bid. Earnest money
deposit submitted by the lowest tenderer will be returned after acceptance of the tender
and submission of the security deposit.

c) Forfeiture of Earnest Money:

(i) If the tenderer withdraws his tender before expiry of the validity period, or before
the issue of letter of acceptance, whichever is earlier, or makes any modification
in the terms and condition of the tender which are not acceptable to the
department, then the Government shall, without prejudice to any other right or
remedy, be at liberty to forfeit 50% of the earnest money absolutely.

(ii) If contractor fails to furnish the prescribed Performance Guarantee within the
prescribed period, the Earnest Money is absolutely forfeited to the President of
India automatically without any notice.

(iii) In case of forfeiture of earnest money as prescribed in (i) & (ii)above, the
tenderer shall not be allowed to participate in the retendering process of the
work.

18. Scope of work, Site visit and Seeking of clarifications/interpretations on tender:-

(a) The services in this tender are to be provided at KANAKPRASAD DHAMRA.

(b) Agencies are advised to clearly understand the scope of work, location and details of
manpower to be positioned and nature of duty, etc., before participating in the tender. Site
visit can be organized on tenderer’s request with a minimum of two days notice
(excluding holidays). Only two persons per firm will be allowed for the site visit. A
request letter along with aadhar card copy shall be forwarded. The following are the

19. Failure to execute/ perform the obligatory works on becoming L1 tenderer:-

a) The L-1 tenderer is bound to accept the tender and execute/ perform the work as
envisaged in the tender documents. In case of unwilling to perform/ execute the work or
withdraw his L-1 offer due to any reason including incorrect/ wrong quoting, the firm will be
debarred to participate in any future tender for a minimum duration of one year.

b) Apart from the above, the complete EMD amount will be forfeited and the same will
be deposited into Government treasury accordingly. The decision of the accepting
authority is final and binding.
c) In case a firm that avails the concessions of MSME/ NSIC becomes a defaulter, they
also will not be permitted to apply any tenders for a period of one year.

d) No representation will be entertained in this regard.

20. ESTATE MANAGEMENT UNIT R &D CHANDIPUR, reserves the right to:

(a) To postpone/ change/ cancel the above mentioned dates and modify the terms and
conditions, including cancelling the tender without assigning any reasons.

(b) To ask for further clarifications, etc., any time, as and when required.

(c) In case any firm is found to indulge in malpractice or furnish false information, the
firm will be debarred from the tendering process and also suitable action including
imposing of Ban shall be initiated against the firm. No representation will be entertained.
