ASSIGNMENT FOR LESSON NO.

1:

1. Think of one of the festival or tourist-oriented events you did attend or participate in,
based on your recollections write an essay of 80-100 stating the possible situations that
may lead to violation of law.

My friend and I attended the Nagraksak Ti Guimba Festival in our hometown, in Guimba, upon
our arrival, as expected, a wide range of people attended, there are more than genre playing
throughout at the same time. We loved the music, the crowd, and the positive energy. When
we decided to buy a snack nearby, we nonchalantly passed by a certain group of guys, then
they started to wolf whistling and cat calling my friend, Jasmin. Their facial expression shows
maniacally.

They violated the “Bawal ang Bastos” Bill or Republic Act of 11313 – Safe Spaces Act, in which
criminalizing catcalling, wolf-whistling, intrusive gazing, cursing, misogynistic acts, sexist slurs
and other forms of public and online sexual harassment.

2. Sofia Feldman is an Israeli beauty queen participating in an international beauty pageant


held in Manila.  During one of the social functions, she was forcibly taken by two drunk
men.  The security personnel assigned to guard the beauty contestants from 72
countries were not able to notice the disappearance of Miss Israel.  The organizers were
beginning to panic upon learning of the abduction of a contestant who was predicted to
win the competition. Research on the following:
a. Who would be liable for the disappearance of the beauty queen,
criminally? Civilly?
b. What measures can be undertaken by organizers of a high profile event
to prevent such kind of incident.

Answer:
Criminal Liability – the abductors of Ms. Sofia Feldman.
Note: Specific abductor’s penalty is cannot be determined due to insufficient evidences/facts.

Civil Liability – the uniformed personnel (security) responsibility with securing all the
contestants’’ well-being.
Basis: The Security Personnel violated the Republic Act No. 5487, otherwise known as “The
Private Security Agency Law”.

Whereas, RA 5487 as amended empowers the Chief of Constabulary either only to suspend or
cancel the license of security guards, private security agencies and company guard forces that
have violated the law and its implementing rules and regulations which if enforced to the letter
may amount to excessive penalty resulting to the loss of capital investment of security business
firms and dislocation or lay off of their gainfully employed security guards regardless of the
nature/gravity of the offense committed or degree of delinquency;
Whereas, there is a need to introduce the concept of administrative fines based on the degree
of delinquencies committed in order for the Chief of Constabulary not to resort to the drastic
action of suspending or cancelling the operations of private security agencies and company
guard forces, afford them a chance to continue their business operations and earn revenues for
the government;

Whereas, there is a necessity to redefine the meaning of watchman or security guard into more
specific terms to clarify the status of the three (3) categories of security guards covered by RA
5487.

Answer:
With the situation, there are too many beauty queens yet there are insufficient number of
security personnel to secure the candidates’ well-being in order for the security haven’t noticed
about Ms. Sofia Feldman disappearance. To prevent this incident, we could instead increase the
number of securities to tighten the security to any suspicious person.
