Question: Are resolutions issued by the Sangguniang

Bayan/Panlungsod subject for review by the province? If yes, who is


the reviewing authority, the SP or PLO?

Answer:
NO unless it is a resolution approving the local development plans and public
investment programs formulated by the local development councils.

Applicable Law/Basis:

1.) Section 56, (a) of R.A. 7610 which provides:

“(a) Within three (3) days after approval, the secretary to the Sanggunian
Panlungsod or Sangguniang bayan shall forward to the Sangguniang
Panlalawigan for review, copies of approved ordinances and the resolutions
approving the local development plans and public investment programs
formulated by the local development councils.”

2.) DILG Opinion no. 3, 2009 (Reference number: LO-003S2009)

Explanation:

It is apparent from Section 56 that the Sangguniang Panlalawigan shall review


copies of the approved:
a. Ordinances
b. Resolutions that approve local development plans and public investment
programs formulated by the local development councils.

DILG Opinion no. 3 series of 2009 explained that the power of review conferred
unto the Sangguniang Panlalawigan extends only to approved city ordinances and
resolutions approving the local development plans and public investment programs
formulated by the local development councils.

Stated differently, all approved ordinances of component cities are mandated by


the Local Government Code to be forwarded to the Sangguniang Panlalawigan for
review. On the other hand, resolutions are not anymore to be forwarded to the
Sangguniang Panlalawigan for review except those resolutions approving and
adopting the local development plans and public investment programs of
component cities.
