MEMORANDUM
I. AUTHORITY/REFERENCE:
2. On or about 12:45 AM of February 15, 2019, Friday, Franco Reyes, who was
intoxicated with alcohol, came home to ask for money from his wife named Reychel Reyes.
Due to the fact that Reychel has no money to give, Franco, enraged with his anger, starts to
slap, punch and kick Reychel.
3. As Reychel was kicked in her stomach, she fell on the ground. While Franco
was approaching Reychel, their son, Kenneth Reyes, who just came from work, saw what was
happening and due to the fast pace of events, he immediately grabbed a metal pipe, and hit
Franco three times in his head, one (1) while the victim is standing and the other two (2) while
the victim is already unconscious.
4. While patrolling the area of Victory Hills, Fortune, Marikina City, PMsg Arvin
Parta and PCpl Ronnie Rivas from the Fortune Police Sub-Station, was approached by Marites
Villanueva y Reyes. Marites said to the aforementioned officers that Kenneth killed the victim
while she was pointing at the house located at #12 Princess St, Victory Hills, Fortune, Marikina
City.
7. The witness/ reportee Marites Villanueva y Reyes has given her Sworn
Statement at the Marikina City Police Station at 3:00 AM regarding the killing that transpired
on or about 12:45 AM, February 15, 2019 at #12 Princess St, Victory Hills, Fortune, Marikina
City.
8. The suspect Kenneth Reyes y Palapar has given his Sworn Statement at the
Marikina City Police Station at 4:00 AM regarding the killing that transpired on or about 12:45
AM, February 15, 2019 at #12 Princess St, Victory Hills, Fortune, Marikina City.
9. After the suspect had given his Sworn Statement, he was then brought to
Amang Rodriguez Memorial Medical Center for his Medical Examination which is administered
by Dr. Bobby Uy.
10. After the Medical Examination, the suspect was then brought to the lock-up
jail of Marikina City Police Station.
IV. CONCLUSION
11. After a careful perusal in this particular incident, probable cause exists that
herein suspect displayed intent of killing through the use of a metal pipe, hence the proximate
cause of this incident resulted to the death of the victim, the suspect’s intentional manner is
the cause, and that the victim and the suspect are relative of first (1 st) degree, therefore he is
criminally liable for Parricide.
