1. Kenneth Reyes is accused of killing his father Franco Reyes with a metal pipe after witnessing his father physically assaulting his mother. 2. Police officers responded to the scene and found Franco Reyes unconscious and bleeding. He was declared dead upon arriving at the hospital. 3. Parricide

DATE : February 15, 2019

I. AUTHORITY/REFERENCE:

Progress Report on re Alleged Parricide dated February 15, 2019.

II. MATTERS INVESTIGATED

1. This pertains to the report submitted to the Fortune Police Sub-Station


regarding the alleged Parricide that transpired on or about 12:45 AM of February 15, 2019,
Friday, wherein a victim who is identified Franco Reyes y Gagarin, 45 years of age, Delivery
Boy, married, native of Bulacan, residing at #12 Princess St, Victory Hills, Fortune, Marikina
City. Upon the report submitted, the suspect was identified as Kenneth Reyes y Palapar 22
years of age, bagger, single, native of Marikina presently residing at #12 Princess St, Victory
Hills, Fortune, Marikina City.

III. FACTS OF THE CASE

2. On or about 12:45 AM of February 15, 2019, Friday, Franco Reyes, who was
intoxicated with alcohol, came home to ask for money from his wife named Reychel Reyes.
Due to the fact that Reychel has no money to give, Franco, enraged with his anger, starts to
slap, punch and kick Reychel.

3. As Reychel was kicked in her stomach, she fell on the ground. While Franco
was approaching Reychel, their son, Kenneth Reyes, who just came from work, saw what was
happening and due to the fast pace of events, he immediately grabbed a metal pipe, and hit
Franco three times in his head, one (1) while the victim is standing and the other two (2) while
the victim is already unconscious.

4. While patrolling the area of Victory Hills, Fortune, Marikina City, PMsg Arvin
Parta and PCpl Ronnie Rivas from the Fortune Police Sub-Station, was approached by Marites
Villanueva y Reyes. Marites said to the aforementioned officers that Kenneth killed the victim
while she was pointing at the house located at #12 Princess St, Victory Hills, Fortune, Marikina
City.

5. PMsg Parta and PCpl Rivas immediately responded to the aforementioned


location and they saw the unconscious victim laying down oozing in his blood. As he was seen
breathing, PCpl Rivas immediately called for an ambulance and a backup police personnel.
PMsg Parta and PCpl Rivas arrested Kenneth Reyes on the scene and brought him to the
Fortune Police Sub-station and later on, Marikina Police Station.
6. The victim, Franco Reyes y Gagarin was brought to St Vincent General
Hospital. Dr. Hayden Mo immediately attended the victim and tried to revive him. But to no
avail, Dr. Mo declared that the victim is Dead-on-arrival at on or about 1:20 AM of the
aforementioned date.

7. The witness/ reportee Marites Villanueva y Reyes has given her Sworn
Statement at the Marikina City Police Station at 3:00 AM regarding the killing that transpired
on or about 12:45 AM, February 15, 2019 at #12 Princess St, Victory Hills, Fortune, Marikina
City.

8. The suspect Kenneth Reyes y Palapar has given his Sworn Statement at the
Marikina City Police Station at 4:00 AM regarding the killing that transpired on or about 12:45
AM, February 15, 2019 at #12 Princess St, Victory Hills, Fortune, Marikina City.

9. After the suspect had given his Sworn Statement, he was then brought to
Amang Rodriguez Memorial Medical Center for his Medical Examination which is administered
by Dr. Bobby Uy.

10. After the Medical Examination, the suspect was then brought to the lock-up
jail of Marikina City Police Station.

IV. CONCLUSION

11. After a careful perusal in this particular incident, probable cause exists that
herein suspect displayed intent of killing through the use of a metal pipe, hence the proximate
cause of this incident resulted to the death of the victim, the suspect’s intentional manner is
the cause, and that the victim and the suspect are relative of first (1 st) degree, therefore he is
criminally liable for Parricide.

12. This case is considered solved and closed.

V. RECOMMENDATION

13. Wherefore, in view of the foregoing, the undersigned respectfully


recommends that this case be referred to the Office of the Marikina City Prosecutors Office for
final disposition.
