Nominal complainant, through the undersigned Special Prosecutor, respectfully submits


this Position Paper and states:

IV. ISSUE/S

Whether or not the respondent is guilty of Conduct Unbecoming of a Police Officer under
NAPOLCOM MC No. 2016-002?

V. ARGUMENTS AND DISCUSSIONS

It is the policy of the State to promote a high standard of ethics in public service. 1 To
further emphasize this, the Philippine National Police promulgated the PNP Ethical Doctrine
which prescribes the moral and ethical guidance that its members must abide, adhere to and
internalize. The doctrine provides that PNP members are expected to serve with utmost
responsibility, integrity, morality, loyalty and efficiency with due respect to human rights (italics

supplied) and dignity as hallmark of a democratic society. Moreover, the doctrine dictates that
PNP members are required to act in a manner that would reflect best on the PNP.

VI. PRAYER

WHEREFORE, it is respectfully prayed that the pieces of evidence submitted by


respondent, particularly the Affidavits of Desistance, be deemed inadmissible in evidence and
that respondent be found liable for Conduct Unbecoming of a Police Officer and meted with the
appropriate penalty provided under the law.

Other relief which this Office may deem just and equitable are likewise prayed for.
