SUBJECT : Investigation Report Re: Alleged Reckless Imprudence Resulting to


Damages of Property transpired along Rotonda,
Barangay Nazareth, CDOC.

I. AUTHORITY:

September 21, 2020, and

II. MATTERS TO BE INVESTIGATED:


3. To determine fact and circumstances surrounding the incident
4. To determine other relevant matters that would require further police actions
5. To determine the extent of damages incurred by Rolls Royce bearing
plate no. TOY 143.

III. FACTS OF THE CASE:


6. On or about 6:20 in the morning of September 21, 2020, BPAT's of Barangay
Nazareth, this city reported and seek police assistance on the alleged vehicular
accident along Rotonda, Barangay Nazareth, this city. PCpl Chuy Kau Bai was
dispatched and returned to this police station together with the alleged involved
parties.
Upon confrontation at this office Police Station 9, Datuon Siya y Gong, 24 years
old, single, a resident of 38 St. Barangay Nazareth, this city (referred to as V1 driver)
requested to put into record that while his vehicle Rolls Royce, color red bearing plate
no. TOY 143 was parked unattended at the side of the road along Rotonda while
jogging around Rotonda circle when suddenly heard an impact of collision and upon
verification, a color yellow Mercedez-Benz hit his vehicle and shouted to the driver to
stop but instead fled from the scene of accident. He then chased said vehicle and was
able to flagged it down along 15 St Nazareth and asked the driver of his identity which
later identified as King Kong y Kang. 36 years old single and a resident of Haven's
Subdivision, Barangay Lumbia, this city
(referred as V2 driver), holder of LTO NPDL no NO1-12-234567 with restriction code 1
& 2 valid until 2021-02-02 Few minutes later, the responding Police officer together with
the BPAT Juan Pedro brought both parties at the Police Station 9 (Hereto attached the
copy of excerpt from PS-9 biother entry no 012345678910 dated September 21, 2020
as Tab "A")

7. In the investigation conducted by the duty traffic investigator alleged


vehicular incident disclosed that after verification and ocular inspection to the
alleged damages revealed that V1 vehicle incurred damage at the front portion
particularly the right signal light, it was broken and measured 1 15 meters in
height from the concrete surface, crack signal light holder, misaligned right side
bumper scratches and dents on the bumper while V2 has only visible scratches
and dents the front left portion of the bumper Damages were photograph thereto
attached the copy of the excerpt from PS-9 blotter entry no 10987654321 dated
September 21, 2020 as Tab 'B' and photograph of Damages of the vehicle with
measurement as Tab "C")

8. Follow-up investigation conducted by the duty traffic investigator in the place


of incident, revealed that some of the debris of V1 was recovered at the side of
the road indicating that V1 was parked fronting Rotonda circle. Further, a walk-
thru was made and disclosed that it was not suitable for parking for it was narrow
and the incoming vehicle from 15 St. Nazareth were blinded by the curve lane.
The vehicle in the opposite direction will be surprised and probably had a
tendency to maneuver to the night. Furthermore, no CCTV camera found around
the place of incident and no bystanders for possible eyewitness of the incident
(Hereto attached the photograph in the place of incident along Rotonda,
Barangay Nazareth as Tab "D)

9. In the statement of the responding BPAT Juan Pedro, 43 years of age,


married and a resident of Upper 20 St. Barangay Nazareth, this city, that on or
about 6:15 AM, September 21, 2020 while in the performance of his tour of duty
as BPAT averred that while conducting roving at the said area, he saw both
parties arguing at the road side and immediately left the place to seek for a police
assistance (Hereto attached the copy of the excerpt from PS-9 blotter entry no
1234598760 dated September 21, 2020 as Tab "E")

IV. DISCUSSION:

10. In this instant case under investigation and both parties have a respective
allegation with the incident. In the statement of V1 driver he only saw a yellow
Mercedez-Benz hit and damages his vehicle while on park at the road side
thereafter fled toward 15 St without identifying the LTO plate no and the model of
the suspected vehicle, upon chased he chance upon V2 Upon confrontation, the
driver of V2 denied the allegation of V1 which caused their heated arguments
Responding traffic investigator has brought them to this office, ocular inspection
was made and recovered particles left by the other vehicle attach to the bumper
as cause by strong impact of damages. In the statement of V2 driver, he was
surprised when he was being flagged down by V1 driver while he was travelling
to his work place at Café de Cafitana, situated at 41" St. Barangay Nazareth, this
city. Both drivers were advised to undergo medical examination due to the
suspicious smelling of alcoholic breath but V2 driver refused while V1 driver
voluntarily submitted himself with hospital no 21134567.
In the ocular inspection made by the traffic investigator to the vehicles
presented, damages were situated at the front right portion (signal light broken)
vertically measured 1,15 meters in height from the concrete surface, crack signal light
holder, misaligned right side bumper, scratches and dents on the bumper while V2 has
no current damage, only visible scratches and dents at the front left side bumper

11. In the follow-up investigation, the duty traffic investigator conducted ocular
investigation at the place of incident disclosed that the place is narrow and near a
blind curve and upon walk thru, some debris were recovered near the side of the
road Further the place and the recovered debris was photograph

V. CONCLUSION:

12. After a careful perusal surrounding this particular incident, a fact of comparison
related with the damage incurred by V1 were not appropriate/matched as to the
vertical height, structure of the vehicle and to the damages of 92. In the
disposition of the traffic investigator related with the drivers suspected smelling
alcoholic breath they submitted both drivers but only V1 driver voluntarily
submitted himself for medical attention while V2 defensively refused the
procedure.

VI. RECOMMENDATION:

13. Wherefore, in view of the foregoing the undersigned respectfully recommends


that debris recovered and both vehicles will undergo field laboratory examination
at RCLOS for paints comparison and parties involved will file their separate
complaint against each other
