JOB ORDER WORKER (JOW)
(For Renewal or Extension of Contract)

KNOWN ALL MEN BY THESE PRESENTS:

This Contract of Service entered this ________ day of ________ 20____ in the City of Quezon,
Philipphines, by and between;

The PHILIPPINE STATISTICS AUTHORITY, with principal office at TAM Building,


PSA Complex, East Avenue, Quezon City, Philippines, represented by
____________________________________ (DNS/RD), in his/her capacity as the head
Of office, as the authorized representative of undersecretary LISA GRACE S. BERSALES,
National Statistician and Civil Registrar General hereinafter referred to as PSA;

-And-

_________________________________________, of legal age and residing at


______________________________________________, Whose signature appears on page 4 of this
Contract of Service and hereinafter referred to as a Contract of Service Worker (COSW) / job Order
Workers (JOW).

WITHNESSETH:

WHEREAS, the Philippine Statistic Authority (PSA) being tasked as the primary implementing agency of
laws, among others, R.A. No. 10625, R.A. No. 11055, R.A. No. 11032, R.A. No. 10712, R.A No. 9858, R.A.
No. 9255, R.A No. 9048 and Act No,3753, need additional manpower to initially carry out the provisions
of these Act and subsequent issuance thereof;

WHEREAS, specially, the _______________________ needs extra manpower to cope with additional or
emerging tasks of the Division;

WHEREAS, both parties signed a contract on ________________ and to expire on


_______________________;

WHEREAS, the COSW/LOW, after the performance and competency/character evaluation of the
COSW/JOW pursuant tom Memorandum Order No. 2018-NS ________ dated
_____________________, 20___, possesses the qualifications and requirements and offers services to
perform the duties and functions as provided hereof in the _____________________;

NOW, THEREFORE, and in consideration of the foregoing premises and of the terms and conditions
hereinafter provided, it is hereby agreed that:

1. Renewal/Extension/Hiring, Period of Engagement, work station, works schedule and


supervision. – The contract signed on __________________________ is renewed or extended
for the period ____________________ subject the provisions hereof.

As such, the PSA shall hire the COSW effective ____________________________ until
____________________ to perform the duties and functions as provided in Clause 2 hereof to
be assigned at ___________________________ under the direction supervision of
_____________________________________.
The COWS commits to report to the workstation and to perform the duties and responsibilities
during regular working hours (______________________) form Monday
To Friday.

2. Duties and Functions – The COSW commits to perform the following duties and responsibilities
under the direction supervisions his/her supervisor as provided in Clause 1 above, to wit:

3. Comparable Salary Grade, wages and premiums. - The COSW is entitled to a comparable salary
grade (SG) ______ with a daily compensation of
_________________________________________________ (Php. __________), on a
“Equal Pay for works is suspended due to security risks such as floods, typhoon,
earthquakes, or others fortuitous event for the personnel and the government, no works is allowed.
However, if the COSW was able to Work as evidenced by time in and time out before suspension,

4. Record of Attendance and Submits of Reports. – The COSW is to work on agreed schedule as
provided in Clause 1, para. 2 above and on such schedules as may be agreed between the COSW
and the Super duly reviewed and with Supervisor duly determined by the National Statistician
and Civil Registry General (NSCRG) upon the recommended of the ____________________. The
supervisor is to submit the agreed monthly schedule to the Human Resources Division (HRM) for
monitoring of attendance, In case of change of schedule, the supervisor shall inform the HRM. In
the exigency of the service, the COSW is authorized to work in the weekends. Holiday or beyond
office hours as the case maybe. As such at least one permanent second level employee who is
assigned to the ________________________ must be present to the supervise the
administrative assistants III who will report the works.

5. Other Entitlement. – The COSW is authorized to attend PSA Workshop r Lectures on Workplace
integration and coordination as determined by the agency to ensure that the roles of the COSW
and regular Employees are clear and not redundant. The workshop/Lecture are also set the
work standing and protocols of PSA. If the activity is to be conducted outside the station , COSW
may be authorized to travel,

6. Confidentiality. – All materials, document and information that may come into the possession of
the COSW for the purposes for this Contract and Service are to remain confidentiality and
should not be given or disclosed to any third party at any time, in any forum , without prior
consent of the PSA

7. Suspension and termination. – Unless otherwise renewed or noticed, upon the arrival of the
end state above, this contract of service is understood to be terminated. No separate notice of
termination needs to be served of this provision serves as notice of termination under the
condition stated in the immediately preceding sentence ;
The contract of Service may be terminated at any time during its affectivity in the event of
unsatisfactory performance of work of the COSW deliberately violates the
Provisions of the contract in addition, immediate, dismissal may be resorted to in the events that the
person hired under the contract of Service is prima facie found to be directly or indirectly in the
fallowing activities, commissions of offense/s as provide in Clause 9hereof and/or as may be provided in
applicable laws, rules and regulations.

Moreover, the provisions of memorandum Order No. 2018-_____ dated 19 December 2018 are to be
strictly observed.

8. Administrative Disciplinary Policies. – The COSW is to be subject to administrative disciplinary action


as provided hereof. Administrative offences with corresponding penalties are classified into grave, less
grave or light, depending on their gravity or depravity and effect on the government service as provided
hereunder, without prejudice of filling appropriate criminal and/or civil case/s against any person/s, to
wit.

8.1. Grave Offence.- The following grave offenses shall be immediate termination of contact or
agreement

8.1.1. Dishonesty (whether serious or less serious);

8.1.2. Violations of any provision/s of republic Act No.10173 106

8.1.3. Using peddling, selling, trading, or producing of any dangerous or illegal drugs
regardless of volume;

8.1.4. Gross neglect of duty;

8.1.5. Grave misconduct;

8.1.6. Being notoriously undesirable;

8.1.7. Conviction of a crime involving moral turpitude;

8.1.8. Falsification of official document;

8.1.9. Physical or mental incapacity or disability due to immoral or vicious habits;

8.1.10 receiving for personal use of fee, gift or other valuable thing in the course of
Official duties or in connection therewith when such fee, gift of other valuable
Thing is given by any person in the hope or expectation of receiving favor of better
Treatment than that accorded to other persons, or committing acts punishable

8.1.11. Contracting loans of money or other property from persons with whom the office of
the COSW or JOW has business relations;

8.1.12. Soliciting or accepting directly or indirectly, any gift, gratuity , favor, entertainment,
loan or anything of monetary value which in the course of his/her/their duties or in
connection with any operation being regulated by, or any transaction which may
be affected by the functions of one’s office. The propriety or impropriety of the
foregoing is to be determined by its value, kinship, or relationship between giver
and receiver or manifestly excessive by its very nature;

8.1.13. Disloyalty to the Republic of the Philippines and to the Filipino peoples;

8.1.14. Oppression;
8.1.15. Disgraceful and immoral conduct;

8.1.16. Inefficiency and incompetence in the performance of duties;

8.1.17. Frequent unauthorized absences (habitual absenteeism);

8.1.18. Habitual tardiness in reporting for duty causing prejudice to the operations of the
Office/service / department/unit/section;

8.1.20. Refusal to perform duty and assignments as provided in the contract or agreement;

8.1.21. Gross insubordination;

8.1.22. Conduct prejudicial to the best interest of the service;

8.1.23. Directly or indirectly having financial and material interest in any transaction
requiring the approval of one’s office. Financial and material interest is defined as
pecuniary or proprietary interest by which a person will gain or lose something;

8.1.24. Owning, Controlling, Managing or accepting employment as officer, employee,


consultant, counsel, broker, agent, trustee, or nominee in any private enterprise
regulated, supervised or licensed by PSA, unless expressly allowed by law:

8.1.25. Disclosing or misusing confidential or classified information officially known to one’s


office and not made available to the public, to further one’s interest or give undue
advantage to anyone, or prejudice the public interest;

8.1.26. Obtaining or using any statement filed under the Code of Conduct and Ethnical
standards for public Officials and employees for any purpose contrary to morals or
public policy or any commercial purpose other than by news and communications
media for dissemination to the general public;

8.1.27. Recommended any person to any position in a private enterprise which has regular
or pending official transaction with his/her/their office, unless such
recommendation or referral is mandated by (1) law, or (2) international agreements,
commitment and obligation, or (3) as part of the functions of one’s office;

8.1.28. Plagiarism;

8.1.29. Thief of property, whether government or private, for so long as it is in


premises/area under the effective responsibility of the PSA;

8.1.30. Directly committing or being indirectly involve with falsification or irregularity of own
or another employee’s time records. Falsification includes causing unauthorized
erasures or markings on the Daily Time Record, and other similar violations
contained in the civil service rules and regulations;

8.1.31. Frequent tardiness and absences. For purpose of this Contract of Service, frequent
tardiness mean reporting late for work for more than five (5) times in a month, or a
total of ten (10) times in two (2) succeeding months. Frequent absences mean
absence of three (3) days or more in a month;
8.1.32. Unjustified or continued refusal to wear the prescribed office uniform and
Identification card;

8.1.33. Discourtesy and dishonesty in the course of official duties;

8.1.34. Abandonment of work;

8.1.35. Willful disobedience of lawful orders connected with work;

8.1.36. Fraud or breach of trust;

8.1.37. Permanent disability;

8.1.38. Criminal conviction;

8.1.39. Conviction of administrative offense/s with penalty of dismissal from service or


suspension of at least three months in PSA and/or in any other government
agency/ies or private entity/ies; and

8.1.40. Other analogous causes.

8.2. Less Grave Offenses. – The following less grave offenses are punishable by suspension of least
six(6) months for the first offense; and immediate termination of contract or agreement for the
second offense:

8.2.1. Failure to act promptly on letters and request within the reglementary period or
failure to process documents and complete action on documents and paper within a
reasonable time from preparation thereof, or within the reglementary period prescribed
under Republic Act No. 11032107;

8.2.2. Failure to attend to anyone who wants to avail himself/herself of the services of the
office, or act promptly and expeditiously on public transactions;

8.2.3. Possession of any dangerous or illegal drugs regardless of volume;

8.2.4. Simple neglect of duty;

8.2.5. Simple misconduct;

8.2.6. Discourtesy in the course or performance of duties;

8.2.7. Insubordination;

8.2.8. Habitual drunkenness;

8.2.9. Unfair discrimination in rendering public service due to a party affiliation or


preference;

8.2.10 Failure to file sworn statements of assets, liabilities and net worth (SALN), and
disclosure of business interest and financial connections including those of their
spouses and unmarried children under eighteen (18) years of age living in one’s
households;

8.2.11. Failure to resign from one’s position in the private business enterprise within ten (10)
days from actual discharge of duties when conflict of interest arises, and/or failure to
divest himself/herself of his/her

Shareholdings or interest in private business enterprise within sixty (30) days from
actual discharge of duties when conflict of interest arises;

8.2.12. Engaging directly or indirectly in partisan political activities by one holding non-
political office; and

8.2.13. Commission of acts without prior notice and justifiable grounds such as, but not
limited to:

9. Incurring of at least five (5) absences in a month, whether consecutive or not;

10. Loafing (issued with five (5) notices) in a month, whether consecutive or not;

11. Tardiness of at least ten (10) tardiness in a month, whether consecutive or not;

12. Failure of at least five (5) instances in a week to provide services or conveyance to
any official/s or authorized passenger/s as provided in the approved trip ticket/s;

13. Failure of at least five (5) instances in a week to carry out instruction/s prescribed
by the Head of Office. Supervisors or their respective authorized representatives;

14. Failure to attend at least five (5) meetings in a month or such function duly
authorized by the Head of Office and or immediate Supervisors; and

15. Such act/s analogous thereof and/or contrary to any of the provisions of this
Memorandum Order and/or existing rules and regulations promulgated by the PSA
and/or polices prescribed under existing laws, rules and regulations.

8.2.14. Other analogous causes.

8.3. Light Offenses – The following light offenses are punishable by reprimand for the first offense;
suspension of one (1) to thirty (30) days for the second offense; and dismissal from the service
or termination of contract for the third offense:

8.3.1. Simple discourtesy in the course or discharge of duties;

8.3.2. Improper or unauthorized solicitation of contributions from subordinate employees


And officials of the PSA;

8.3.3. Violation of reasonable office rules and regulations;

8.3.4. Delay or late or non-submission of the proof of rendition of service and attachments
thereof;

8.3.5. Commission of acts without prior notice and justifiable grounds such as, but not limit
to:

8. Incurring of four (4) absences or below in a month, whether consecutive or not;

9. Loafing (issued with four (4) notices or below in month);

10. Tardiness of four (4) absences or below in a month, whether


11. Failure of four (4) instances or below in a week to provide services or conveyance to
any official/s or authorized passenger/s as provided in the approved trip tickets;

12. Failure of four (4) instances or below in a week to carry out instruction/s prescribed
by the head of office, supervisors or their respective authorized representatives.

13. Failure to attend four (4) meetings or below in a month or such function/s duly
authorized by the head of office and/or immediate supervisors; and

14. Such act/s analogous thereof and/ or contrary to any of the provision of this
memorandum order and/or existing rules and regulations promulgated by the PSA
and/or polices prescribed under existing laws, rules and regulations:

8.3.6. Gambling prohibited by law;


8.3.7. Refusal to render service beyond the regular working hours;

8.3.8. Disgraceful, immoral or dishonest conduct prior to entering the service;

8.3.9. Borrowing money by superior officers from subordinates;

8.3.10. Willful failure to pay just debts or willful failure to pay taxes due to the
government.
Provided, that term “just debts” shall apply only to:

3. Claims adjudicated by a court of law; or

4. Claims the existences of justness of which are admitted by the debtor;

8.3.11. Lobbying for personal interest or gain in legislative halls and offices without
authority;

8.3.12. Promoting the sale of tickets in behalf of private enterprises that not intended for
charitable or public welfare purposes and even in the latter cases, if there is no prior
authority from the NSCRG;

8.3.13. Engaging I private practice of one’s profession unless authorized by the


constitutions, law or regulation and/or NSCRG, provided, that such practice will not
conflict with one’s official functions; and

8.3.14. Pursuit of private business, vocation or profession without the permission.

8.3.15. Other analogous causes.

8.4. Other Specific Offenses. – The following acts also constitute administrative offenses:

8.4.1. The Offense of Sexual Harassment:

4. Grave offenses punishable by immediate termination of contract or agreement are to


include, but not limited to:

a. Unwanted touching private parts of the body (inner thighs, genetalia, buttocks and
breasts);

b. Sexual assault;

c. Malicious touching;
d. Requesting for sexual favor in exchange for employment, promotion, local or foreign
travels, favorable working conditions or assignments, a passing grade, the granting of
honors or scholarship, or the grant of benefits or payment of a stipend or allowance; and

e. Other analogous cases.

5. Less Grave Offenses punishable by suspension of one (1) year or termination of the
contract or agreements are to include, but are not limited to:

a. Unwanted touching or brushing against a victim’s body;

b. Pinching not failing under grave offenses;

c. Derogatory or degrading remarks or innuendoes directed toward the members of one’s


sex, or One’s sexual orientation or used to describe a person;

d. Verbal abuse with sexual overtones; and

e. Other analogous cases.

6. Light Offenses punishable by suspension of six (6) months to one (1) year are to include, but are
Not limited to:

a. Surreptitiously looking at a person’s private part or worn undergarments;

b. Making sexist statements and uttering smutty jokes or sending these through text,
electronic mail including but not limited to social media platform, causing embarrassment
or offenses and carried out after the offender has been advised that they are offensive or
embarrassing or, even without such advise, when they are by their nature clearly
embarrassing, offensive or vulgar;

c. Malicious leering or ogling;

d. Display of sexually offensive pictures, materials or graffiti;

e. Unwelcome inquiries or comment about a person’s sex life;

f. Unwelcome sexual filtration, advances, propositions;

g. Making offensive hand or body gestures at an employee;

h. Persistent unwanted attention with sexual overtones;

I. Unwelcome phone calls with sexual overtones causing discomfort, embarrassments,


Offense or Insult to the receiver; and

j. Other analogous cases.

8.4.2. Violations of Republic act No. 9485 or Anti-Red Tape Act of 2007

1. Grave Offense:

a. Fixing and/or collusion with fixers in consideration of economic and/or other gain or
advantage shall be penalized by dismissal and perpetual disqualification from public
service.
2. Light Offenses:

a. Refusal to accept application and/or request within the prescribed period or any
Document being submitted by a client;

b. Failure to act on an application and/or request or failure to refer back to the client a
request which cannot be acted upon due to lack of requirements within the prescribed
period;

c. Failure to attend to clients who are within the premises of the office or PSA prior to the
end of official working hours and during lunch break;

d. Failure to render frontline services within the prescribed period on any application
and/or request without due cause; and

e. Imposition of additional irrelevant requirements other than those listed in the first
notice.

Except as provided in clause 12.4.2(1) above and/or as may be provided in existing laws,
Rules and regulations, the foregoing light offenses shall be penalized as follows:

First Offense – Thirty (30) days suspension without pay and mandatory attendance in
Values Orientation Program;

Second Offense – Three months suspension without pay;

Third Offense – Dismissal and perpetual disqualification from selection and hiring in any
Positions of the PSA.

9. Other Conditions. – The other conditions shall be observed

9.1. Payment of services under this contract of service is to be charged to PSA funds subject to
applicable withholding tax and/or other taxes pursuant to existing laws and revenue
regulations, availability of funds, and usual auditing and accounting, rules and regulations.

9.2. This Contract of Service may be amended or supplemented through the execution of a
contract Variation. Such variation in the contract shall be effective only on the date and for
the period stated therein, and provided both parties agree to the terms and conditions
stated. Any Contract variation is deemed an integral and amendatory part of this contract
of service.

9.3.This service rendered by the COSW under this contact of service cannot be
considered or counted as government service. Thus, the COSW shall not be
entitled on any benefits due to regular or casual employees, such us leave credits
(sick/Vacation/social/emergency leave), Christmas bonus and cash gift, personnel
economic relief allowance (PERA), productivity incentive bonus (PIB), uniform
allowance, and other similar benefits.

9.4. The COSW shall be answerable for any claim for losses and for damage to
property of the office, its employees, offices or agents or to third parties or
personal injury which may arise from the work of service under this contact of
Service through own negligence or own misbehavior.

9.5. If the COSW is designated to assist in workshops/training/meeting or performs


function outside work station, the transportation and accommodation expenses
shall be charged to PSA Funds;
9.6.The COSW shall be subjected to performance assessment using the PSA’s
instrument and standards and the result are to serve as among of the bases for
proper action/s of the competent authorities of the Philippines Statistics Authority
(PSA); and

9.7.It the COSW is to resign. Or if her contact is terminated/has arrived at the end date,
then, Administrative Assistant III is to properly turn over all materials, documents
and information under her position to the immediate supervisor.

10. Suppletory Application of Relevant Laws, Rules and Regulations. – the pertinent
provisions of memorandum order No. 2018-____ dated _____________ 108, CSC-COA-
DBM join circular No. 1, s 2017 dated June 15, 2017 109 as amended by CSC-COA-DBM
join circular No. 1,s 2018 dated November 9, 2018 110, CSC resolution No. 020790
promulgated on June 5, 2002111 CSC En Banc Resolution No. 1800692 promulgated on
July 3 2018 and circularized pursuant to MC No. 14, s 2018 issued on August 30,
2018112 CSC Resolution No. 062254 promulgated on December 20, 2006 circularized
per MC No. 01, s. 2007113, GPBB policy Opinions No. 2012-11-21114, GPPB Resolution
No. 09-2012 promulgated on April 27, 2012 115 and subsequent issuances thereof, are
to be applied suppletory, strictly implemented and to serve as the governing
guidelines hereof accordingly.
