PROJECT BASED EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This Employment Contract made and entered into this ___ of____, 2019 in ____
City, by and between:

_____________, Filipino, of legal age and with residence and postal address at
_________, hereinafter referred to as the “PROJECT BASED EMPLOYEE”

And

_______________________________________, a Proprietorship duly registered and


existing in accordance with the laws of the Republic of the Philippines with
address at ____________________________________, represented herein by its
___________________________________________, __________________________________
hereinafter referred to as “PROPRIETORSHIP”

WITNESSSETH: that

WHEREAS, the PROPRIETORSHIP is engaged in the [DESCRIPTION OF


BUSINESS];

WHEREAS, PROPRIETORSHIP, is in need of an (POSITION) for (PROJECT),


hereinafter referred to as the PROJECT;

WHEREAS, the PROPRIETORSHIP desires to employ and retain the services of


the “PROJECT BASED EMPLOYEE” on a project basis according to the terms
and conditions herein.

WHEREAS, the “PROJECT BASED EMPLOYEE” has signified his willingness and
warranted his qualification for the position;

WHEREAS, PROPRIETORSHIP, warrants that this Employment Contract is


compliant with the minimum requirements of the Labor Code and stands in deference
and is superseded by the laws as stated in the Labor Code of the Philippines;
NOW, THEREFORE, In consideration of the mutual covenants and promises
made by the parties hereto, the PROPRIETORSHIP and the PROJECT BASED
EMPLOYEE covenant and agree as follows:

TERMS AND CONDITIONS:

1. TERM. The term of this Project Based Employment Contract shall


commence on [START DATE] and continue [TIME FRAME].

2. TERMINATION. The PROJECT BASED EMPLOYEE agrees and


acknowledges that, just as they have the right to terminate their
employment with the PROPRIETORSHIP at any time for any reason
(subject to proper turnover and transition if needed), the
PROPRIETORSHIP has the same right, and may terminate their
employment with the PROPRIETORSHIP at any time for any reason.
Either Party may terminate said employment with written notice to the
other Party.

The contract maybe terminated at anytime for cause as


provided for by law and/or existing Proprietorship Policy.
This maybe terminated if services are unsatisfactory, or
when it shall no longer needed, as determined by the
Proprietorship. If services are still needed beyond the
validity of this contract, the Proprietorship shall extend the
services of the Project Based Employee. After services are
terminated, the Project Based Employee shall be under no
obligation to re-employ with the Proprietorship nor shall
the Proprietorship be obliged to re-employ the Project
Based Employee.

3. DUTIES. The PROPRIETORSHIP shall employ the PROJECT BASED


EMPLOYEE as [POSITION TITLE] (the “Position”). The PROJECT BASED
EMPLOYEE accepts Project Employment with the PROPRIETORSHIP on
the terms and conditions set forth in this PROJECT BASED EMPLOYEE
Employment Contract, and agrees to devote his full time and attention
(reasonable periods of illness excepted) to the performance of his duties
under this Agreement. In general, the PROJECT BASED EMPLOYEE shall
perform all the duties as described on Exhibit A attached hereto.

4. HOURS OF WORK. The PROJECT BASED EMPLOYEE’s hours of work
shall be [DAY OF WEEK] to [DAY OF WEEK] at hours determined by the
employer provided that ordinary working hours shall not exceed
[AMOUNT] hours per week.

5. COMPENSATION. In consideration for the performance of the duties


hereunder, the PROJECT BASED EMPLOYEE shall be entitled to
compensation as described:

The PROJECT BASED EMPLOYEE shall be entitled to receive a [TIME


FRAME] rate of [PESO/DOLLAR AMOUNT] per [TIME FRAME] (the
“Compensation”) for performance of the duties described in this
Agreement for the term of the Agreement.

Compensation shall be paid by the PROPRIETORSHIP every [PAY


PERIOD] (the “Pay Period”) within [NUMBER OF DAYS] from the end
of the Pay Period for which the Compensation is paid. For example,
payments from the Pay Period ending [DATE] will be paid on or
before [DATE].

NO OTHER COMPENSATION. The compensation set out above shall


be the PROJECT BASED EMPLOYEE’s sole compensation under this
Agreement.

6. RETURN OF PROPERTY. Within Seven (7) days of the termination of


this Project Based Employment Contract, whether by expiration or
otherwise, the Project Based Employee agrees and obligates itself to
return to the Proprietorship, all products, samples, or models, and all
documents, retaining no copies or notes, relating to the Proprietorship’s
business including, but not limited to,

obtained by the Project Based Employee during its representation of the


Proprietorship.
7. PROPRIETORSHIP PROCEDURES. The Project Based Employee agrees
and acknowledges that he or she shall comply with the Proprietorship’s
established disciplinary code as well as any other rules, policies, and
procedures that may be introduced from time to time. Copies of such
documents are available upon request.

8. NO MODIFICATION UNLESS IN WRITING. No modification of this


Agreement shall be valid unless it is in writing, agreed upon by both
Parties.

9. APPLICABLE LAW. This Project Based Employment Contract and the


interpretation of its terms shall be governed by and construed in
accordance with the laws of the Republic of the Philippines and subject
to the exclusive jurisdiction of the courts of Quezon City.
