Tutorial Questions—4

1. Critically examine the various heads that make up the award of damages for negligently
caused personal injury.

2. One afternoon last October, the company vehicle carrying Nick, a manager employed
by the Postal Service, crashed into a lamppost on the highway. The driver, Jacob, a
fellow employee, unknown to Nick had consumed two large whiskies at lunch that
day. Nick was not wearing a seatbelt and he suffered injuries which left him in a
coma for a month and left his face disfigured. Nick has since been in excruciating
pain and has suffered with depression. He needs constant attention as he is unable to
control his arms and legs. His wife who owns a very popular clothing store and makes
on average $8,000, 000 a year has closed the store in order to focus her attention on
Nick. At the time of the accident, Nick, who was then age 40, earning $100,000 a
year. He enjoyed cycling and swimming.

Advise Nick.
