THE GOVERNMENT OF THE PHILIPPINE ISLANDS, applicant-appellant, vs.

CONSORCIA CABANGIS, ET AL., claimants-appellees.

G.R. No. L-28379, March 27, 1929

FACTS

Consorcia Cabangis, et al. owned a parcel of land situated somewhere in Manila Bay which is
now claimed by the Government. It was established that due to the gradual erosion caused by the
ebb and flow of the tide, until the year 1901, when the waters of Manila Bay completely
submerged a portion of it, including the lands of Cabangis, et al in question. It was reclaimed as
a result of certain work done by the Government in 1912. Because of the reclamation made by
the Government, it is now petitioning that such land is public dominion.

ISSUE

Whether or not reclaimed land by the Government is of public dominion? (YES)

RULING

As the lots in question disappearedby natural erosion due to the ebb and flow of the tide, and
asthey remained in that condition until reclaimed from the sea bythe filling in done by the
Government, they belong to the publicdomain for public use. (Aragonvs.Insular Government, 19
Phil.,223; Franciscovs.Government of the Philippine Islands, 28Phil., 505.)
