SUBJECT: EVALUATION/RECOMMENDATION ON THE LETTER-REQUEST OF


CHRISTOPHER LAURENTE SEEKING FOR LEGAL REPRESENTATION

S I R:

This refers to the letter dated March 8, 2017 of Mr. Christopher Laurente
who addressed the same to the BALA Director in search for legal representation
from our Office involving a cancellation case filed by the DAR PARPO of the
Province of Bukidnon.

Per documents attached, Christopher has a Special Power of Attorney from


his father Rodito, who was awarded TCT-CLOA No. 00372950 in 1997 by the DAR
over a landholding consisting an aggregate area of 10,117 square meters situated
in Brgy. Tongantongan, Valencia City, Bukidnon.

Sometime on November 18, 2006 Ruperto, the father of Rodito and the
grandfather of Christopher, allegedly executed a “Kasulatan sa Palit” in favor of
the Sps. Raul and Melodia Amora conveying the aforesaid landholding in the
latter’s favor. Likewise, the Sps. Amora sold the land to a certian Engr. Enrique
Noveros, who in turn filed a disqualification case against Rodito Laurente.

The disqualification case ripened into the institution of this petition for
cancellation filed by the DAR Provincial Office of Bukidnon and Engr. Noveros, the
buyer.

The Laurente’s cannot seek legal assistance from the DARPO considering
that it is the petitioner in this case for cancellation. They went to the DAR
Regional Office but they were given a ran around without the legal division having
made any Commen to the petition.
Thus, the Laurente’s went to the DAR Central Office which immediately
drafted a Comment and signed by the client for filing in order to avoid the
prescriptive period.

EVALUATION:

There is no dispute that herein letter sender is a farmer-beneficiary, he


being a CLOA Holder. He is entitled to representation by the ARBLAD. Likewise,
since the DAR field offices represents the petitioner, clients have no choice but to
seek for legal assistance from our office.

RECOMMENDATION:

We may enter our appearance as counsel for the respondent Laurente in


the ALI Case and for a possible filing of an ejectment case before the regular
courts.
