Complaint Case Under Sections 416/417/493/494 Indian Penal Code, 1860

Sir,
The Complainant above-named most respectfully states as under:

1. That the Complainant (a widow) lodged an F.I.R dated 2 nd February, 2012 against the
accused about the commission of the crime described below in the nearest police station.
The police department has not taken heed of the case and no investigation was done
further to proceed with the prosecution case against the above accused.

2. That a registered notice about the commission of the crime was also served upon the
Superintendent of Police, Mumbai District narrating the offence committed by the
accused and lodging of F.I.R against him as aforesaid but nothing was heard from any
quarter. Therefore, there is no other option available to the Complainant except to file the
instant criminal complaint before this Hon’ble Court having jurisdiction to deal with the
case.

3. That the Accused by deceiving and his dishonest inducement has taken consent of the
Complainant to marry her daughter Miss. Deepa Paleja (adult) on 10 th January, 2012. The
accused intentionally induced the complainant so deceived to go through the marriage
ceremony professing himself to be a graduate and a bachelor while he is an illiterate and
has a living wife. The marriage was solemnised according to Hindu rites on 10th January,
2012 at Patil Matruti Mandir in the presence of near relatives and invitees. The reality
about the accused came into notice of the Complainant as on 31st January, 2012 when he
himself admitted his guilt before the witnesses.

4. That the Complainant and her daughter would not have consented to the above fraudulent
marriage if the real facts about the status of the accused were known to them. The
accused procured his marriage with the daughter of the complainant by fraudulent
inducement and dishonest misrepresentation and thereby caused damage to the mind and
reputation of both the Complainant and her daughter. The marriage is void by reason it
taking place during the life of the first wife of accused. Marrying again during the life of
the first wife and also cohabitation caused by the accused with the complainant’s
daughter deceitfully under a belief of lawful marriage are offences for which the accused
is liable to be punished.

It is therefore, most respectfully prayed that a criminal case be registered and instituted
against the above Accused by taking cognizance and ensuring arrest of accused.
Accordingly, the accused be punished under the provisions of law. Lawful compensation
may be awarded to the complainant and her daughter as aforesaid.
