PREAMBLE

We, the sovereign teaching personnel of the Gulod Public Secondary Schools, imploring the aid of the
divine Providence, organize into an associated in rights, as well as foster professional, harmonious and
progressive teaching environment do hereby ordain this CONSTITUTION AND BY LAWS.

ARTICLE I

NAME AND DOMICLE

Section 1 The name of the association shall be Gulod Public Secondary School Teachers
Association, herein after referred as the association.

Section 2 The association shall be domicile to the school where the president is currently
teaching, and what whoever shall be elected president of the association, the school
wherein he/she teaches will automatically venue of the association.

ARTICLE 2

OBJECTIVES AND POLICIES

Section 1 The Association shall arrive to the following objectives and policies.

a. To advance the cause of education as an agency for the Philippine Nationalism and
to promote and preserve the ideals of the Constitution of the Republic of the
Philippines.
b. To enhance the professional and cultural growth of the members and to protect
their rights, interest and welfare.
c. To undertake the projects that will improve the welfare of Gulod Public Secondary
School teachers Association and its constituent.
d. To provide voluntary financial or material assistance to members in case necessity.
e. To promote the moral, social and economic well-being of all the members and to
foster harmonious and progressive labor- management relations.
f. To protect and uphold the individual and collective rights of all members.
g. To strive for the adoption of legislation, and policies and other measures that will
promote the economic, social, and general well-being of all members, in particular,
and the working class, in general.
h. To promote the enlightenment of all the members in regard to their rights and
obligation as members and faculty, the presenter labor relation system and existing
collective negotiations agreement and all other matters that directly and indirectly
affect them.
i. To participate in decision making whenever and appropriated particularly on the
welfare of its members and on school matters.
j. To establish and organization that will represent the secondary school teachers of
Cabuyao District in collective negotiations and grievance procedure under the civil
Service Commission Rules and Regulations.

ARTICLE III

NAME OF DEFINITE EMPLOYEE AND PLACE OF OPERATION

Section 1 For Collective negotiation purposes, the definite employer is the Public Secondary
Teachers of Cabuyao District; namely Bigaa National High School; Cabuyao National High
School; Casile National High School; Gulod National High School; Pulo National High
School; Southville 1 National High School, the principal place of operation is
___________________________________________.
ARTICLE IV

MEMBERSHIP

Section 1 All full time teachers and principals in the Public Secondary School in Cabuyao District
plantilla of positions from the National and Local School board without regard to sex,
race, nationality , political belief or affilation is eligible for membership in the
association.

Section 2 Qualified Teachers of Public Secondary Schools in Cabuyao District may become
members of the Association by written application field in writing with the President
through secretary and shall be acted by the Board of Directors.

Section 3 Upon the approval of the application for membership and payments of membership fee,
rights and privileges as member will attach.

Section 4 The following shall not be eligible for membership and for election or appointments in
the Association:

a. Persons who have been convicted subversions and similar offences;


b. Persons who have been convicted of a crime involving moral turpitude; and
c. High level, highly confidential and coterminous employees are not eligible to
join the Association in consonance with the Civil Service Rules and
Regulations.

ARTICLE V

RIGHTS AND DUTIES OF MEMBERS

Section 1 Members shall have the rights to avail benefits and privileges due then from the
Association.

Section 2 Members shall have the right to be informed on business of the Association and have
the right to be consulted on its affairs whenever deemed necessary and applicable.

Section 3 Members shall have the right to run for and hold office, subject only to the qualifications
prescribed by the Association, uniformly applied.

Section 4 Members shall observe, obey and uphold the Constitution and By- laws of the
Association.

Section 5 Members shall observe whatever resolution the duty elected representatives of the
Association may promulgate.

Section 6 Members shall faithfully comply with any and all financial obligation in accordance with
this Constitution and By-laws.

ARTICLE VI

BOARD OF DIRECTORS

Section 1 The governing body of the Association shall be the Board of Directors.

Section 2 The Board of Directors shall consist of at least seven (7) members of one from each of
the Public Secondary Schools in Cabuyao District namely; Bigaa National High School;
Cabuyao National High Shool; Casile National High School; Gulod National High School;
Pulo National High School; Southville I National High School and the president of the
Association as an ex-officio.
Section 3 the Board of Directors must be a member of the Association in good standing for a at
least one year.

Section 4 Regular election of the Board of Directors of the Association shall be held on the last
Friday of February and on the same date every two years thereafter.

Section 5 The Board of Directors shall hold office for a period of two years from the date of their
election until their successors shall have been duly elected and qualified, provided that
they remain members of the Association in good standing.

Section 6 Vacancies in the board of Directors / officers except the position of president shall be
filled up by the Board of appointing any member in good standing of the association for
a continuous period of one year immediately preceding such appointment. The said
appointee shall hold office of the immediate predecessor, until a special election thereof
is called for the purpose as authorized by the Board of by the general membership.

Section 7 The Board of Directors shall administer the Association affairs, formulate policies and
implement program to electively carry out the objectives of the Association, attend and
investigate problems concerning the welfare of the schools and the members of the
association, protect the legitimate rights of the members, formulate and approved
decisions which are not against the rules of the school.

ARTICLE VII

THE OFFICERS

Section 1 The officers of the Association shall consist of the following:

President
Vice president
Secretary
Treasurer
Auditor
Business Manager
Public Information Officer (PIO)

Section 2 The officers of the Association shall be elected by the general membership.

Section 3 Regular elections of the officers of the Association shall be held on the first Monday of
March and on the same date every two years thereafter.

Section 4 The President shall:

a. Preside over meetings and deliberations of the officers and of the general
membership.
b. Create and organize essential committees with the concurrence of the
majority of the members.
c. Preserve order and defend the constitution of the association and the rights
and welfare of the members.
d. Submit recommendations and necessary responds to the members.
e. Vote only on all questions the results to a tie
f. Render a yearly report of the Association before the general assembly last
Monday of February.
g. Represent the Association on all occasions on the meeting in which
representation of the Association may be agreed upon or required.
h. Perform such other duties inherent to the position of the executive officer
of similar organizations.
Section 5 The Vice president shall:

a. Act as President in case of the latters illness , absence, temporary inability to


discharge the duties of the said office.
b. Perform such other duties as may be assign by the president.

Section 6 The Secretary:

a. Take down minutes of a general meeting assembly and of the Board


Meeting and call the roll during the meetings of the Board of Directors /
Officers and the general members.
b. Submit to the president an actual report of the achievements and activities
of the Association together with it plans for the ensuing years.
c. Keep perpetual records of the minutes of the meeting, resolution of the
Board of Directors and continuing register of all members of the Association
and prepare excerpts from the information of individual members.
d. Submit to the Department of Labor and Employment and Civil Service
Commission annually a list of Association members, list of officers and their
respective addresses, minutes of election of officers and list of voters within
(30) days from the date of election or from the occurrence of a change in
the Association officers and such other documents or papers as may be
required.

Section 7 The Treasurer shall:

a. Keep and safeguard the funds of the association and all the book of
accounts and records necessary for the purpose.
b. Collect all necessary fees and dues and issue corresponding receipts
thereof.
c. Keep a registry book, showing the names of all members of the association
with corresponding payments and dues.
d. Pay all authorized expenses duly countersigned by the President and
auditor.
e. Present the books and records of account open for examination of any
reasonable time to any member or group members of the association duly
authorized by the Board of Directors and order persons authorized by the
existing regulations and laws.
f. Submit a statement of yearly trial balance to the Board of Directors /
officers.
g. Act as a custodian of all properties that belong to the association.

Section 8 The auditor shall:

a. Audit the book of records and accounts of the association / school


organization clubs a year and certify to the correctness of the same.
b. Certify the correctness of the annual financial reports of the treasurer to the
general assembly.
c. Suspend or withheld the payments of accounts
the accordance with the expresses policies of the Board of
Directors.
d. Issue rules and Regulation in accordance with such a procedures.

Section 9 The Business Manager shall:

a. Attend the association and supervision of the social function and activities
of the association.
b. Supervise and manage the disbursement of funds to the association.
c. Attend the associations participation of any activity in style affairs.

Section 10 The Public Officer shall:

a. Attends to the publication of information regarding the association plans of


the community or for its members.
b. Act as liaison officer to the association and on activities or persons who may
desire to avail of the association service or participation.
c. Manage the associations publication or pamphlets, if any
d. Manage the publications of the activities of the association.

ARTICLE VIII

THE COMMITTEE ON ELECTION

Section 1 There shall be an independent Committee on Election composed of the Chairman and
one member from each school.

Section 2 The members of the committee shall hold office for a period of one year from time they
were appointed.

Section 3 The chairman and the members of the Committee of Elections shall be recommended
by the President subject to the approval of the board of Directors.

Section 4 The Committee on Elections shall have the following powers and functions:

a. Enforce and administer all rules and regulations promulgated by the Board
of Directors relative to the conduct of the elections.
b. Be the sole judge of all contests relating to the election and qualification of
all members of the Board of Directors.
c. Decide all administrative questions affecting elections.

Section 5 The Committee on elections shall meet as the need arises.

Section 6 In case of vacancies in the Committee on Elections, the president with the approval of
the Board of Directors shall appoint a qualified member to all the vacancies to serve the
unexpired term.

ARTICLE IX

DISCIPLINARY ACTIONS

Section 1 Any member or officer who continually and deliberately fails to mess his/her obligations
financial or otherwise, as impose by the Association shall be liable to disciplinary action
by the officers.

Section 2 Willful and culpable violation of the Constitution shall be sufficient grounds for
expulsion of any member or officer provided, however, that the concern shall be given
due hearing before any decision is made.

Section 3 All disqualification cases shall be passed upon and decided by the majority of all officers
and members of the special meeting held for the purpose. The decision made herein is
final

ARTICLE X

DUES

Section 1 A membership fees of fifty pesos (Php 50.00) shall be paid by an new member before
he/she becomes an official member of the Association.

Section 2 Every member shall pay regular dues to the Association in the amount of thirty pesos
(Php 30.00)

Section 3 Every payment of fees, dues or other contributions by a member shall be evidenced by a
receipt signed by the Treasurer or a duly authorized representative making the
collection and entered into the records of the Association to be kept and maintained for
the purpose.

Section 4 Any member who shall be three months in arrears in the payments of his regular dues
or who fails for two time to pay specials assessments , fines or other payments required
to be made shall cease to be a members in good standing and may be subjected to
other disciplinary action. In the event of sickness, leaves of absences without pay and
other similar cause, the Board of Directors may excuse non-payment or defer collection
thereof at its discretion.

Section 5 Monthly contributions shall be automatically deducted from the quarterly city
allowance every month March & September.

ARTICLE XI

FUNDS

Section 1 The funds of the Association shall consists of membership fee, monthly dues, special
assessment contribution, fund raising and donations.

Section 2 All amount collected pursuant to Section 1 and 2 of Article X shall constitute the General
Fund of the Association to be applied to the operational and organizational expenses of
the association or for any purposes or objects as may be authorized by the Board in a
written resolution adopted at a Board meeting duly called for the purpose.

Section 3 Every member shall contribute to the association such amounts as may be fixed by the
general membership through a written resolution adopted at a general assembly may
called for the purpose to be applied to for any or all of the following objects:

a. Labor Education programs


b. Collective Negotiation Agreement (CAN)
c. Welfare and Cooperative Programs
d. Attorney’s fees and
e. Such other plans and programs that will promote the interest and welfare of
the association and its members.

Section 4 Contribution to Death Aid Benefit in the amount of ten thousand pesos (Php 10,000)
shall be given when a member dies and mutual aid of two thousand pesos (Php 2,000)
when an immediate family member dies.

a. Immediate member refers to:


1. Married: Husband/Wife
Parent
Children
2. Unmarried: Parents and two beneficiaries as specified in the
membership form; if orphan, two or more beneficiaries as specified
in the application form.
3. Widow / Widower: Parents, unmarried children, if childless, to or
more beneficiaries as specified in the membership form.

Section 5 Contribution to Hospitalization Assistance in the amount of two thousand pesos shall be
given from the general fund to members for confinement for at least once in every year.

Section 6 A retirement benefits – active members for at least five years shall be given five
thousand pesos.

Php 5,000.00 - 5 years and above

Php 3,000.00 - 4 years and above

Php 2,000.00 - 3 years and above

Php 1,000.00 - 2 years and above

Section 7 Proceeds from fund raising activities shall be defined by the Board of Directors.

Section 8 Donation to / from the Association whether materials or financial shall be determined
by the Board of Directors.

Section 9 Expenditure of the funds of the association shall be evidenced by a receipt from the
person to whom the payment is made which shall state the date, place and purpose of
such payments. Such receipts shall from part of the financial records of the association.
Section 10 Disbursement of funds shall be under the discretion of the Board of Directors / Officers
as embodied in the budget for the fiscal year.

Section 11 Auditing of the funds shall be made by the auditor twice a year and will be presented
during the general assembly. Result of the first and second auditing will be posted in the
association’s bulletin board.

Section 12 The book of accounts and other records for the financial activities of the association
shall be open for an inspection by any officer anytime during the office hours.

Section 13 In case of voluntary dissolution of the Association of final its registration


certificate, the association members shall enjoy the association properties to the
extent that the said properties shall be sold to the association members and the
proceeds more form together with the balance of the association’s fund shall be
distributed each member, depending on the membership cues collected to the
association. The Bureau of Labor Relations may be consulted to differences of opinion.

ARTICLE XII

STANDING COMMITTEE

Section 1 To ensure the coordination and efficiency in the transaction of the Association matters
and in order to realize the objectives of this constitution, the following three (3)
standing committees are hereby created.

a. Internal Committee. The function of the committee shall be:


1. Receive and process application for membership and make
recommendations thereon to the president.
2. Responsible for adoption and implementation of programs. Projects
and activities that will promote and protect the general welfare of
the members.
3. Coordinate affairs within the institute sponsored by the Association.
4. Perform other duties related to membership and welfare of the
members and other duties relevant to internal affairs of the
association.

b. External Committee. The functions of the committee shall be:


1. Adopt and implement labor education program and activities that
will promote the enlightenment of the members in regard to the
prevailing labor relations system, to provision of this Constitution
and the existing CAN and all labor legislation rules, issuance and
policies that affect the members directly or indirectly.
2. Coordinate affairs of the association outside the institution.
3. Perform other duties pertaining the labor education and research
and other duties relevant to the external of the
association.
c. Committee on Collective Negotiation. The functions of the committee shall
be:
1. Research and gather all data as may be necessary in collective
negotiations. It shall assist the association’s negotiating panel in the
preparation of all necessary papers, documents and material in
collective negotiation agreement.
ARTICLE XIII

MEETING OF THE ASSOCIATION

Section 1 There shall be four kinds of meeting in the Associations.

a. Board Meetings – Regular meetings of the Officers, Board of


Directors which shall be every first Friday as
the President / Board may designate.
b. Special Meetings – Special meetings may be called at any
either at the call of president or upon request of the majority of
officers / Board of Directors upon written request of at least Thirty
percent (30%) of the members of good standing.
c. Committee Meetings – This shall be called for the purpose of
committee work with the proper notice from the president and / or
d. General Assembly, which shall be regular meeting convened to
discuss plans for the year and important matters as may be called
for on first Friday of February.

Section 2 The notice for any meeting, whether it will be general assembly or of the Officers /
Board of Directors, regular or special shall contain the item or items to be discussed and
shall constitute the agenda may be taken up upon recommendation of majority of the
Officers / Board of Directors and constituting a quorum if it be a Board Meeting of the
majority of the members present and constituting a quorum if it be a general assembly.

Section 3 Any member, who absent himself from any regular, special , or general meetings shall
within five days from the date of the said meeting, shall submit a written explanation to
the Internal Committee as to the reason or reasons of his failure to attend the meeting.
The Internal Committee shall evaluate the explanation and render a report thereof the
Board of Directors.

Section 4 In the event the reason or reasons are unacceptable to the Board of Directors for being
unjustified, the erring member or members shall pay at the discretion of the Board a
fine of not less than nor more fifty pesos (Php 50.00) through the treasurer.

Section 5 Members on official leave of absence are excused from extending meetings whether
regular, special or general assembly.

ARTICLE XIV

QUORUM AND RULES OF ORDER

Section 1 Except when a greater proportion is requires herein or by law, a majority vote which
constitute two – thirds (2/3) of the General Membership / Officers / Board of Directors,
shall prevail at meetings and deliberations of the association. A majority of the members
of the association shall constitute a quorum to officially transact any business.

ARTICLE XV

COLLECTIVE NEGOTIATION

Section 1 Collective negotiation agreement resulting from the negotiation shall be subject to the
ratification and approval by majority vote of the coordination members at a meeting
convened or by a referendum held for each purpose.
ARTICLE XVI

SELECTION OF LEGAL COUNSEL/ ADVISER

Section 1 The Board of Directors may select a legal counsel / adviser on for legal
representation of the Association.

Section 2 The legal counsel / adviser shall provide legal assistance to members.

Section 3 Expenses for the legal counsel / adviser shall be taken from the general fund of the
association.

ARTICLE XVII

FISCAL YEAR

Section 1 The Association’s fiscal year consist of twenty four (24) months or two years from
__________________________ to ____________________ of the next two years.

ARTICLE XVIII

AMENDMENTS

Section 1 Proposal for amendments to this constitution may be made by the Board of Directors or
upon formal petition of at least thirty percent (30%) of the general membership.

Section 2 No proposal shall be considered an amendment and become a part of this Constitution
after the same have been ratified by vote of all the members of the association either at
a regular or special meeting or by convention or by a referendum called for such
purpose.

ARTICLE XIX

EFFECTIVITY

Section 1 This constitution and By-Laws shall take effect on the day following its ratification.

Adopted and ratified on the_______________________ day of ______________________ at


_______________________________________, _________________________ with the Officers and,
together with their signatures.
