We have discussed with PPG Deptt. and requested them to provide revised Pension

DELHI HIGH COURT CASE
CASE OF OUR FEDRATION AT DELHI HIGH COURT ON PENSION ISSUE IS AGAIN DEFERED FOR
PHYSICAL HEARING.

We like to reproduce one case pending before the Hon'ble Supreme Court of India for information. The case
history with enclosures etc. will throw light on the present status of revision of Pension.

STATEMENT FILED BY DEPONENT C N Venugopalan, aged 71 years,


son of late Shri K R Narayanan resident of “Nandanam”,
Kesari Junction, N Paravur, Kerala – 683 513

MOST RESPECTFULLY SHEWETH THAT:

1. The deponent is similarly affected person by the act of the respondents in not updating his pension for the past two
decades, he having retired on 20th April, 2001 from Union Bank of India, a similar Public Sector Bank under the
control of the respondent government. He has also functioned as Independent Director, State Bank of Travancore
nominated by the Government during 11.01.2011 to 10.01.2014.
2. He makes this deposition before the Hon’ble Court in person in view of his inability to engage a counsel on account
of financial constraints and inability to travel long distances.
3. He files this statement in the interest of justice as any ruling emanating without a holistic view of facts and of law can
prejudicially affect a vast commune including the deponent who are expropriated their statutorily vested rights besides
jeopardising impartial justice.
4. On the above SLPs on coming up on 20.02.2022 are now posted to 13.05.2022 through the following order:
“ Mr. Rajesh Kumar Gautam, learned counsel appearing for the respondent(s) including Indian Banks’
Association, submits that the Committee which was supposed to consider the representation / claim of
the petitioners and similarly placed persons, is required to be reconstituted, as the Chairman of the
Committee is demitting office.
In the circumstances, we give three months’ time to the Indian Banks’Association to do the needful and
submit appropriate report regarding the decision taken on the proposal.
If final decision cannot be, reached, the Indian Banks’Association must submit interim report before the
next date of hearing.
List these matters after three months.”
5. By its own Legal Circular dated 30.09.2019 [EXHIBIT-D1] Indian Banks’ Association has made its status
known to the world voluntarily that it is disqualified from suing or being sued or impleaded in any manner in Courts.
6. The Pension Scheme in Public Sector Banks including the respondent bank ought to be on the lines of that in

Reserve Bank of India so far as relating to amount of pension, updating, general conditions etc in terms of clause 12
of the Memorandum of Settlement dated 29.10.1993 entered into under the provisions of the Industrial Disputes
Act, 1947 between Indian Banks’Association representing 58 banks including the respondent bank and Workmen
Unions representing employees of such banks, which is appended as EXHIBIT-D2 clause 12 reading verbatim as
“Provisions will be made by a scheme, to be negotiated and settled between the parties to this Settlement by 31st
December, 1993 for applicability, qualifying service, amounts of pension, payment of pension, commutation of
pension, family pension, updating and other general conditions, etc. on the lines as are in force in Reserve Bank of
India”.
7 Pension in Reserve Bank of India was updated by a factor of 3.63 for pensioners who retired prior to 1.11.2002,
by a factor of 2.44 for pensioners who retired during the period from 1.11.2002 to 31.10.2007 and by a factor of
1.76 for pensioners who retired during the period from 1.1.2007 to 31.10.2012 with effect from 01.03.2019 as
per EXHIBIT-D3 sanction F No.11/5/2001-IR dated 05.03.2019 from the respondent government rendering
the non-updating of pension in Public Sector Banks on similar lines breach of the EXHIBIT-D2 Settlement dated
29.10.1993.
8. Regulation 35 (1) of the Bank Employees Pension Regulations, 1995 including that of the respondent bank which
initially stood as “ In respect of employees who retired between the 1st day of January, 1986 but before
31st day of October, 1987, basic pension and additional pension will be updated as per the formulae
given in Appendix-I” confining the updating to employees who retired from 01.01.1986 to 31.10.1987 was later
amended in 2002 as “Basic pension and additional pension, wherever applicable shall be updated as per
the formulae given in Appendix -1” making the updating applicable to employees retiring on any date and
further emphatically stating that “wherever applicable shall be updated ’’ by replacing the words “ will be
updated”. Accordingly, the non- updating of pension in Public Sector Banks is in derogation of this regulation 35
(1).
9. Regulations 56 termed as residuary regulation reading as “In case of doubt in the matter of application of these
regulations, regard may be had to the corresponding provisions of Central Civil Services Rules, 1972 or Central
Civil Services (Commutation of Pension) Rules, 1981 applicable for Central Government employees with such
exceptions and modifications as the Bank, with the previous sanction of the Central Government, may from time to
time, determine’ makes it mandatory that just in the same way Central Civil Pension gets updated with the
implementation of each Pay Commission, pension in Public Sector Banks also shall be updated sin tune with the
revised pay scales arising out of each Bipartite Settlement. The regulation has pervasive application on all other
regulations when any doubt arises in the matter of their applicability.
10. This Hon’ble Court has held on 01.07.2015 in Civil Appeal No.1123 of 2015 viz. State Of Rajasthan & Another
Vs. Mahendranath Sharma & Others that Pension shall not be less than 50 percent of the running pay bands
corresponding to the pre-revised scales of pay rendering the act of the respondents in not updating pension in
Public Sector Banks in gross disregard to the law laid by the Hon’ble Supreme Court. Any overt or covert
resistance from the government or banks controlled by it to updating of pension is callous disregard to the ruling of
the Apex Court in Civil Appeal No.1123 of 2015 besides being antithetical to several other rulings. 11. A copy of
this statement with Exhibits mentioned in it is also mailed to Shri. Rajesh Kumar Gautam, Advocate, Chamber No
127, Old Court Compound, Inter State Bus Terminal, Kashmir Gate, New Delhi – 110 006, the counsel of
respondents, Indian Banks’Association.

1. Application Form for family pension, duly filled in and affixed with recent passport size
photograph of the family pensioner, attested by the Branch Manager.

2. Photocopy of the death certificate of the deceased pensioner.

3. Photocopy of KYC documents of the family pensioner.

4. Life Certificate of the family pensioner.

5. Copy of Previous Pension records (like PPO, if any).

6. Birth proof of the family pensioner (if pension is to be paid to children of the deceased
employee).

7. Stamped Indemnity Form for family pensioner duly embossed with RslO/- special adhe-
sive stamp and stamp cancelled by branch head with date there on.

8. Excess Pension paid to the pensioner, if any, to be recovered and credited to LHO,
Bhubaneswar (Brcd-03980) through IBTS_Credit with responding BGL- 98751 and nar-
ration as

10. Before sending the proposal, please stop pension and mark death in HRMS.

N.B.
1. The above documents are to be verified/signed by the Branch Man-
ager/authorised branch official under Official Seal with name and
SS no.

2. Communication will be sent to branch through E-mail to comply with


deficiency, if any found during the processing of family pension.
The pension proposal will be returned to branch, if no response is
received within 2 weeks.

3. Family Pension processing is done in HRMS from the 1st to 20th of


every month. Hence, the proposal should reach us before the 15th so
as to enable us to finish the processing in time for payment on the
pension date, i.e. 27th.

3) Type the Captcha field correctly
4) Type your Password
PASSWORD RESET PROCESS : If you have forgotten your password, click on reset password
link provided on the Login screen, just below the Captcha field. Type your User ID and Date of Birth
on next screen. Give OTP option through Mobile or E-mail. Usually E-mail option provides quicker
OTP than mobile option. Then feed the OTP on the next screen to get the reset password in your
mobile/email. Create your password after making 1st login with the reset password provided through
e-mail.

IMPORTANT
If your mobile number and Email ID is not updated in HRMS, you will not be able to reset the
password in the above process. Please, contact the PPG Department, LHO. Password reset re-
quest to be e-mailed to [email protected] from your registered E-mail ID only. Request
letter signed by the pensioner is also acceptable.

9. IDF/Form 12BB (Submission of Investment Declaration Form between 1st to 20th of every month)
10. Emergency Hospital Help (View empanelled hospitals for cashless treatment under REMBS)
11. Organ Donation (to volunteer for organ donation)
12. Apply consent u/s 194(P) (To exercise option for conditional relaxation to senior citizens above the
age of 75 years from filing the Income-tax return)

Dear all Esteemed SB Retirees,”This message is regarding claims that are received by the TPA.
While submitting a claim please ensure that all documents relevant to the stay in hospital( Including
Pre & Post) are attached along with the claim. Proper documentation enables the TPA to process
the claim immediately.
1. All claims should be submitted within 30days from the date of discharge. Post hospitalization
bills can be submitted later as additional claim.
2. All Reimbursement claims should be intimated to VIDAL at the time of admission, and obtain
Claim intimation number which has to be quoted above the Claim form (Part A) at the time of
submission.
3. All claims should have either a Cancelled Cheque / Passbook front page/ Bank statement
with NEFT & IFSC details.
4. All investigation reports should be in originals -Lab, X-ray, Scan including films. (The duplicate
copy of the same can be obtained from the hospital.)
5. For hospitalization claims fill SBI General- Part A and Part B forms. Forms can be availed
from zonal executives of TPA posted at respective AO’s. (All Zonal executives phone number
