This Deed of Transfer of Rights with Assumption of Mortgage made and executed by and
among:
RICKY BULAGAGAO ROYALES, of legal age, Filipino citizen, single, and a resident of Brgy.
Cabuco, Trece Martires City, Cavite, Philippines, hereinafter referred to as the
Transferor/Vendor;
-and-
ARJAY E. DELA PAZ, of legal age, Filipino citizen, married to ANNABEL K. DELA PAZ, of
legal age, Filipino citizen, and a resident of Blk. 20 Lot 16 Bell Flower St., Capitol Hills executive
SUbd., Brgy. Lapidario, Trece Martires City, Cavite, Philippines, hereinafter referred to as the
Transferee/Vendee;
Witnesseth:
public instrument under the Notarial Registry of Atty. Amely Dait-Agmata [ Doc. No.: 286,
Page No.: 59, Book No.: 10, Series of: 2018) concerning a house and lot / residential unit
with improvements erected / existing thereon, situated at Lot 59 Blk. 38 Capitol Hills Executive
Subd., Ph. 2, Brgy. Lapidario, Trece Martires City, Cavite under Transfer Certificate of Title No.
T-22127 under the name of Marcins Agricultural Dev’t Corp., and is more specified as follows:
Technical Description
“A parcel of land (Lot 59, Blk. 38) of the cons./subd. Plan, Pcs-04-011239, being a
portion of the cons. of Lots 26 & 46 B1, All lots Blks 3 to 11’ 13 to 24; 26 to 27; 37 to 44; 47,
Rd. Lots 1 to 20; 22 to 31; 33, 41, 42 & Alley 1, all of Pcs-042122-008951, situated in the Bo.
of Lapidario, Mun. of Trece Martires, Prov. Of Cavite, Is. of Luzon. Bounded on xxxxx
containing an area of THIRTY NINE (39 SQ. METERS.”
NOW THEREFORE for and in consideration of One Hundred Fifteen Thousand Pesos
(₱ 115,000.00), Philippine Currency receipt of which is hereby acknowledged by the
TRANSFEROR/SELLER said TRANSFEROR/SELLER, do hereby SELL, TRANSFER and CONVEY by
way of this Deed of Transfer of Rights with Assumption Of Mortgage, unto the said
TRANSFEREE/BUYER, to her heir, assigns and successors in interest, all of their rights, interest,
obligation and participation, over house and lot / residential unit with improvements erected
thereon, specified in the following terms and conditions.
1. That the total contract is amounting to One Hundred Fifteen Thousand Pesos
(₱ 115,000.00), Philippine Currency;
2. That the Transferee/Buyer will give and amount of Fifty Thousand Pesos (₱ 50,000.00),
Philippine Currency represent as down payment;
4. That in the event the transferee/buyer was not able to pay the monthly amortization of the
subject property, the transferee/buyer will surrender to the transferor/seller the original
copies of the subject property, and the transferor/seller will return the amount of One
Hundred Fifteen Thousand Pesos (₱ 115,000.00), Philippine Currency to the
transferee/buyer;
PROVIDED, that the Buyer will assume the obligations and remaining balance of the
property subject hereof until fully - paid, in favor of Home Development Mutual (Pag -IBIG)
Fund. The Buyer likewise, undertake to comply with all the conditions related to the
acquisition of the property that will be imposed by the Home Development Mutual (Pag -
IBIG) Fund.

AND OTHER WRITINGS OF WHATEVER NATURE OR KIND, TO THE OFFICES ABOVE-
SPECIFIED AND WITH ANY AND ALL THIRD PERSONS, ENTITIES OR CONCERNS, UPON
TERMS AND CONDITIONS ACCEPTABLE TO MY SAID ATTORNEY;

WAIVER OF RIGHTS
I, RICKY BULAGAGAO ROYALES, of legal age, Filipino citizen, single, and a resident of
Brgy. Cabuco, Trece Martires City, Cavite, Philippines, after having been duly sworn on oath in
accordance with law hereby voluntarily depose and say:
1. That I am the lawful possessor / vendee (by virtue of a Deed of Conditional Sale, dated
April 18, 2018 with the Pag-IBIG Fund as Seller and made a public instrument under
the Notarial Registry of Atty. Amely Dait-Agmata [ Doc. No.: 286, Page No.: 59, Book
No.: 10, Series of: 2018) concerning a house and lot / residential unit with
improvements erected / existing thereon, situated at Lot 59 Blk. 38 Capitol Hills
Executive Subd., Ph. 2, Brgy. Lapidario, Trece Martires City, Cavite under Transfer
Certificate of Title No. T-22127 under the name of Marcins Agricultural
Dev’t Corp.;
3. Provided that the said ARJAY E. DELA PAZ has undertaken to assume all existing
obligations and balance concerning the property subject hereof, including payment of
its monthly amortizations until fully-paid, in favor of Home Development Mutual
Fund (also known as Pag-IBIG);
4. That I am executing this affidavit to attest of the foregoing facts and for whatever legal
purpose it may suit best.
