‘On August 21, 2006 at 1201 hours, | heard dispatch broadcast and unknown injury accident on Tahoe Boulevard
near the Wild Flower cafe. | responded to the scene which was in front of 866 Tahoe Boulevard in the westbound
lane.
I saw a white 2007 Dodge truck with Nevada License Plate 292PTL in the westbound lane. The truck had been
rearended by a white 1990 Jeep Cherokee with Nevada License Plate 961TRP.
Paramedics arrived on scene and provided medical attention to the driver of the truck. I went to the Jeep and
spoke with Calen Michael Evans, identified by his Nevada Driver's License. Evans told me that he was driving the
Jeep and that he was the sole occupant of the vehicle.
Evans was sitting in the driver's seat of the Jeep. | asked Evans if he was injured. Evans said that he was not
injured. | started Evans on a statement about what happened. The accident was investigated by the Nevada
Highway Patrol, see Trooper Rivas’ #163 report 0608210721, for further details on the accident
Ihanded Evans the statement form and | could smell the odor of Marijuana coming from his vehicle. | asked
Evans if he had used any marijuana recently. Evans said that he had smoked marijuana the night before. | told
Evans that | could smell the marijuana and asked him if he had any marijuana in his vehicle. Evans said that he
did have marijuana in the vehicle and offered to show me where it was.
My primary concern was whether or not Evans was currently under the influence of Marijuana. | asked Evans to
step in front of his vehicle onto the sidewalk so | could check Evans for impairment. | am a NHTSA certified Drug
Recognition Expert. | checked Evans for signs and symptoms of recent marijuana use. Evans had clear eyes, no
eyelid flutter, and no oral signs of ingestion. Once | determined that Evans was not impaired | asked him about
‘the marijuana in his vehicle.
| asked Evans for permission to search his vehicle for drugs. Evans gave me consent and offered to show me
exactly where the marijuana was. | asked Evans to just tell me where the marijuana was because | did not want
Evans going into the vehicle in case there were any weapons. Evans told me that the marijuana was in the center
console.
I began to search the vehiole with Sergeant Devine present and Evans standing at the front of his vehicle. |
looked in the center console and found a clear plastic bag with marijuana inside. | also found a multicolored glass
pipe with burnt marijuana residue.
| continued the search of Evans’ vehicle and found a black backpack in the passenger side front seat. | asked
Evans who the backpack belonged to. Evans said that he didn't know whose it was. The backpack smelled so
strongly of marijuana that | had to pull my head back outside of the vehicle to catch some fresh air.
opened the backpack starting with the front small pocket. | found a fokded up wad of cash. | continued looking
through the pockets and found two more folded up wads of cash and 3 more plastic bags of marijuana. | also
found a small black scale, an empty prescription bottle of Hydrocodone/APAP 10/500, and miscellaneous clothes
with marijuana debris from a whole in one of the bags of marijuana.
Jasked Evans if he wanted to write a statement about the backpack and its contents, to document where and
when he found it since he said that it was not his. Evans elected to make a statement. Evans said that he found
the backpack at a concert at the Harvey's outdoor amphitheater on August 20, 2008. Evans found it near the
restrooms. Evans states that he gave me permission to search his vehicle and that the backpack contained
"weed"
asked Evans if he had looked inside the backpack when he found it. Evans said that he had looked inside it and
knew that it contained marijuana.

arrested Evans for Possession of Marijuana, Possession of Marijuana For Sale, and Possession of Drug
Paraphernalia. I took possession of the backpack and its contents, the contraband I found in the console, and an
additional $11.00 | found in the console. Evans had a black Motorola cell phone in his right cargo pocket.
Sergeant Devine prepared and released the vehicle to Alpine Tow.
| inventoried and booked, the items | secured, into Evidence locker #13. | weighed and packaged the marijuana
and other items and placed them under the following Control numbers.
C-68712:
One clear plastic bag of 18.5 grams Gross Weight of Marijuana.
One clear plastic bag of 14 grams Gross Weight of Marijuana.
One clear plastic bag of 16 grams Gross Weight of Marijuana.
One clear plastic bag of 127.5 grams Gross Weight of Marijuana.
Total Gross Weight = 176 grams.
C-68713:
One mutticolored glass pipe with burnt marijuana residue.
(One black Motorola cell phone and charger.
(One black USN-250 scale with marijuana residue.
(One empty prescription bottle of Hydrocodone/APAP 10/500.
(One black backpack with miscellaneous clothes and marijuana debris.

$4637.00 in various denominations of cash. Double counted by myself and Deputy Longshore.
While | packaged the evidence the cell phone continuously rang. | also noticed a text message that was asking
Evans to supply the texter with an “eighth” until “wend” and signed by norris.
| gave Evans a property receipt for the items that | confiscated,
I completed a form S-390 Request for Forfeiture for the money confiscated.
Evans was transported to the Washoe County Jail, by the Incline Village Constable, without incident.
