Jojo Buena Reporting:
Following the 1987 Phil Constitution,
the Philippine government is presidential in
form for it adheres to the Doctrine of
Separation of Powers. Under this Doctrine
the three fundamental powers of the
government, namely, the executive power,
legislative power and the judicial power, are
separated from each other and are distributed

Executive department. It is empowered to
administer or implement the laws. The power is
vested to the President of the Philippines.

2. Legislative department, known as Congress.


It has two chambers, the lower house known as
the House of Representation and the upper
house, known as Senate. It’s fundamental power
is to make, amend and repeal laws.
3. Judiciary department. It is empowered to
interpret and apply the law enacted by Congress.
The power is vested in the Supreme Court and
its lower Courts.

The three branches of the government are of
co-equal and coordinate powers. The officers entrusted
with each of these powers are not permitted to
encroach upon the powers confided to other.
The doctrine of the Separation of Powers is
motivated by the belief that arbitrary rule will result if
the same person or body is to exercise all of the
powers of government. With this doctrine, tyranny in
our country is prevented.
Example:
Our Constitution has temporarily suspends death
penalty. In case the people want to restore it, it’s the
Congress who has the power to amend such provision.
The amendment shall be submitted to the
people for their rejection or approval thru plebiscite.
