MEMORANDUM OF AGREEMENT

KNOWN ALL PERSONS BY THESE PRESENTS

This Memorandum of Agreement (MOA) is entered into this _____ day of


_____________ 20_____ in _________________, Philippines by and between:

The CAMALANDA-AN NATIONAL HIGH SCHOOL, an


educational institution duly organized and existing under the
Department of Education (DepEd) with office address at
Barangay Camalanda-an, Cauayan, Negros Occidental,
represented by its School Principal, MR. RICKY A. DELA CRUZ,
herein referred to as “FIRST PARTY;”

-and-

The BARANGAY CAMALANDA-AN, duly organized and existing


under the Local Government Unit (LGU) of the Municipality of
Cauayan, with office address at Barangay Camalanda-an,
Cauayan, Negros Occidental represented by the Punong
Barangay, HON. JEMUEL G. DULLA SR. hereinafter referred to
as SECOND PARTY.

WITNESSETH; that,

WHEREAS, on March 8, 2020, the President- His Excellency Rodrigo Roa Duterte,
through Proclamation No. 922 titled, “Declaring a State of Public Health
Emergency Throughout the Philippines,” in view of the COVID-19 public health
situation;

WHEREAS, Section 2 of Proclamation No. 922, states that “all government


agencies and LGUs are hereby enjoined to render full assistance and cooperation
and mobilize the necessary resources to undertake critical, urgent, and appropriate
response and measures in a timely manner to curtail and eliminate the COVID-19
threat;”

WHEREAS, the Department of Education (DepEd) created mechanism for


learning continuity despite the health crises brought about by the pandemic
through DepEd Order No. 12, s. 2020 titled, “Adoption of the Basic Education
Learning Continuity Plan for School Year 2020-2021 in the Light of the COVID-19
Public Health Emergency;”

WHEREAS, the occurrence of the pandemic has affected the face-to-face learning
engagement of both students and teachers that compelled educational institutions
to adopt distance learning modalities namely, modular distance learning, online
distance learning, blended learning, as a new-form of instruction to students.

WHEREAS, the Department of Education (DepEd) issued an Office Order (OO-


OSEC-2022-003) titled, “Interim Guidelines on the Expansion of Limited Face-to-
Face Classes” for school year 2021-2022.
WHEREAS, the FIRST PARTY, in the exercises of its corporate social
responsibility promotes and supports the Department of Education Learning
Continuity Plan and finds existing program of Camalanda-an National High School
in line with such purpose as well as its own student development program and
school enhancement facilities aligned with the guidelines and standards set forth
by the Department of Health (DOH), Department of Education (DepEd), among
other entities concerned.

WHEREAS, pursuant to the FIRT PARTY objective for the implementation of face-
to-face learning modality for this incoming school year 2022-2023, the FIRST
PARTY has expressed its willingness to partner with the BARANGAY OFFICIALS
OF CAMALANDA-AN.

NOW, THEREFORE, for and in consideration of the foregoing premises and of the
terms hereinafter provided, the parties hereby agree to execute this Memorandum
of Agreement.

ARTICLE I
SCOPE AND DURATION OF THE AGREEMENT

Section 1.1 All the activities, including the pre-implementation, implementation


and post implementation of the face-to-face learning modality for school year 2022-
2023.

Section 1.2 This Memorandum of Agreement will last until successful operation
for face-to-face learning modality will be granted by the Department of Education
through the Division of Negros Occidental for school year 2022-2023.

ARTICLE II
OBLIGATIONS OF THE PARTIES

Section 2.1 The FIRST PARTY will be responsible for the following:

a. Maintain harmonious relationship with the Barangay Officials of


Camalanda-an imbued with highest respect, integrity, and
professionalism.

b. Submit all the required documents for the implementation of


face-to-face learning modality pursuant to the heath standards
set forth by the Department of Education (DepEd), Department
of Health (DOH) and other authorized government agencies.

c. Ensure that well-being of learners, teaching and non-teaching


personnel of the school will be protected against from the
potential transmission of COVID-19.

d. Ensure that all funds, donations, and any monetary form given
by the Barangay Officials of Barangay Camalanda-an will be
spent according to the needs of the school for the
implementation of face-to-face learning modality.

e. Coordinate with the Barangay Officials in times of emergencies


and any other health related problems that may arise before,
during, and after the implementation of face-to-face learning
modality.

f. Coordinate with the Barangay Health Workers (BHW) and


Barangay Midwife in terms of deworming activities,
immunization, vaccination, and any health related activities
when the assistance of the teachers are needed.

g. Extend assistance or help to the Barangay Officials when


needed.

h. Establish mechanism in helping the Barangay Camalanda-an in


educating students related to COVID-19 awareness and its
effects by means of conducting symposia, lectures, among
others.

i. Disclose any conflict of interest (possible or actual) that may


arise during the pre-implementation, implementation, and post
implementation of the face-to-face learning.

Section 2.2 The SECOND PARTY will be responsible for the following:

a. Maintain harmonious relationship with the teachers and


principal imbued with highest respect, integrity, and
professionalism.

b. Support to the needs of the school whenever there is a need of


participation of the Barangay for the smooth implementation of
face-to-face learning pursuant to the heath standards set forth
by the Department of Education (DepEd), Department of Health
(DOH) and other authorized government agencies.

c. Establish mechanism to monitor the well-being of learners,


teaching and non-teaching personnel of Camalanda-an National
High School will be protected against from the potential
transmission of COVID-19.

d. Establish mechanism to monitor the funds, donations, and any


monetary form given by the Barangay Officials of Barangay
Camalanda-an and such will be properly utilized pursuant to the
needs of the school for the implementation of face-to-face
learning modality.

e. Establish mechanism to respond to the needs of Camalanda-an


National High School community whenever emergencies might
happen especially before, during, and after the implementation
of face-to-face learning modality.

f. Establish mechanism to inform Camalanda-an National High


School community whenever there are health related programs
that the Barangay is implementing such as deworming activities,
immunization, vaccination, and any health related activities.
g. Extend assistance or help to the Camalanda-an National High
School community when needed.

h. Establish mechanism in supporting the school’s symposia,


lectures, or seminars relative to the COVID-19 awareness and
health education.

i. Disclose any conflict of interest (possible or actual) that may


arise during the pre-implementation, implementation, and post
implementation of the face-to-face learning.

j. Monitor progress of the Camalanda-an National High School


community implementation of face-to-face learning modality for
school year 2022-2023.

ARTICLE III
EFFECTIVITY AND TERMINATION

The MOA will take effect on the date of signature of both the PARTIES and
will end up until successful operation of the face-to-face learning for school year
2022-2023. The expected date of termination of this memorandum of agreement
is July 30, 2023.

IN WITNESS WHEREOF, the parties have affixed their signatures on
