Rodulfo M. Malaca, president of Stock Care Cargo and Warehousing, Inc., signed an affidavit undertaking the following: 1) To secure and submit a surety/performance bond for Pepsi Cola Product Philippines, Inc. as required by their contract. 2) Failure to submit the bond would cause termination of the contract. 3) To renew the surety bond yearly as required by the contract and provide copies to Pepsi Cola. 4) Stock Care Cargo would be responsible for any damages if they fail to secure or renew the bond. AFFIDAVIT OF UNDERTAKING

I, RODULFO M. MALACA, of legal age, Filipino, and with office address at Lot
2A Quirino Highway, Brgy. Sto. Cristo, District 1, San Jose Del Monte, Bulacan after
having been duly sworn to in accordance with law, hereby voluntarily depose and state
that:

1. I am the President of Stock Care Cargo and Warehousing, Inc.


(hereinafter referred to as “SCCWI”) , an entity duly organized and existing
under the laws of the Republic of the Philippines;

2. I hereby undertake to secure and submit the surety/ performance


bond in the amount of ______________________, as required in the contract of
service executed between Pepsi Cola Product Philippines, Inc. (PCPPI) and
SCCWI;

3. I hereby undertake that failure to secure and submit the surety/


performance bond after the execution of the contract of service shall cause the
termination of the said contract;

4. I hereby undertake to renew yearly the surety bond within the


appropriate period pursuant to the above-mentioned contract and to provide
PCPPI copies thereof;

5. Should SCCWI fail to secure or renew the surety/ performance bond,


all damages or loss that shall occur within the period not covered by any
surety/ performance bond shall be for the sole account of SCCWI;

6. I am executing this affidavit to attest to the truth of the foregoing and


for the purpose of complying with the requirements of the contract of service
with PCPPI and applicable laws, rules and regulations.
