Memorandum Circular

2. RATIONALE:
A review of the disciplinary policies, the Chief/Head of Office is one among the
enumerated disciplinary authorities who can hear and decide administrative cases
(Citizen’s Complaint and breach of Internal Discipline) with imposable penalty of
withholding of admonition, reprimand, privileges, restriction to specified limits,
suspension or forfeiture of salary or any combination thereof, for a period not exceeding
15 days.
3. MISSION:
The PNP shall modify and institutionalize the Delinquency Report System to
every unit/office in order to enhance the disciplinary authority of the Chief/Head of Office
and to facilitate the disposition of minor offenses as defined in NMC No. 2007-001 dated
March 6, 2007.

b) All ADMO/RPHRDD/RPMD/ARMD shall present in matrix form all
reported offenders, the facts surrounding the minor infractions and the submitted
explanation with evidence if warranted;
c) Any reports or complaints filed by any person regarding minor
infraction committed by PNP personnel shall be recorded by the admin office;
d) The Chief Clerk of ADMO/RPHRDD/RPMD/ARMD shall issue DR
form which contains the date, time and specific infractions/minor offenses committed
and requires the offender to write therein in the space provided his/her explanation
which shall be submitted within 24 hours from notice; and
e) All accomplished DR forms within the week shall be consolidated
and be presented during the next scheduled Staff Conference.
3) Execution Phase
b. Tasks
1) DPRM
- Shall be the OPR of this MC on Delinquency Report System;
- Shall draft disseminate and monitor the implementation of this
MC on Delinquency Report System;
- Shall establish database through PNP Personnel Clearance
System of all reported and sanctioned delinquent personnel;
and
- Perform other task as directed.

2) D-Staff/P-Staff/PROs/NSUs
- Shall implement the DR System;
- Shall include in the Staff Conference the DR System;
- Shall submit reports to DPRM on the sanctioned delinquent
personnel; and
- Perform other task as directed.
6. COORDINATING INSTRUCTIONS:
a. Demerit System – The infractions and their corresponding demerits are listed
hereunder:
• The maximum allowable demerits shall be fifteen (15) demerits per month or 90 demerits per
semester. One demerit in excess of the allowable number shall be equivalent to one (1) hour of
community service.

c. All personnel with exceeding 20 demerits per week shall be subjected to
Pre-Charge Evaluation and Summary Hearing Proceedings in accordance with the
NMC 2007-001 for uniformed personnel and RRACCS for non-uniformed personnel.
d. All records of minor infractions of PNP personnel shall be recorded in the
PNP Personnel Clearance System which shall be reflected in the PAIS record.
7. RESCISSION:
All existing PNP directives and other issuances which are contrary to or
inconsistent with this directive are hereby rescinded or modified accordingly.
8. SEPARABILITY CLAUSE:
Any portion of this Memorandum Circular inconsistent with the organic law or
declared unconstitutional shall not affect the validity of other provisions.
9. EFFECTIVITY:
This circular shall take effect upon the filing of a copy hereof with the Office of
National Administrative Register (ONAR), UP Law Center pursuant to Sections 3 and 4
of the Administrative Code of 1987.
