At the time of our arrival at the Peoples’ Hall of Brgy. Busay, the Barangay Chairman was not
around. However, we were welcomed by the barangay’s lupon member Mrs. Gelanie Legaspi
and we asked her if we could conduct a recorded and documented interview regarding the roles
and function of Lupon members, and she gladly agreed to it. Here are the details and answers
that she provided from the guide questions that were given to her at during the time of the
interview that was also recorded via a phone voice recorder.

1.Who is the Lupong Tagapamayapa Chairman?

The Lupong Tagapamayapa Chairman should be the Barangay Chairman himself.

2. Who are the members of the Lupon?

Members of the Lupon she mentioned are usually former kagawads, religious personalities such
as pastors and she also added that respected members of the community. But she said that
majority members of the Lupon are fomer Kagawads and Purok Presidents and Pastors.

3.Do the members of the said Lupon carry specific qualifications?

There are no specific qualifications to be a lupon member and as long as you know how to
mediate and de-escalate barangay related disputes you could be a member of the lupon. And if
you know how to make people settle their disputes to one another and have them reconciled, then
you are already qualified she added.

4. What are the duties and responsibilities of the individual members of the Lupon?
She mentioned that for example if there would be a case it would simply just be mediation and if
both parties could just settle thereon and that there would be no need to take the situation up in
court

5. What is the role of the Katarungang Pambarangay?

She emphasized that the Lupon and the role of Katarungang Pambarangay are just the same. That
both of them are task for the mediation and dispute resolution within their area of jurisdiction.

6. What are the protocol/measures in resolving disputes within the Barangay level?

If the cases involved are either Violence against Women and Children, she said that there is no
need to issue a summon against the offender and have the offender apprehended by the Tanods
with the coordination from the Bago City police station. But if the case is Barangay related (such
as disputes within their community), they will be issued a summon letter and shall report to the
barangay hall within 3 days that both the complainant and the subject shall face in front of the 3
Lupong members and the Barangay Chairman himself shall be present during the hearing. If on
the first hearing that both parties could not reach a settlement, another hearing shall be scheduled
for the next week. And after the next session that there still would be no settlement reached from
both parties and the case will reach more than 45 days. It would be endorsed to her, the Lupong
Tagapamayapa and that would be the time that she would issue a certificate to file action if the
complainant wishes to pursue the matter into court.

7. What are the most common handled disputes by barangay.

The most common cases she handled on her end are mostly unpaid debts and fist fights she said.
On physical altercations, both parties usually just settle the matter monetarily. However, on cases
involving unsettled loans commonly more than 10,000 Pesos; the complainants usually asks if
they could tell the offending party to pay their accounts and she jokingly added that sometimes
they are also part time collectors for the complainants because most offending parties are just
very difficult to talk to when it comes to the debt that they owe.

8. What is the most common unresolved dispute case?

She said that Land-Related disputes are the most rampant cases she handles that are commonly
undisputable. Because most of these cases are Family-Related. Land disputes she mentioned
have a BARC (Barangay Agrarian Reform Chairman) tasked to handle cases relating to Land.
And on occasion, if the Barangay chairman would like to handle the dispute related to agrarian
reform; the BARC should be present at all hearings she added.

9. How are you going to handle dispute cases which both parties could not be settled?

If both parties could not be settled, she said that would be the time that she will recommend to
the complainant to create a certificate to file action since she emphasized that they are not a court
and if the case continues to be unsettled during the timeframe given (45 days) she will definitely
issue one to the complainant said Mrs. Legaspi.

10. Does it happen in your Barangay that has an incident wherein the complaint asks for
Certificate to File Action?

Cases that are already unsettled for too long and involves a large sum of money are the usual
cases in where complainants ask her for certificate to file action since most of these complainants
want to take the matter into court and the sum of money involved (More than Php 50,000)
usually could not be settled in the barangay level.

She also said to us that if we have more questions that we are welcome to come back to their
barangay hall. She was very welcoming and enthusiastic in answering all of our questions during
