ETHICO-LEGAL ISSUES AFFECTING DISASTER

NURSING MANAGEMENT

ETHICAL PRINCIPLES IN NURSING

The two major classifications of ethical principles and ethical


thought are:

Deontology
Utilitarianism
THE ETHICAL PRINCIPLES THAT NURSES MUST ADHERE TO ARE:

 Justice is fairness.
 Beneficence is doing good
 Non-maleficence is doing no harm
 Accountability is accepting responsibility for one's own
actions.
 Fidelity is keeping one's promises.
 Autonomy and patient self-determination are upheld
 Veracity is being completely truthful with patients
RA 10121: PHILIPPINE DISASTER RISK REDUCTION AND
MANAGEMENT (DRRM) ACT OF 2010

1. The Act shifted the policy environment and the way the country deals
with disasters from mere response to preparedness.
2. RA 10121 provides a comprehensive, all-hazard, multi-sectoral, inter-
agency, and community based approach to disaster risk management
through the formulation of the National Disaster Risk Management
Framework.
3. A LAW THAT REQUIRES THE COUNTRY ‘S GOVERNMENT AND ITS
CITIZENS TO BE PREPARED FOR DISASTER. Principle of impartiality
UNITED NATIONS’(UN’S) DECLARATION OF HUMAN RIGHTS IN
1948

 Human rights in the Philippines are protected by the Constitution of the


Philippines, to make sure that persons in the Philippines are able to live
peacefully and with dignity, safe from the abuse of any individuals or
institutions, including the state.
 The concept and practice of human rights within the Philippines is
defined by Article III of the Philippine Constitution, as well as the United
Nations' International Bill of Human Rights, to which the Philippines is a
signatory.
RA 9372: HUMAN SECURITY ACT OF 2007

 The Human Security Act (HSA) of 2007 is an act to secure the


State and to protect the people from acts of “Terrorism”.
 It condemns terrorism as inimical and dangerous to national
security and to the welfare of the people, thereby making
terrorism a crime against the Filipino people, Humanity and the
Law of the nations.
RA10168: TERRORISM FINANCING PREVENTION AND SUPPRESSION
ACT OF 2012

 Otherwise known as "The Terrorism Financing Prevention and


Suppression Act of 2012", hereafter referred to as the "TF Suppression
Act."
 Declaration of Policy. - It is the policy of the State to protect life, liberty,
and property from acts of terrorism and to condemn terrorism and
those who support and finance it and to recognize it as inimical and
dangerous to national security and the welfare of the people, and to
make the financing of terrorism a crime against the Filipino people,
against humanity, and against the law of nations.
RA 10871: BLS TRAINING IN SCHOOLS ACT

 AN ACT REQUIRING BASIC EDUCATION STUDENTS TO UNDERGO


AGEAPPROPRIATE BASIC LIFE SUPPORT TRAINING
 Section 2. Declaration of Policy. - Pursuant to Section 15, Article II of the 1987
Philippine Constitution, it is hereby declared the policy of the State to protect and
promote the right to health of the people and instill health consciousness among
them. Pursuant thereto, the State shall ensure that able-bodied citizens are equipped
with the necessary knowledge and basic skills to respond to certain health
emergencies.
 Section 3. Basic Life Support for Basic Education Students. - It shall be the duty of all
public and private basic education schools operating nationwide to provide their
students with basic life support training through the use of psychomotor training in
an age-appropriate manner.
 The instruction shall include programs which have been developed by
the Philippine Heart Association (PHA) or Philippine Red Cross (PRC)
using nationally-recognized, evidence-based guidelines for emergency
cardiovascular care, and psychomotor training, to support the
instruction. As far as practicable, basic education schools shall
incorporate basic life support training as part of the schools'
comprehensive health and physical education curriculum. As used in this
Act, psychomotor training refers to hands-on practice to support
cognitive learning.
STANDARDS OF CARE DURING DISASTER

 It refers to the level of attentiveness and care that a certain person owes
to another person under the circumstances. This generally refers to
professionals, such as doctors, paramedics, lawyers, and others.
 A professional standard of care applies to anyone in a professional role
offering services to a client, patient, or customer. Professionals govern
themselves by a professional standard of care that, if violated, can subject
them to lawsuits for malpractice.
CODE OF CONDUCT FOR INTERNATIONAL RED CROSS AND RED
CRESCENT MOVEMENT AND NGOS IN DISASTER RELIEF IN 1992 (STEERING
COMMITTEE FOR HUMANITARIAN RESPONSE

 Agreed upon by 7 International Humanitarian Agencies: IFRC, ICRC, Caritas


International, International Save the Children, Lutheran World Federation, Oxfam and
World Council of Churches;
 Seeks to guard the standards of behavior of International Humanitarian Agency and
Humanitarian Aid workers as well as to maintain the high standards of independence,
effectiveness and impact to humanitarian activities;
 Adopted by Federation through General Assembly and The Council of Delegates
(Birmingham, 1993) and International Conference (Geneva, 1995); 4. Consist of 10
(ten) fundamental principles related to Humanitarian Relief Operation and 3 (three)
Annex that regulatory with governments of affected countries, donor governments
and intergovernmental organizations
RED CROSS PRINCIPLES OF HUMANITY
IATF GUIDELINES (INTER AGENCY TASK FORCE FOR THE
MANAGEMENT OF EMERGING INFECTIOUS DISEASE)

 RESOLUTION NO. 134, Series of 2021, August 19, 2021 WHEREAS, Section 15
Article II of the 1987 Constitution states that the State shall protect and promote
the right to health of the people and instill health consciousness among them;
 WHEREAS, Section 2(b) of Executive Order No. 168 (s.2014) mandates the Inter-
Agency Task Force for the Management of Emerging Infectious Diseases (IATF) to
prevent and/or minimize the entry of suspected or confirmed patients with emerging
infectious diseases into the country;
 WHEREAS, the continued implementation of proactive measures and restrictions
must be put in place to slow down the surge in COVID-19 cases, stop further spread
of variants, buy time for the health system to cope, and to protect more lives;
