Fencing Law of 1979

I. AUTHORITY:
1. PNP Blotter Entry No. with subject Theft Incident with Certification To File
Action dated August 1, 2018;
2. Presidential Decree No. 1612 (Anti-Fencing Law of 1979); and
3. Standard Operating Procedures;

II. MATTERS TO BE INVESTIGATED:


4. To determine the surrounding facts and circumstances on the alleged
fencing incident that transpired at 11:00 AM of March 12, 2018 at Purok 2 Brgy Tayhi,
Tabaco City perpetrated by a certain Reymar Lungan Serrano, 21 years old, single,
jobless and a resident of aforesaid place particularly at the residence of the victim,
Melvin M. Samar, 33 years old, single, welder and a resident of same place;

III. FACTS OF THE CASE:


5. At about 6:00 PM of August 1, 2018, Mr. Melvin Samar y Marqueses, 23
y/o (DOB: Nove 26, 1993), single and a resident of P-1 Brgy Tayhi, Tabaco City, went
into this office and requested to put into record that on or about 5:00 AM of May 11,
2017, allegedly he discovered that their house was victimized by a thief that took and
carted away his Lenovo Tablet worth P2,500.00 and his brother, RichardM. Samar’s
MyPhone touchscreen cell phone worth P1,599.00.

6. According to Melvin M. Samar, at 5:00 AM of May 11, 2018 at Brgy Tayhi,


Tabaco City, he Samar was awakened and he found out that his Lenovo Tablet placed
beside his pillow was already missing including the MyPhone cellular phone of his
brother, Richard M. Samar, placed beside their television set at their living room where
they slept. Further, they went to Brgy Hall of Brgy Tayhi, Tabaco City and requested to
put into record the said incident at the Brgy Blotter Book. Moreover, on May 14, 2018,
Jhodan S. Abrera informed him that his Lenovo Tablet was taken by his taken, Remar
L. Serrano, as he saw it in the possession of the latter.
IV. DISCUSSIONS:
7. Considering the above facts and circumstances and the accounts of the
witnesses in this particular case, it clearly shows that the respondent, Reymar Lungan
Serrano, 21 years old, single, jobless and a resident of Brgy Tayhi, Tabaco City has
committed the offense charged penalized under Presidential Decree No. 1612 also
known as Anti-Fencing Law of 1979. The witnesses have never seen the respondent
took and carted away said Lenovo Tablet and MyPhone cellular phone, however,
respondent admitted to Jhodan S. Abrera, that he took the said items. Further, according
to Mr. Abrera, he only saw the said tablet in the possession of the respondent.
Furthermore, respondent has gained from the proceeds of said tablet which according to
Mr. Abrera that the former sold the said tablet and invited him to a drinking session.
Thus, according to the law:

"Fencing" is the act of any person who, with intent to gain for himself or for
another, shall buy, receive, possess, keep, acquire, conceal, sell or dispose of, or
shall buy and sell, or in any other manner deal in any article, item, object or
anything of value which he knows, or should be known to him, to have been
derived from the proceeds of the crime of robbery or theft.

Presumption of Fencing. Mere possession of any good, article, item, object, or


anything of value which has been the subject of robbery or thievery shall be
prima facie evidence of fencing.

V. CONCLUSIONS:
8. Premises considered, it is concluded that respondent, Reymar Lungan
Serrano, is probably liable for Violation of Presidential Decree No. 1612 aka Anti-
Fencing Law of 1979 as discussed above;

VI. RECOMMENDATIONS:
9. It is respectfully recommended that a case for Violation of PD 1612 be
filed against Reymar Lungan Serrano, 21 years old, single, jobless and a resident of
Brgy Tayhi, Tabaco City before the Office of the City Prosecutor for preliminary
investigation.

1979. The witnesses have never seen the respondent took and carted
away said Lenovo Tablet and MyPhone cellular phone, however,
respondent admitted to Jhodan S. Abrera, that he took the said items.
Further, according to Mr. Abrera, he only saw the said tablet in the
