Dear sir,
RE: CLAIM FOR MEDICAL COST AND REPAIR COSTS OF VEHICLE AGAINST ABU BAKAR
Reference is made to the above subject matter wherein we act for Ms Victoria Lim who
presently lives at No 9, Jalan Setapak, Shah Alam, District Selangor. We act for and on behalf
of Ms. Victoria Lim who has instructed us to demand a claim for the injury and damages she
suffered from the car-van accident happened on 1st February 2022 along the Malacca Kuala
Lumpur Highway. The van driver, Abu Bakar was involved in the accident with our client,
Ms. Victoria.
Our client was driving a Honda HRV registration number WC 354 D along the Malacca Kuala
Lumpur Highway around 6.30 p.m. Ms Victoria was driving within the speed limit on the
highway and suddenly she felt a violent crash at the back of her car. She was thrown
forward into the roadway which caused her to suffer serious injuries. Her car was badly
damaged resulting from the accident, which was caused by Mr Abu Bakar driving into her
rear.
a) The accident and collision were not caused by her negligence and it is not her
responsibility. It was caused by the van driver’s negligence for using his phone while
driving on the highway.
b) Mr Abu Bakar was not focusing on the road and he was unable to take control of his
vehicle when the van come into collide with Ms Victoria car, he was distracted and
was “travelling blind” which causes significantly large areas of the road space to
become hazardous for other road users.
c) The damage and injury suffered by Ms Victoria was resulted from the van driver’s
negligent for not paying attention while driving. If Mr Abu Bakar was paying full
attention, all would have been well.
Resulting from the accident, Ms Victoria was seriously injured and had gone through
traumatic stress and nightmares at night.
She had undergone several surgeries and therapies after being admitted at the Kuala
Lumpur General Hospital for three weeks. Being severely injured, Ms Victoria had incurred a
lot of expenses and special damages.
The expenses and losts are listed as below:
According to the list above, Mr Abu Bakar would have to compensate a sum of RM86,000.00
to our client. Our client holds you responsible for the damage and lost she suffered due to
the accident.
PLEASE TAKE NOTICE that we are instructed by our client to DEMAND of you which we
hereby do that you do make the payment of the sum of Ringgit Malaysia Eighty-Six
Thousand (RM86,000) to our client or to us as our client’s solicitors within FOURTEEN (14)
DAYS from the date of this letter. If we fail to hear from you within the 14 days, legal
proceeding would be issued against you without further notice.
In view of this, you may wish to take legal advice and we suggest you to contact a lawyer.
