BARANGAY ORDINANCE

No.02, S. of 2019

AN ORDINANCE REQUIRING ALL PERSON WHILE WITHIN BARANGAY ANNAFUNAN EAST,


TUGUEGARAO CITY TO KEEP AND MAINTAIN A CLEAN AND GREEN ENVIRONMENT

BE IT ENACTED by the Sangguniang Barangay that:

Section 1. This Ordinance shall be known and cited as the “Clean and
Green Ordinance of 2019.”

Section 2. All persons whether permanent or temporary residents,


including transients or passing through, while within the territorial
jurisdiction of Barangay Annafunan East, Tuguegarao City are hereby
required to maintain cleanliness in their surroundings and to keep a clean
and green environment;

Section 3. All residents and owners of properties located within this


jurisdiction, whether actually residing threat or otherwise shall be
responsible in maintaining the cleanliness of at least up to the middle of
the road or alleys surrounding their premises or properties, to the effect
that the said space shall be free and clear of any garbage, litter, trash,
refuse waste, rubbish, debris and any other similar kind of materials,
items or articles;

Section 4. All persons are hereby prohibited from littering, throwing or


dumping any garbage, refuse, waste, rubbish, debris and others similar kind
of materials, items or articles alongside any road, tract or open space
within the territorial jurisdiction of Barangay Annafunan East, Tuguegarao
City not otherwise designated for the purpose;

Section 5. All persons and/or owners of properties within the


territorial jurisdiction of Barangay Annafunan East, Tuguegarao City are
hereby required to have a waste segregation containers and plant trees and
or other plants where there are available spaces within their premises and
immediate surroundings.

Section 6. The Punong Barangay shall cause the cleaning of dirty or


uncleaned surroundings or planting of trees or other plants as contemplated
in Section 5 hereof, and the cost of such cleaning of planting of plants or
trees, as case may be, shall be charge to the owners of properties
responsible thereof.

Section 7. In addition to fines imposed in Section 8 hereunder, property


owners who refuse to pay the aforesaid charges for the cleaning of their
surroundings or for the planting of trees or other plants within their
areas of responsibility, shall be charged by the Sangguniang Barangay,
through a Resolution, with an appropriate case in Court to include
attachment of the property involved;

Section 8. In addition to sanctions that may be imposed by a court of


competent jurisdiction, persons found violating any provisions of the
Ordinance shall be liable to fines as follows:

First Offense ------- fine of P 100.00


Second Offense ------- fine of P 200.00
Third Offense ------- fine of P 500.00

Section 9. Compromise Settlement- Punong Barangay is hereby authorized


to enter into an “extrajudicial” or out of court settlement of any offence
involving violations of this Ordinance Subject, hoowever, to the condition
that the offender/s shall perform community service work under the
supervision

the fine at the rate of four (4) hour community service work for every One
Hundred (P100.00) Pesos fine.

Section 10. The purpose of this Ordinance, members of the Barangay


Tanod, or any other concerned citizens, are hereby authorized to apprehend
and turn-over to proper authorities any person violating in their presence
any provision of this Ordinance.

Section 11. If for any reason, any section or part of this Ordinance is
declared not valid by a Court of competent jurisdiction or suspended or
revoked by the Sangguniang Panlungsod, such judgment shall not affect or
impair the remaining sections or parts thereof which shall remain or
continue to remain to be in full force and effect.

Section 12. All barangay ordinances, rules and regulations, or parts


thereof, in conflict with or inconsistent with any provision of this
Ordinance, are hereby repealed, amended or modified accordingly.

Section 13. Effectivity- This Ordinance shall take effect immediately


upon approvaland after posting in at least three conspicuous places in the
Barangay.

ENACTED and APPROVED by the Sangguniang Barangay this 12 TH day of


March, 2019 at Barangay Annafunan East, Tuguegarao City.
