adult personality with reference to the psychoanalytic perspective. How does the dynamics

4. A 27-year old male complaint that other people were speaking his thoughts aloud and telling
them to others. He felt that his family members were recording his behavior on CCTV and
sound recorders and a satellite was telling them to the world. He also complained that he
could not read other people’s minds because of hormonal imbalances which had led to
disbalancesin his mind and claimed that most other people had mindreading powers. He could
not concentrate on anything, did not feel like doing any work. He had been on medication for
these symptoms since age 16. He suspected that the doctors were not treating him sincerely,
which is why he was not getting well.
5. A 28-year old woman has been unable to drive since 3 years following an accident in which
she sustained two broken ribs and two other passengers were seriously injured. She has
moved closer to work and cycles wherever she can. On the rare occasion she gets into a car or
bus, she feels immobilized whenever brakes are applied and has to frequently get out of the
car to “breathe”. She avoided hospital treatment for bronchitis last year as long as she could
because visiting the hospital reminds her of the accident. She has been on sleeping medication
since last three years.
6. A 19-year old girl came to the psychological clinic with chief complaints of restlessness,
irritability, sleeplessness, increased appetite and anxiety. Over the past 2 months, she had
become very restless and could not sit still. She would wander outside in the village fields
most of the day. If her parents tried to bring her back, she would get angry and try to run
away again. She clarified that she was not mistreated at home but did not like being indoors.
She would sometimes feel highly active and found it difficult to sleep. Even during the
psychological evaluation, the patient would take frequent breaks and go for walks. While
talking, she found it hard to stick tothe topic.When she was in the house, the patient always

1. Contract law does not recognize unfettered freedom of the parties to enter into a contract
of their choice. Critically evaluate the statement.
2. A proposal is sent by party A using speed post in Delhi to Party B in Lucknow on 13 th
December, 2020. Party B is happy to receive the proposal, accepts the same and replies
accordingly using speed post on 15th December, 2020. The speed post reaches party A on
17th December, 2020. However, in the meanwhile, Party B changes her mind about the
offer and revokes her acceptance by writing an email on 16th December, 2020. However,
due to government order, the internet services are suspended in Delhi starting 15 th
December at 00:00 hours till 00:00 hours on 18th December, 2020 and it is not possible
for Party A to access her email till such time. Analyze whether a legally binding contract
has come into existence between party A and party B as per the Indian Contract Act,
1872. If yes, determine the time and place of the contract.
3. (a) “A peppercorn does not cease to be a good consideration because it is established that
the party to the contract does not like pepper and will throw away the corn”. Explain the
statement elaborating on the rules governing consideration in the Indian Contract Act,
1872.
(b) Dr. Ram Manohar Lohiya National Law University had on 24th March, 2020 made an
advertisement that it required masks and sanitizers up to a maximum of 5000 units in the
period from 1st April, 2020 to 31st December, 2020. The deliveries were to be made if and
when a precise quantity was demanded by the University. Pursuant to this advertisement,
the University entered into an agreement with Detox Pvt. Ltd. Accordingly, Detox Pvt.
Ltd. supplied a total of 3000 units of masks and sanitizers up to the month of September,
2020 as and when the University demanded a fixed quantity. Towards the end of
September, 2020 the University wrote to Detox Pvt. Ltd that it no longer required the
items and was closing the order by completing the full and final payment of all the
supplied items. Detox Pvt. Ltd., however, believes that the University has breached its
contractual obligation by not taking the delivery of the remaining 2000 items till
December, 2020 and seeks your opinion on the same. Write a legal advice for Detox Pvt.
Ltd.
4. (a) Compare and contrast the majority opinion and minority opinion in Bhagwandas
Goverdhandas Kedia v. Girdharilal Purshottamdas & Co., AIR 1966 SC 543.
(b) During the rainy seasons when dengue was assuming epidemic proportions in Delhi,
Good Morning Co. Ltd. announced by advertisement that all those who light their popular
mosquito repellent Nightfall in their bed-room during sleeping hours will not be hit by
dengue. One condition of the use mentioned in the advertisement was that the windows of
the room during sleeping hours should remain closed. Further it was announced that if
anyone is still hit by dengue, they will be compensated with Rs. 10,000. Ms. Nazeeha
files a suit against the Co. successfully proving that she had bought Nightfall and still
contracted dengue. The Co. refuses to pay compensation and defends by saying that how
could the plaintiff prove that she always used the repellent during sleeping hours with
windows closed which is an essential condition of the contract. Decide the case
supporting your answer with reasons.
5. Explain the legal position of the agreements entered into by minors with reference to
statutory provisions and leading cases. What is role of doctrine of restitution in minors’
agreements?
6. Ms. Anam had joined Medilabs, a multinational pharmaceutical research company as the
research and development director of its vaccine development wing in December, 2015.
Her employment contract, inter alia, stipulated that she was not to leave Medilabs before
serving for 6 years. Also, the contract forbade her from joining any other competitor of
Medilabs for a period of 3 years after leaving the company. Ms. Anam left Medilabs in
December, 2020 and joined its competitor Medicana Ltd. Medilabs seeks to take legal
action against her and approaches you for advice. Prepare a legal advice for Medilabs
explaining if the stipulations in the employment contract can be enforced against Ms.
Anam.
