1 PROJECT PARTICULARITIES
1.1 Introduction About The Project
On the May 29th 2015 Afro-Tsion construction entered into a contract agreement with City
Government of Addis Ababa Saving Houses Development Enterprise for the construction of
40/60 Saving House Building Project. Work on the project commenced on June 5th, 2015
G.C.. The original date for completion of the project is June 4th 2017 with a contract period
of 730 Calendar Days.

1.2 The Parties


The construction of 40/60 Saving House Building Project comprises the following three
contractual parties:

2 Background on The Claim Cases


This Extension of time claim is prepared in order to entertain delays the contractor
encountered due to Material Shortage Such as 10cm HCB, late provision of work orders Such
as roof design, quartz color specification and lift top elevation. The above listed
circumstances being out of the control of the contractor have affected work progress in a
negative way. And since all issues are entirely not the contractor’s default, extension of the
intended completion date is rightly due.

3 Delay in The Provision Of Work Orders For Lift Top


Elevation
3.1 The Cause of the Claim

3.1.1 According to the contract G.C.C. Clause 15.2 and G.C.C. Clause 15.4, the Engineer
shall issue any change or work order required for the execution of the project in
writing. Accordingly the decision on the level of the top lift elevation requires
issuance of instruction from the Engineer.
3.1.2 The work order has been requested on 08/01/2011, 03/02/2011and 04/03/2011[See
Appendix A], but no response has been given up to now. This has caused
retardation in the project progress as described below.

3.2 The Effect

o Had the Work Order Been Issued on 29/01/2019, the construction of the lift top,
shear wall, fire escape requires (Concrete):
 Crew composition=2 mason,14 Daily laborer
 Output of 1crew for masonry work=3.75m2/day
 Total concrete to be constructed=76.77 m3
 Total number of days required for concrete work =20.47
=21days

o Had the Work Order Been Issued on 29/01/2019, the construction of the lift top,
shear wall, fire escape (Rebar):
 Crew composition=3 barbender,6Daily laborer
 Output of 1crew for masonry work=450 kg/day
 Total Rebar to be done=12626.61 kg
 Total number of days required for rebar work=28.05
=28days
o Had the Work Order Been Issued on 29/01/2019, the construction of the lift top,
shear wall, fire escape (Formwork):
 Crew composition=2 carpenter,4Daily laborer

 Output of 1crew for masonry work=22 m2/day


 Total Formwork to be done=567.09 m2
 Total number of days required for formwork =25.77
=26days
o Overall the construction of the lift top, shear wall & fire escape requires
=21+28+26=75days
3.2.1 In conclusion, the project completion date needs to be extended for75 calendar
days due to the delay in issuing the work order for top elevation of lift.

3.3 The Contractor’s Entitlement

3.3.1 Extension to the Time for Completion


a) The contractor’s entitlement to an extension to the Time for completion is contained
within the provisions of G.C.C. Clause 74.1(c),[The Contractor may request an extension
of the Intended Completion Date if he is or will be delayed in completing the contract
by…..Failure of the Engineer to provide instructions required for the execution of the
work on time”
b) Consequently the contractor is entitled to an extension of the Time for Completion to the
extent that completion of the project is delayed, which as explained in section 3.2 of this
document is 75 Calendar days.

4 Delay In The Provision Quartz Paint Color Specification


4.1 The Cause of the Claim

4.1.1 According to the contract GCC clause 15.2 and G.C.C. Clause 15.4, the Engineer
shall issue any change or work order required for the execution of the project.
4.1.2 The work order has been requested on 08/01/2011, 03/02/2011 and 04/03/2011 [See
Appendix B], but the response has not been issued up to now. This has caused
retardation in the project progress as described below.

4.2 The Effect

4.2.1 Due to the delay in issuance of instruction to start executing quartz paint contract
bill item, the Contractor was forced to stop production and purchase of material
and this in turn caused delay in time.
o As per the original contract, 19,608.47 m2 Quartz work require the
construction of the lift top, shear wall, fire escape Formwork:
 Crew composition=12 painter, 24daily laborer
 Output of 1crew for quartz paint=144 m2/day
 Total paint to be done=19608.47 m2
 Total number of days required for paint =136.11 days
=137days

4.2.1 The Approval of the material, purchase and Production require additional 30
calendar days.

4.2.2 In conclusion, the project completion date needs to be extended for (137+30) = 167
calendar days due to the delay in the issuance of quartz color specification.

4.3 The Contractor’s Entitlement

4.3.1 Extension to the Time for Completion


c) The contractor’s entitlement to an extension to the Time for completion is contained
within the provisions G.C.C Clause 74.1 (c),[The Contractor may request an extension of
the Intended Completion Date if he is or will be delayed in completing the contract
by…..Failure of the Engineer to provide instructions required for the execution of the
work on time”
d) Consequently the contractor is entitled to an extension of the Time for Completion to the
extent that completion of the project is delayed, which as explained in section 4.2 of this
document is 167 Calendar days.

5 Shortage of 10 Cm HCB
5.1 The Cause of the Claim

5.1.1 According to the contract S.C.C. Clause 1.2 and Annex A of the Contract, the HCB
supply is not the responsibility of the contractor. Accordingly delays in the supply
of HCB are justifiable causes for a time extension claim.
3.1.2 The issue of shortage of 10cm HCB and delay in supply thereof have been
repeatedly flagged by the contractor with letters written on 27/12/2010,
08/01/2011,09/01/2011 and 03/02/2011[Appendix C] .

5.2 The Effect

o Include 12-15 floors BLOCK Work and Plastering work.


 The construction 12-15 floor Block Masonry requires:
 Crew composition=3 mason,6 Daily laborer
 Output of 1crew for masonry work=72m2/day
 Total blockwork to be constructed=5124 m2
 Total number of days required for masonry wall=71.16 days
=72days
o The Curing of Block work requires additional 15 Days:

 Over all Block work requires=15+72=87days


 The Plastering of Constructed block masonry requires:
 Crew composition=6 Plasterer,6Daily laborer
 Output of 1crew for masonry work=50m2/day
 Total concrete to be constructed=10,248 m2
 Total number of days required for masonry wall=204.96
=205days

 Over all Shortage of 10 cm HCB requires=205+87=292days

5.3 The Contractor’s Entitlement

5.3.1 Extension to the Time for Completion


e) The contractor’s entitlement to an extension to the Time for completion is contained
within the provisions G.C.C Clause 74.1 (g),[The Contractor may request an extension of
the Intended Completion Date if he is or will be delayed in completing the contract
by…..other contractors, public authorities, utilities or the public body do not work within
the dates and other constraints stated in the contract, and they cause delay”
f) Consequently the contractor is entitled to an extension of the Time for Completion to the
extent that completion of the project is delayed, which as explained in section 5.2 of this
document is 292 Calendar days.

6 Conclusion
In conclusion the claim submitted herein contains the Contractor’s request for an extension of
Time for Completion up until September 1, 2019(i.e., A total sum of 534 Calendar Days
Requested Extension of Time under Section 3,4 & Section 5of this document)
