WHEREAS, the unregulated use of firecrackers and other pyrotechnic devices poses grave
threat to one’s well-being and disrupts public safety, to include the occurrence of firecracker-
related injuries and casualties and fire outbreak;
WHEREAS, to address the foregoing concerns, Republic Act No. 7183 was enacted
providing for the regulation and control of the manufacture, sale, distribution, and use of
firecrackers and pyrotechnic devices, consistent with, and in furtherance of, public safety,
order and national security, as well as the enhancement of the cultural traditions;
WHEREAS, former President Rodrigo R. Duterte issued Executive Order No. 28 dated June
20, 2017 providing stricter national standards, rules and regulations on the use of
firecrackers and other pyrotechnic devices to address the constant substantial number of
firecracker-related injuries and casualties recorded every year;
WHEREAS, in view of the above laws and issuances, the DILG issued Memorandum
Circular No. 2017-105 and 2017-168 to enjoin the Department of the Interior and Local
Government (DILG), Philippine National Police (PNP), Bureau of Fire Protection (BFP), and
local government units (LGUs) to take necessary actions on the regulation and control of the
use of firecrackers and other pyrotechnic devices, in compliance with the provisions of EO
No. 28.
A. Firecrackers
Baby Rocket - A firecracker with a stick so constructed that lighting of the wick will
propel the whole thing to lift a few meters before exploding. The firecracker is about
1 1/2 inches in length by 3/8 inch in diameter while the stick is about a foot in length;
Bawang - A firecracker larger than a triangulo with 1/3 teaspoon of powder packed in
cardboard tied around with abaca strings and wrapped in shape of garlic;
Small Triangulo - A firecracker shaped like a triangle with powder content less than
the bawang and usually wrapped in brown paper measuring 3/4-inch length in its
longest side;

B. Pyrotechnic Devices
Sparklers - Pyrotechnic devices usually made of black powder on a piece of wire or
inside a paper tube designed to light up and glow after igniting;
Luces - Any of several kinds of sparklers;
Fountain - A kind of sparkler conical in shape which is lighted on the ground and
designed to provide various rising colors and intermittent lights upon being ignited;
Jumbo Regular and Special - A kind of sparkler similar to a "fountain" but bigger in
size;
Mabuhay - Sparklers bunched into a bundle of a dozen pieces;
Roman Candle - A sparkler similar to a "fountain" but shaped like a big candle;
Trompillo - A pyrotechnic device usually fastened at the center and designed to spin
first clockwise and then counterclockwise and provides various colored lights upon
being ignited;
Airwolf - A kind of sky rocket shaped like an airplane with a propeller to rise about
forty (40) or fifty (50) feet and provide various kinds of light while aloft;
Whistle Device - Any of the various kinds of firecrackers or pyrotechnic designed to
either simply emit a whistle-like sound or explode afterwards upon being ignited;
Butterfly - Butterfly-shaped pyrotechnic device designed to lift above ground which
providing light;
All kinds of pyrotechnic devices (pailaw); and
Other types equivalent to the foregoing devices.
A. Manufacture of any type of firecrackers and other pyrotechnic devices within the
municipality is strictly prohibited;
B. Distribution and sale of allowable firecrackers and other pyrotechnic devices within the
municipality may be allowed provided:
It is conducted during festive occasions such as Christmas, New Year and local
fiestas;
It is conducted within the designated zones identified by the PNP and BFP and
approved by the LCE; and
It is conducted with the appropriate permit issued by the proper authority.
SECTION 4. PENALTIES. Use of prohibited firecrackers and other pyrotechnic devices and
any violation of Section 3 hereof shall be penalized in accordance with Section 11 of RA No.
7183.
A. Information and Education Campaign – IEC activities on the danger of using firecrackers
and other pyrotechnic devices shall be conducted regularly by the MHO, PNP, BFP and
DILG, in coordination with barangay officials, to prevent or mitigate firecracker-related
injuries and casualties, as well as fire outbreak;
B. Inspection, Licensing and Permitting – to ensure compliance of distributors, sellers and
fireworks display operators on the different safety guidelines, the PNP and BFP are

hereby directed to identify and/or inspect designated zones prior to the issuance of
appropriate permit;
C. Monitoring and Reporting – any case of firecracker-related injuries and casualties shall
be immediately reported by the concerned barangay officials to the PNP, BFP and MHO
for proper assistance. Said report shall be consolidated by the MHO and furnish the
Office of the Municipal Mayor and MLGOO for their information and reference.
SECTION 6. EFFECTIVITY. This Executive Order shall take effect immediately upon signing
hereof and shall remain effective until revoked.
