Review of Related Literature

            Cybercrime or RA 10175 is an act that prevents, investigates and suppress the


crimes on the internet world. It also imposes penalties of any offense made.The
contents of the law include the collaborative IRR of the law with its provisions,
punishable acts, penalties, enforcement, jurisdiction, and for other purposes

            Republic Act 10175 contents includes the punishable acts that were protested
by citizens of the Philippines such as cybercrime offense like illegal access, illegal
interception, data and system interference, misuse of devices, cyber squatting,
computer forgery, fraud and identity theft, most especially cybersex and child
pornography and unsolicited commercial communications, abetting in the commission of
cybercrime ( http://wordpress.com).

            People who are favorites of the bill include the online account owners, such as
facebook, twitter, email, online bank account owners who will be more worry free from
their passwords being hacked. Another is bloggers; web publishers, software
developers and any original computer data owners will also have a strong ownership
with their contents. And most especially are parents who will not be troubled that their
children will now be safe against child pornography and cybersex

            Cybercrime Prevention Act of 2012 has benefits especially among Filipino


citizens because it helps in maintaining peace for all internet users, lessen the cases of
hacked online accounts, giving acknowledgment of the owner of an software or
accounts made. But most especially is to stop cybersex and child pornography
( http://blogspot.com).

            Even if the Cybercrime Prevention Act of 2012 or Ra 10175 is opposed by many


media people, journalists and citizens, a Catholic Leader in the name of Legazpi Bishop
Joel Baylon urged the people to give the newly constituted law the chance to impose
the contents of the law ( http://cbcpnews.com ).
            Legazpi Bishop Joel Baylon as the Chairman of the CBCP Episcopal
Commission on Youth admitted that the law has prons and cons. He also stated that   it
is the right of the people to be protected from people on the internet with malicious
intentions and not only celebrities, politicians and other prominent people in the society
will be protected but also citizens affected by cyber bullying and e-libel. Baylon urged
the government to implement the IRR that will clear all the people's opposed reactions
and statements (http://cbcpnews.com ).

            From the contents of the law, it penalizes all cyber or internet related crimes
such as illegal publishing or plagiarism, distributing illegal files in the internet, illegal
access or usage of any computer data, hacking of online password of accounts, illegal
online services and among others, cybersex and child pornography which is very
rampant in the society today (http://vintage.com).

            The people who are against the Cybercrime Law are first, the hackers. Hackers
have two classifications, Black Hat Hackers and White Hat Hackers. Black Hat Hackers
are characterized as the bad hackers who hack just to show they can, without any
principle. While White Hat Hackers are the exact opposite. They are the people behind
the online hacked websites of some online accounts. Another is the computer / online
content thieves and illegal users, people who engage in illegal access, forgery and fraud

            However, a temporary restraining order was passed to the Congress by citizens


who opposed the harsh penalty for online libel for up to 12 years in prison and then the
TRO was issued by the Congress by citizens who opposed the harsh penalty for online
libel for up to 12 years and then the TRO was issued by the Congress suspending the
implementation of the law for 120 days. But in the meeting of top administration, the
order was effective immediately and the administration should refrain from enforcing the

            The announcement of the TRO was met with jubilation for some 500 protesters
massed in front of the court wearing black and wearing placards, the protesters called
for the impeachment of Mr. Aquino for signing the Cybercrime Law and chanted no to
cyber martial law ( http://gameface.ph )

            Anonymous Philippines, a group of Pinoy hackers hacked loads of Philippine


Government websites. The group protests about the internet libel which they believed
the end of the freedom of speech in the internet world. They now protests about the

            According to Rachel (2012) that the government should not only focus their
attention towards implementing the law because there are a lot of issues and problems
in the society that are more severe like murders and wars happening within the borders
of the country. There are malignant issues that should be solved than cybercrime
offenses because the life of people is more important than any money or reputation
loss.
