Mechanical engineering is a discipline of engineering that applies the


principles of physics and materials science for analysis,
design, manufacturing, and maintenance of mechanical systems.
It is the branch of engineering that involves the production and usage
of heat and mechanical power for the design, production, and operation

The BRAT Case

In the early 1970s, work was nearing completion on the Bay Area Rapid Transit (BART) system
in the San Francisco Bay metropolitan area. The design for BART was very innovative, utilizing
a highly automated train system with no direct human control of the trains. In the spring of 1972,
three engineers working for BART were fired for insubordination. During the course of their work
on the project, the three had become concerned about the safety of the automated control
system and were not satisfied with the test procedures being used by Westinghouse, the
contractor for the BART train controls.

Unable to get a satisfactory response from their immediate supervisors, the engineers resorted
to an anonymous memo to upper management detailing their concerns and even met with a
BART board member to discuss the situation. The information on the problems at BART was
leaked to the press by the board member, leading to the firing of the engineers. They
subsequently sued BART and were aided in their suit by the Institute of Electrical and
Electronics Engineers (IEEE), which contended that they were performing their ethical duties as
engineers in trying to protect the safety of the public that would use BART. Eventually, the
engineers were forced to settle the case out of court for only a fraction of the damages that they
were1 -seeking.

Based on the Case Study

• Reason being, they were concerned about the safety of the automated control
system and were not at all satisfied with the test procedure being used to control
the train.

Commissioning
• Process by which an equipment, facility, or plant (which is installed, or is complete
or near completion) is tested to verify if it functions according to its design
objectives or specifications.
• When new construction is planned, a commissioning engineer is hired by the
owner to provide independent oversight of the many contractors needed to install
heating, ventilation and air conditioning (HVAC), electrical and other systems for
the building.
• Many times, commissioning is not considered until a project reaches the
construction phase. While still valuable, employing a commissioning engineer
after construction begins means that there is less opportunity to organize and
plan ahead .

BEM Code of Professional Conduct
• The code of Professional Conduct describes the professional behavior of Engineers.
• Are amenable and have clear interpretation because of its legal connotations and would be
enforceable in law. Issues of morality and philosophy would be ineffective in law since it is
impossible to legislate moral or philosophical principles.
• Therefore, the BEM code can distinguish between legal and illegal cases.
• BEM lays down minimum baseline rules which are enforceable in law and must be observed
by all engineers registered under the Engineer’s Act.

The IEM Regulations on Professional Conduct


• Tend to be general because IEM members comprise of various engineering disciplines, as
well as types of professional employment and businesses.
• Involves moral and philosophical considerations including public safety & health,

Malaysia (ACEM) code
• is designed to order conduct of Consulting Engineers in areas like advertising and
promotion of works, fees and other remuneration, competition with other members,

• ACEM members are bound to observe the Codes of both BEM and IEM (if they are also
IEM members) and details rules to govern the conduct of Consulting Engineer’s business.
• The ACEM Code is designed to maintain strict discipline amongst their members to ensure
