SHORT TERM LEASE CONTRACT OF REAL PROPERTY

KNOW ALL MEN BY THESE PRESENTS:

This Short Term Lease Contract (“Contract”) is made and entered


into on this ___ day of ______, 2023, by and between:

________________________________, of legal age, Filipino, and a


resident of __________________________________________, and
herein after called the “LANDLORD”;

____________________________, a corporation duly organized


and existing under the laws of the Philippines, with office
address at
___________________________________________________________
______________________________, Philippines, and represented
in this contract by its Branch Operation Manager,
________________________________________________, of legal
age, Filipino, and resident of _____________________,
Philippines, and herein after called the “TENANT”

WHEREAS, Landlord is the owner of a certain parcel of land


located at ___________________________________________, Philippines,
which is a portion of the lot covered by Transfer Certificate of Title
No. ___________________, herein after called, the “PROPERTY”; and

WHEREAS, Tenant desires to lease the Property from Landlord,


subject to the terms and conditions set forth herein.

NOW, THEREFORE, in consideration of the foregoing premises,


the mutual promises and covenants contained herein, and other
valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the parties agree as follows:

1. PREMISES: That the premises to be rented is a portion of


the lot covered by Transfer Certificate of Title No.
__________________________, more particularly described as:

A rectangular area currently lightly covered by trees, and


with the following boundaries:

That, attached in this contract as ANNEX “A” and “B”


photographic rendering of the said area and its boundaries;

That, Landlord hereby leases the Property to Tenant, and


Tenant hereby accepts the lease of the Property from
Landlord, subject to the terms and conditions set forth in
this Contract;

2. TERM: The term of this lease shall be for a minimum period


of three (3) months, commencing on ____________________
and ending on ___________________, unless terminated
earlier pursuant to the provisions of this Contract. After the
lapse of three months, this Contract may be renewed on a
month-to-month basis, subject to the payment of rent as
set forth herein. Provided, that, the entire lease shall not
extend to twelve (12) months counted from the
commencement date;

3. RENT: Tenant agrees to pay the monthly rent of TEN


THOUSAND PESOS (PHP 10,000.00), Philippine Currency.
The rent for the initial three months of the lease shall be
paid in advance upon signing of this Contract. Thereafter,
rent shall be payable and demandable on the first week of
every extended month;

4. USE OF PREMISES: The Property shall be used by Tenant


solely for the purpose of parking its heavy equipment.
Tenant shall not use the Property as a barracks or housing
for its personnel, except for a guardhouse to house security
personnel that shall guard the equipment of Tenant. Tenant
shall also be responsible for maintaining the cleanliness of
the premises. Tenant should also not park, use and or
interfere with the peaceful use, in any way shape or form, of
the parking lot in front of the apartment building;

5. MAINTENANCE AND REPAIRS: Tenant shall maintain the


Property and keep it in good and clean condition. Tenant
shall undertake any necessary works to prevent damage to
existing structures and utilities, which shall include, but
not limited to, burying any protruding or uncovered water
utility hoses/tubes and the like, and shall be liable for any
damage caused to the Property, structures or utilities by its
operations. Tenant shall be responsible for the cost of
repairing any damage caused by its operations or use of the
Property;

6. WARRANTIES AND REPRESENTATIONS: Tenant hereby


represents and warrants that it has the legal authority to
enter into this Contract and that it shall comply with all
laws, rules and regulations applicable to its operations on
the Property. Tenant shall indemnify and hold harmless
Landlord from any and all claims, liabilities, losses or
damages arising from Tenant’s breach of this Contract or its
use of the Property;

7. INSURANCE: Tenant shall procure and maintain insurance


coverage against all risks of loss or damage to its equipment
while parked on the Property, as well as liability insurance
to cover any injury or damage caused by Tenant’s
operations or use of the Property;

8. DEFAULT: Tenant shall be in default of this Contract if it


fails to pay the rent when due, violates any of the terms and
conditions set forth herein, or engages in any illegal,
hazardous or nuisance activity on the Property. In the event
of a default by Tenant, Landlord may terminate this
Contract and evict Tenant from the Property, without
prejudice to any other rights and remedies available to
Landlord under Philippine law;

9. GOVERNING LAW AND JURISDICTION: This Contract


shall be governed by and construed in accordance with the
laws of the Philippines. Any disputes arising out of or in
connection with this Contract shall be submitted to the
exclusive jurisdiction of the courts of the Province of
_____________, or the City of ________________, _____________,
as the case may be, to the exclusion of all other courts.

10. ENTIRE AGREEMENT: This Contract constitutes the entire


agreement between the parties and supersedes all prior and
contemporaneous agreements and understandings, whether
oral or written, relating to the subject matter hereof. No
amendment, modification or waiver of any provision of this
Contract shall be valid unless in writing and signed by both
parties;

11. SEVERABILITY: If any provision of this Contract is held to


be invalid or unenforceable, the validity and enforceability
of the remaining provisions shall not be affected thereby;

12. WAIVER: The failure of either party to enforce any provision


of this Contract shall not be deemed a waiver of such
provision or of the right to enforce such provision.
