(1) Subject to the provisions of sub-section (9), there shall be levied and paid to the State Government on the ‘[consumption charges or the] units of energy consumed (excluding losses of energy custained in transmission and transformation by a licensee before supply to a consumer), a duty (hereinafter referned to as" eletricity duty") at the rates specified in the Schedule to this Act. XL] Maharashtra Electricity Duty Act. *[Provided that, a new industrial undertaking which begins to manufacture cor produce articles for the first time on any date after the commencement of the Bombay Electricity Duty (Amendment) Act, 1986 (hereinafter referred toin this sub-clause as "the said date"), shall make an application in the preseribed manner and form within two years from the said date ; and thereupon the provisions of this sub-clause shall apply to such undertaking from the said Sate!) {Provided further that,] the State Government may, either prospectively or retrospectively, by notification in the Official Gazette, exclude, — (@) any area aforesaid or any part thereof (regard being had to the price of energy prevailing therein and to the state of industrial development thereo!), or (@) any new industrial undertaking “for class of new industrial undertaking, subject to such conditions and restrictions,] as may be specified in this behalf by the State Government in such notifieation, and therenpon the provisions of this claaze shall aot apply in those areas or part thereof or in relation to such new industrial undertaking, ‘[or clase of new industrial undertaking) 4. (1) Every licenses shall collect and pay to the State Government at the time and in the manner prescribed, the proper electricity duty payable under this Act on the “fconsumption charges) of energy supplied by him to consumers. ‘The duty so payable shall be a first charge on the amount recoverable by the licences for the energy supplied by him and ehall be a debt due by him to the State Government: Provided that where the licensee has been unable to recover his dues for the energy cupplied by him, he chall not be Liable to pay the duty in reapect of the energy s0 supplied. (Z) The State Government may, by notification in the Official Gazette, appeint any person aa it thinks fit, having the prescribed qualifications to he Tnspectors for the purposes of this Act (2) Every Inspector shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code 7. (d)Subjectto the provisions ofany rules made by the State Government in this behalf, an Inspector may— (O require production for inspection of such books and records as may be necessary for ascertaining or verifying the amount of electricity duty leviable under the Act; Gi) enter and eearch any premises where energy is, or is believed to be eupplied for the purpose of — (©) verifying the statements made in the books of account kept, and returns submitted, under section 5, () teoting the reading of meters, (©) verifying the particulars requiredin connection with levy of electricity duty; id) exercise euch other powers and perform euch other duties ae may be necessary for carrying out the purpose ofthis Act or the rules made thereunder. (2)All searches made under eub-section (1) shall be made in accordance with the provisions of *[ the Code of Criminal Procedure, 1978]. * (TA. An appeal against the decision of the authority under sub-section (1) of section 4A shall lie to the State Government and such appeal shall be made within sixty days from the date of the decision, ‘7B. Where no appeal is made under section 7A, the State Government may, at anytime, suo motu, for the purpose of satisfying itself as to the legality or propriety of the decision of the authority under sub-section (1) of ection 4A, call for and examine the record of the case. If it appears to the State Government that any decision so called for should be modified, anmulled or reversed, the State Government may, after giving the person affected thereby, an apportunity of being heard, pase such order thereon as it thinks just] 8. (2) Where an offence under this Act has been committed by a company, companies: every person who at the time the offence was committed was in charge of, and was seeponsible to the company for the conduct of the business ofthe company, ‘26 well as the company shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly : Provided that nothing contained in this sub-section shall render any euch, ‘person Liable to any punishment provided in this Actifhe proves that the offence ‘vas committed without his knowledge or that he exercised all due diligence to prevent the commission of such offence (@) Notwithstanding anything contained in sub-section (1), where an offence under thie Act las been committed by a company and it ie proved that the offence has been committed with the consent or connivance of, or is attributable to any neglect on the part of, any dizector, manager, secretary or other officer of the company, such director, manager, secretary or other officer shall alzo be deemed to be gulity of that offence and hall be Kable to be proceeded against ‘and punished accordingly. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may— (a)preccribe the time and manner of payment of the electricity duty under section 4; (o)preseribe the form of the books of aecount to be kept, and the times at which, the form in which and the officers to whom the returns required by section 6 shall be submitted ; (© prescribe the qualifications of Inspectors under section 6 ; (@prescribe the rales. if any, subject to which the Inspectors may exercise the powers under section 7; {(e) provide for installation and the reading of meters and sub-meters 5 (A preseribe the procedure for securing any concession or exemption under the Acts (@ provide for charging fees for the supply of copies of any documents under the Act ; (i) preseribe the procedure for referring questions to the authority, and for filing an appeal to the State Goverament against the decision of ouch authority, under paragraph II ofthe Schedule 2I(7] provide for giving effect to the provisions of thie Act. (2) _ Tho making of rules under thie cection chall be eubject to the condition of previous publiestion. 5{(4) Every rule made under this section shall be laid, as soon as may be after it is made, before each House of the State Legislature while itis in session for «8 total period of thirty days which may be comprised in one session oF in two succestive sessions, and if before the expiry ofthe cession in which itis oo laid or the cession immediately following, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall from the date of publication of notification in the Official Gazette of such decision have effect only in such modified form or be of no effect, as the case may be; s0 however that any such modification or annulment shall be ‘without prejudice to the validity of anything previowely done or omitted to be done under that rule.] 18.
