PROJECT BASED EMPLOYMENT

CONTRACT
KNOW ALL MEN BY THESE PRESENTS:

This PROJECT BASED EMPLOYMENT CONTRACT, entered and executed


by and between:

ERAÑO D. TIMBANG, of legal age, Filipino, married, with


residence and postal address at Brgy. Virgen Delos Remedios, Bamban
2317, Tarlac, Philippines, hereinafter referred to as the
“EMPLOYER”,

– and –

__________________, likewise of legal age, Filipino,


single/married, with residence and postal address at
__________________________________, Philippines,
hereinafter called the “EMPLOYEE”,

W I T N E S S E T H: THAT—

WHEREAS, the EMPLOYER is engaged in a Construction Business as a


CONTRACTOR and is in need of a qualified, skilled and capable workers for his
Project;

WHEREAS, the EMPLOYEE has represented and warranted himself as a


qualified, skilled and capable worker and the EMPLOYER has accepted the offer of
the EMPLOYEE for his Project;

NOW THEREFORE, for and in consideration of the foregoing premises


and the covenants and undertakings hereinafter set forth, the parties hereto agrees
as follows:

1. Work Description: The EMPLOYEE shall perform as


______________ and all other tasks which are necessary for the
accomplishment of his responsibilities.

2. Employment Status: The EMPLOYEE shall be considered as a


project-based employee for _____ (_____) months commencing on
_____________ to _____________.

3. Employee’s Salary: The EMPLOYEE shall have a salary of


__________________________ (Php__________) PESOS,
Philippine Currency, per day, which shall be paid weekly or every
Saturday/Sunday.

Performance Bonus and 13th month pay shall be given to the


EMPLOYEE, the amount being dependent upon EMPLOYEE’s
performance after thoroughly evaluations and Fringe Benefit shall be
given to the EMPLOYEE upon expiration of his contract.

4. Salary Deduction: The EMPLOYER shall deduct the necessary


amounts allowed by law from the EMPLOYEE’s salary, such as but not
limited to Social Security System (SSS) and Pag-IBIG contributions.

5. Regular Work Days: The EMPLOYEE’s work week shall be from


Monday to Saturday.

6. Regular Working Hours: The EMPLOYEE shall work from _____
(_____) o’clock in the morning until _____ (_____) o’clock in the
afternoon.

7. Lunch/Breaks: The EMPLOYEE shall have a lunch period of one (1)


hour and two (2) 10-minute breaks are also provided to the EMPLOYEE.

8. Overtime: The EMPLOYER may require the EMPLOYEE to render


overtime work when the need arises. The EMPLOYEE shall be entitled to
overtime pay during rendition of the overtime work.

9. The PARTIES herein mutually agreed that there is no employer-


employee relationship but only for works given by him for the
accomplishment of his responsibilities.

10. The PARTIES undertakes to abide faithfully by the terms and conditions
of this agreement and that the same is binding upon their heirs, assigns
and successors in interest No amendments, modifications or alterations
to this CONTRACT shall be valid without the signature of all the
PARTIES to this agreement.

IN WITNESS WHEREOF, the PARTIES have hereunto affixed their

ACKNOWLEDGMENT

me known to be the same persons who executed the foregoing instrument and
acknowledgment to me that the same is their free act and voluntary deed.

This instrument refers to a PROJECT BASED EMPLOYMENT CONTRACT


consisting of two (2) pages, including this page whereon this acknowledgement is
written, has been signed by the parties and their instrumental witnesses on each
