The Grand Jurors of the State of Mississippi, taken from the body of good and lawful
persons of the First Judicial District of Hinds County, in the State of Mississippi, elected,
impanelled, sworn and charged to inquire in and for said District, County and State aforesaid, in
the name and by the authority ofthe State of Mississippi, upon their oath present: That

Kenya McCarty
while acting in concert and/or aiding, assisting or encouraging another or others,
to-wit: Avery Willis and James Land

In said First Judicial District of Hinds County, Mississippi

COUNT I

on, about and between the 2nd day of January, 2023, in the county aforesaid and within the
jurisdiction of this Court, the said defendant being a female human being above the age of
eighteen ( 18) years, did willfully, unlawfully, and feloniously, without any premeditated design to
effect the death of Keith Murriel, kill Keith Murriel, a male human being, without the authority of
law by any means or in any manner during the commission of an act eminently dangerous to
others and evincing a depraved heart, regardless of human life; to-wit: Kenya McCarty, while
serving as a City of Jackson Police Officer and/or while acting in concert and/or aiding, assisting
or encouraging City of Jackson Police Officer Avery Willis and/or City of Jackson Police Officer
James Land, used physical force on Keith Murriel, causing Keith Murriel's death, which included
jolting Keith Murriel with electricity, multiple times, with a police issued tazer, assisted in the
jolting of Keith Murriel with electricity, multiple times, with a police issued tazer and placing
Keith Murriel in a patrol car in an unsafe manner, all acts, whether occurring individually and/or
cumulatively, that were eminently dangerous to Keith Murrie! and evincing a depraved heart,
regardless of human life, all occurring within the jurisdiction of this court and in violation of
Section 97-3-19(1)(b), Mississippi Code Annotated (1972, as amended).

All of the above, Count I, being contrary to the form of the statute in such cases made and
provided, and against the peace and dignity of the State of Mississippi.

without the authority of law by the act, procurement, or culpable negligence, not provided for in
Section 97-3-1 through Section 97-3-117, ofthe Mississippi Code Ann, to-wit: James Land, while
serving as a City of Jackson Police Officer and/or while acting in concert and/or aiding, assisting
or encouraging City of Jackson Police Officer A very Willis and/or City of Jackson Police Officer
Kenya McCarty, used physical force on Keith Murrie!, causing Keith Murriel's death, which
included, assisting Officers A very Willis and Kenya McCarty in the jolting of Keith Murrie! with
electricity, multiple times, with a police issued tazer and placing Keith Murrie! in a patrol car in
an unsafe manner, all acts, whether occurring individually and/or cumulatively, of culpable
negligence which were conscious and wanton or in reckless disregard of the probabilities of the
fatal consequences to Keith Murriel, and created an unreasonable risk that said culpable negligent
acts posed to the life of Keith Murrie!, all occurring within the jurisdiction of this court and in
violation of Section 97-3-4 7, Mississippi Code Annotated ( 1972, as amended).

All of the above, Count I, being contrary to the form of the statute in such cases made and
provided, and against the peace and dignity of the State of Mississippi.
