LO1:

1. Read the legal document in the given link:

- Who (which UK organ) made it?
- What are its content?

2. Read case [2021] UKSC 3 and answer the following questions:


- Who sued whom in this case?
- Which court decided this case?
- In deciding this case, which precedent had been used?
- Which UK courts would be bound by (have to follow) this case?

3. Describe role/ participation of UK Cabinet (Government) in the making of law in UK


(both legislation and case law).

4. Kevin was born as a female but had lived as a man and had undergone gender
reassignment surgery. Kevin and Jennifer wanted to get married. However, the
Marriage Act 1961 required the marriage should be performed between a man and
a woman. There is an argument that because Kevin was born as female, therefore
the marriage between two women could not be valid. Use one of the rules for
statutory interpretation to advise Kevin and Jennifer on whether they can get
married or not.

5. Gym For All (GFA) has recently upgraded many of its new facilities and the owner of
the gym posted the advertisement on the Gyms public Facebook page stated: “The
first 10 people to complete 2km on the gyms new water rower in under 7 minutes
will win 1 Annual membership worth €1,500.” Paul saw the GFA’s advertisement and
instantly went to complete the challenge in under the required 7 minutes. But when
Paul claim one of the first 10 memberships, the owner informed him afterwards that
he had replaced the first notice with another on the Facebook page and the offer
was no longer available. The owner stated he was no longer doing the promotion
and no free memberships will be given out. Advise Paul on whether he can get free
annual membership of GFA or not.

6. Raven was working for Road-Runner Transport as office manager. She was in charge
of paying bills and invoices of suppliers (office rent, electricity, etc.) and employees’
salary from the company’s budget. Everything was going smooth and effective.
However, when the Road-Runner Transport had a new owner, situation become
worst. Because of the late payments from the company’s budget, Raven cannot
manage office properly and she received many complaints from suppliers as well as
from company employees. New leaders of company also told some employees that
Raven is not a person suitable for the position of office manager.
Raven resigned because of stress. She then sued Road-Runner Transport on unfair
dismissal. Can Raven win the case?

7. Jessica and her daughter Belinda spent holidays in a High Heaven, a big resort that
has amusement park with lots of entertainment games. Belinda chose to ride on a
big wheel. Due to the poor maintenance by High Heaven, her cabin and some
other cabins had disconnected from the wheel and felt to the ground, causing her
and many other kids seriously injured. Matthew, the big wheel operator, also got
nervous shock. Tom, a guy sitting on one of the cabin, did not suffer any physical
injury, so he tried to rescue the injured kids. Even though at the time of accident,
Jessica was away from the site, but she also got nervously shocked when she saw
her injured daughter in the hospital. Later, Jessica, Belinda, Matthew and Tom
sued High Heaven for damages.
Based on theory of tort of negligence and nervous shock and relevant case law,
discuss situation of Jessica, Belinda, Matthew and Tom and the possible outcome of
the case for each of them.

8. Bill, Donald and George are partners in an unlimited partnership called KwicPic. In
the course of the partnership business, George undertook to restore a valuable
painting for a customer. George carried out the work negligently and the painting
is irreparably damaged. The customer proposed to sue both for tort and for
breach of contract.

Explain the potential liability of KwicPic, Bill, Donald and George on the basis that

11. Hard Steel sold to Smart Constructor 5 tons of construction steel for £28,000.
When dispute arise from the contract, Hard Steel decided to sue Smart
Constructor to the court.

the claim until is decided the case.
